Summary

Councillor Joe Mihevc is requesting a minor addition to the Toronto Municipal Code Chapter 591 governing noise.  Article II of Chapter 591 does set out the general prohibition (591-2) that "No person shall make, cause or permit noise or vibration, at any time, which is likely to disturb the quiet, peace, rest, enjoyment, comfort or convenience of the inhabitants of the City."  Article II also sets out the specific provision (591-2.1) that "No person shall emit or cause or permit the emission of sound resulting from the operation of any electronic device or group of connected electronic devices incorporating one or more loudspeakers or other electro mechanical transducers, intended for the production, reproduction or amplification of sound, that projects noise beyond the lot line of the property from which the noise emanates and into any street or public place."

 

While Prohibition 591-2 is clear that no one shall make noise that disturbs the enjoyment of others in the City, Prohibition 591-2.1 only sets out that this noise shall not be made on "any street or public place".  Councillor Mihevc requests "or any residential neighbourhood" be added to Prohibition 591-2.1 to ensure that the enjoyment of people's backyards free of amplified noise is also clearly protected under the Municipal Code.  Councillor Mihevc believes this addition falls under the intent of Prohibition 591-2.
