City Council Decision

City Council on October 2, 3 and 4, 2012, adopted the following:

 

1.         City Council adopt the confidential recommendations and instructions to staff in the Confidential Attachment 1 to the report (August 21, 2012) from the Acting General Manager, Transportation Services.

 

2.         City Council authorize the public release of the confidential recommendations and instructions to staff in the Confidential Attachment 1 to the report (August 21, 2012) from the Acting General Manager, Transportation Services, if any settlement is finalized to the satisfaction of the General Manager, Transportation Services, in consultation with the City Solicitor, and that the balance of the information remain confidential.

 

Confidential Attachment 1 to the report (August 21,  2012) from the Acting General Manager, Transportation Services, remains confidential in its entirety at this time in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation.  The confidential recommendations and instructions to staff in Confidential Attachment 1 to the report (August 21,  2012) from the Acting General Manager, Transportation Services will be made public if any settlement is finalized to the satisfaction of the General Manager, Transportation Services, in consultation with the City Solicitor.

Committee Recommendations

The Public Works and Infrastructure Committee recommends that:

 

1.         City Council adopt the confidential recommendations and instructions to staff in the Confidential Attachment 1 to the report (August 21, 2012) from the Acting General Manager, Transportation Services.

Summary

The transportation and disposal of the City's street sweepings are currently governed by an agreement between the City and two companies: "Republic" for the disposal of the street sweepings at a landfill site and "Triwaste" for the transportation of the street sweepings to the landfill site.

 

The purpose of this report is to advise of a contractual dispute between the City and Republic and Triwaste and a proposed settlement of the dispute in relation to the transportation and disposal of the City's street sweepings during the period January to June 2011 and to receive direction in that regard from Council as set out in the Confidential Attachment to the report (August 21, 2012) from the Acting General Manager, Transportation Services.
