City Council on February 20 and 21, 2013, adopted the following:

1.         City Council, as approving authority under the Expropriations Act, approve the expropriation of temporary easements at 1065 Eglinton Avenue West, as set out in Appendix "A" and shown on Appendix "B1", to the report (February 11, 2013) from the City Solicitor for the purpose of works related to the construction of a launch shaft and crossover track in connection with the Project.

2.         City Council, as approving authority under the Expropriations Act, consider the report of Victor L. Freidin Q.C., Inquiry Officer as detailed herein and approve the expropriation of temporary easements at 1071 Eglinton Avenue West, as set out in Appendix "A" and shown on Appendix "B2", to the report (February 11, 2013) from the City Solicitor for the purpose of works related to the construction of a launch shaft and crossover track in connection with the Project for the reasons outlined herein and based on the recommendations of the Inquiry Officer.

3.         City Council, as expropriating authority under the Expropriations Act, authorize all necessary steps to comply with the Expropriations Act, including but not limited to the preparation and registration of an Expropriation Plan, service of Notices of Expropriation, Notices of Election as to a  Date for Compensation and Notices of Possession.

4.         City Council grant leave to introduce the necessary Bill in Council to give effect to Council's decision.

5.         City Council authorize the public release of the confidential information contained in Confidential Attachment 1 to the report (February 11, 2013) from the City Solicitor once there has been a final determination of the compensation payable for the subject property by arbitration, appeal or settlement to the satisfaction of the City Solicitor.

Confidential Attachment 1 to the report (February 11, 2013) from the City Solicitor remains confidential in its entirety at this time in accordance with the provisions of the City of Toronto Act, 2006, as it relates to a proposed or pending land acquisition by the City or one of its agencies, boards, and commissions and it pertains to litigation or potential litigation that affects the City or one of its agencies, boards and commissions.  Confidential Attachment 1 to the report (February 11, 2013) from the City Solicitor will be made public once there has been a final determination of the compensation payable for the subject property by arbitration, appeal or settlement to the satisfaction of the City Solicitor.
