City Council on July 16, 17, 18 and 19, 2013, adopted the following:

1.         City Council adopt the confidential recommendations in Confidential Attachment 1 to the report (July 9, 2013) from the City Solicitor.

2.         City Council authorize the public release of the confidential recommendations in Confidential Attachment 1 to the report (July 9, 2013) from the City Solicitor.

The following Recommendations in Confidential Attachment 1 to the report (July 9, 2013) from the City Solicitor were adopted by City Council and are now public:

1.         City Council instruct the City Solicitor to pursue the motion for leave to appeal to the Divisional Court from the Ontario Municipal Board (OMB) Decision of June 20, 2013 respecting 215 Sherway Gardens Road and instruct the City Solicitor to proceed with the appeal if leave is granted by the court.

2.         City Council authorize the appropriate City Officials to pay any costs of the motion for leave and any subsequent appeal, in the event the Divisional Court so orders.

3.         City Council authorize the City Solicitor and other staff to take all necessary and appropriate steps to implement Council's decision.

The balance of Confidential Attachment 1 to the report (July 9, 2013) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.
