Description

Toronto City Council will be considering recommendations to establish a separate municipal code for sidewalk cafés, public parklets, and marketing displays and to adopt amendments to the Toronto Municipal Code, Chapter 27, Council Procedures, respecting delegation, and amendments to Chapter 441, Fees and Charges.

It is proposed that the by-laws be adopted at the Council meeting to be held on March 27, 2019 or at a subsequent meeting.  If adopted by City Council, the proposed amendments will:

1.  Establish a separate municipal code for sidewalk cafés, public parklets, and marketing displays

2.  Amend the delegated authority to Community Councils in Chapter 27, Council Procedures respecting:

- appeals in relation to the location, design and safety of parklet cafés and public parklets, and appeals in relation to the pedestrian clearway requirements for sidewalk cafés

- the revocation of a sidewalk café permit, marketing display permit, and public parklet permit and cancellation of permission for the use of any portion of the sidewalk or street at any time and for any reason

- temporary road closures for the purposes of permitting parklet cafés and public parklets

3.  Amend fees in Chapter 441, Fees and Charges to include new fees for sidewalk cafés, public parklets and marketing displays.

At its meeting to be held in Committee Room 1, 2nd Floor, Toronto City Hall on Wednesday March 6, 2019, at 9:30 a.m., or as soon as possible thereafter, the Economic and Community Development Committee of Toronto City Council will hear in person or by his or her counsel, agent or solicitor, any person who wishes to speak to the matter.

Any comments received after the Committee meeting will be forwarded to Council.

While the staff report sets out proposed changes, the Committee and/or City Council may adopt additional or other amendments that differ from the recommendations set out in the report.  The proposed amendments are subject to the decision of the Economic and Community Development Committee and the decision of Toronto City Council. 

If this matter is postponed at the Committee meeting or Council meeting or considered at a subsequent Committee or Council meeting, no additional notice will be provided other than the information on the subsequent Committee or Council agenda.  Please contact the above City officials if you require notice in these cases.

The Economic and Community Development Committee will make its final recommendations on March 6, 2019 which will be forwarded to City Council on March 27, 2019.
