Vehicles-for-Hire By-law Review

Notice is hereby given that Toronto City Council will be considering recommendations to adopt amendments to the following City of Toronto Municipal Code Chapters: Chapter 546, Licensing of Vehicles-for-Hire, Chapter 441, Fees and Charges, and Chapter 227, Reserves and Reserve Funds.

Description

It is proposed that the amendments be adopted at the City Council meeting to be held on July 16 and 17, 2019, or at a subsequent meeting. If adopted by City Council, the amendments to the City of Toronto Municipal Code Chapter 546, Licensing of Vehicles-for-Hire, will:

1.    Create an Accessibility Fund Program that is:

a.    funded through regulatory charges on members of the vehicle-for-hire and private transportation company industries that do not provide City-licensed wheelchair accessible service; and

b.    disbursed based on service standards and eligibility criteria to City-licensed wheelchair accessible drivers and owners that are not under contract with the Toronto Transit Commission's Wheel-Trans specialized transit service.

Additional amendments to the City of Toronto Municipal Code Chapter 441, Fees and Charges, Appendix C - Schedule 12, Municipal Licensing and Standards, will:

1.    Add the following regulatory charges for the Accessibility Fund Program, including an annual adjustment based on the Consumer Price Index:

a.    Taxicab Brokerage: $250.64 (per application or renewal)

b.    Limousine Brokerage: $250.64 (per application or renewal)

c.    Limousine Owner: $125.32 (per application or renewal)

d.    Private Transportation Company: $0.10 (per trip)

e.    Private Transportation Company Driver: $7.23 (per application or renewal)

f.     Standard Taxicab Operator: $125.32 (per application or renewal)

g.    Non-Accessible Standard Taxicab: $125.32 (per application or renewal)

h.    Vehicle-for-Hire Driver: $62.66 (per application or renewal)

2.    Amend the following Vehicle-for-Hire Licensing Fees to include an annual adjustment based on the Consumer Price Index:

a.    Taxicab Operator Application Fee: $500 (per application)

b.    Taxicab Operator Renewal Fee: $300 (per renewal)

c.    Private Transportation Company Application Fee: $20,000 (per application)

d.    Annual Private Transportation Company Driver Fee: $15 (per application or renewal)

e.    Private Transportation Company Per Trip Fee: $0.30 (per trip)

f.     Vehicle for-Hire Driver Application Fee: $130 (per application)

g.    Vehicle-for Hire Driver Renewal Fee: $130 (per renewal).

Additional amendments to the City of Toronto Municipal Code Chapter 227, Reserves and Reserve Funds, will:

1.    Add a Vehicle-for-Hire Reserve Fund to Schedule 7, Corporate Discretionary

Reserve Funds, to provide funding for initiatives associated with accessibility,

transportation planning, or environmental goals relevant to the vehicle-for-hire and private transportation company industries and to minimize the impact of the reliance on vehicle-for-hire and private transportation company licensing revenue for Municipal Licensing and Standards' Operating Budget.

2.    Fund the Vehicle-for-Hire Reserve Fund in an initial amount of $6.093 million from an in-year adjustment of the 2019 Operating Budget of Municipal Licensing and Standards and, afterwards, with budgeted allocations from vehicle-for-hire and private transportation company licensing, including regulatory charges on licensees that do not provide wheelchair accessible vehicle-for-hire services.

3.    Establish Municipal Licensing and Standards as the primary owner of the account, and establish a minimum targeted reserve balance of $5 million.

At its meeting to be held in Committee Room 1, 2nd Floor, Toronto City Hall on Monday, June 24, 2019 at 9:30 a.m., or as soon as possible thereafter, the General Government and Licensing Committee of Toronto City Council will hear in person or by his or her counsel, agent, or solicitor, any person who wishes to speak to the matter.

The proposed amendments are subject to the decisions of the General Government and Licensing Committee and City Council. Consequently, the proposed amendments may be modified. Additional or other amendments to the above-noted By-laws, including amendments not contemplated or considered in the proposal by Municipal Licensing and Standards staff, may occur as a result of the decisions of the Committee and City Council.

Any comments received after the Committee meeting will be forwarded to City Council.

While the staff report sets out proposed changes and fees, the Committee and/or City Council may change these proposals and adopt additional or other amendments that differ from the recommendations set out in the report, including fees that are higher or lower than the fees being proposed and/or new fees not contemplated in the staff report. The proposed amendments are subject to the decision of the Committee and the decision of City Council.  

If this matter is postponed at the Committee meeting or City Council meeting or considered at a subsequent Committee or City Council meeting, no additional notice will be provided other than the information on the subsequent Committee or City Council agenda. The General Government and Licensing Committee will make its final recommendations on June 24, 2019 which will be forwarded to City Council for its meeting July 16 and 17, 2019.
