City Council on May 8 and 9, 2012, adopted the following:

 

1.         City Council cancel the current Request for Proposals, and direct the General Manager, Parks, Forestry and Recreation to re-issue a Request for Proposal for all locations listed in the original bid, excluding the East York Arena and L'Amoreaux Sports Centre, after City Council has considered the report requested in Part 2 below.

 

2.         City Council request the General Manager, Parks, Forestry and Recreation, in consultation with the Acting Director, Purchasing and Materials Management, to develop a new strategy that will support community-based non-profit groups to operate food concessions in City facilities, and report to the Government Management Committee prior to the issuance of the next Request for Proposal for food concessions in Parks, Forestry and Recreation facilities, such report to identify the financial impact of the options.

That:

 

1.         Government Management Committee Recommendation 1 be amended by

 

a.         inserting the words "to renew the current DAF (delegated authority form) agreement with the East York Figure Skating Club for the operation of the Snack Bar at the East York Memorial Arena, for three years and to" after the word "Recreation" and replace the word "various" with the words "the remaining 22" ; and

 

b.         replacing the words "at the sole discretion of the General Manager, Parks, Forestry and Recreation, based on the terms and conditions set out in the RFP 0613-12-0034, and otherwise on terms and conditions satisfactory to the General Manager, Parks, Forestry and Recreation and in a form satisfactory to the City Solicitor;" with  the words "at the discretion of Council",

 

 so that Recommendation 1 now reads as follows:

 

1.         City Council authorize the General Manager, Parks, Forestry and Recreation to renew the current DAF (delegated authority form) agreement with the East York Figure Skating Club for the operation of the Snack Bar at the East York Memorial Arena, for three years, and to negotiate and enter into separate licence agreements with Donkey Kone Inc., and Global Brand Foods Inc., being the highest scoring proponents meeting the requirements of RFP 0613-12-0034, for the Operation and Maintenance of Food and Beverage Concessions at the remaining 22 Parks, Forestry and Recreation locations for a term of five (5) years commencing May 1, 2012 to April 30, 2017, with an option to renew for an additional five (5) year term at the discretion of Council.

The Government Management Committee recommends that:

 

1.         City Council authorize the General Manager, Parks, Forestry and Recreation, to negotiate and enter into separate licence agreements with Donkey Kone Inc., and Global Brand Foods Inc., being the highest scoring proponents meeting the requirements of RFP 0613-12-0034, for the Operation and Maintenance of Food and Beverage Concessions at various Parks, Forestry and Recreation locations for a term of five (5) years commencing May 1, 2012 to April 30, 2017, with an option to renew for an additional five (5) year term at the sole discretion of the  General Manager, Parks, Forestry and Recreation, based on the terms and conditions set out in the RFP 0613-12-0034, and otherwise on terms and conditions satisfactory to the General Manager, Parks, Forestry and Recreation and in a form satisfactory to the City Solicitor;

That the Government Management Committee:

 

1.         Request the Acting Director, Purchasing and Materials Management, in consultation with the General Manager of Parks, Forestry and Recreation, to include in the report on "social procurement", the feasibility of changes to the RFP process for food and beverage concessions in Parks Forestry and Recreation Facilities, that would give greater weight in the selection criteria to non-profit, community-based proponents, prior to the next RFP for these services.

 

2.         Request the Acting Director of Purchasing and Materials Management and the General Manager of Parks Forestry and Recreation to undertake discussions with the successful proponent, to determine if they would agree voluntarily to remove the East York Memorial Arena from the contract or inter into an alternate arrangement with the East York Skating Club that will assist the club in fulfilling its fundraising objectives, and report to Council on the outcome of these discussions.
