Item - 2013.CC39.6

City Council on October 8, 9, 10 and 11, 2013, adopted the following:

1.         City Council adopt the confidential instructions in Confidential Attachment 1 to the report (September 26, 2013) from the City Solicitor.

2.         City Council authorize the public release of the confidential instructions adopted by Council in Confidential Attachment 1 to the report (September 26, 2013) from the City Solicitor with the remainder of Confidential Attachment 1 to remain confidential as it contains advice that is subject to solicitor-client privilege and information regarding pending litigation.

The confidential instructions contained in Confidential Attachment 1 to the report (September 26, 2013) from the City Solicitor were adopted by City Council and are now public:

1.         City Council authorize the City Solicitor to continue settlement discussions with the applicant.

2.         City Council authorize the City Solicitor to attend at the Ontario Municipal Board hearing in support of the rezoning application, provided that the applicant makes revisions to the plans with respect to the second floor layout, front yard landscaping, the height of the front landing and rear deck and other minor revisions, to the satisfaction of the City Solicitor, in consultation with the outside planning consultant.

The balance of Confidential Attachment 1 to the report (September 26, 2013) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006 as it contains advice that is subject to solicitor-client privilege and information regarding pending litigiation.
