City Council Decision

City Council on November 15, 2013, adopted the following:

 

That in accordance with section 27-7 of the Council Procedures, City Council suspend the necessary rules and substitute special rules for the balance of the current term of office, that give effect to the following:

 

1.         City Council suspend the power of the Mayor to appoint and dismiss the Deputy Mayor and Standing Committee Chairs under Section 27-40 of the Council Procedures.

 

2.         City Council confirm the appointment of the incumbents in the offices of Deputy Mayor and Standing Committee Chairs for the balance of this term.

 

3.         City Council confirm that the incumbent Deputy Mayor and the Standing Committee Chairs remain cross appointed to the Executive Committee.

 

4.         If vacancies occur, that the Deputy Mayor be appointed by City Council and the Standing Committee Chairs be elected by the respective committees.

 

5.         If a Standing Committee Chair resigns as a Chair and member of the Executive Committee, he or she would remain as a member of the committee on which they have served as Chair.

Motions (City Council)

Point of Order by Mayor Rob Ford

Mayor Ford, rising on a Point of Order, stated that his solicitor had asked him to seek clarification on whether or not he should declare a conflict of interest on Item CC42.1.

Ruling by Speaker Frances Nunziata
Speaker Nunziata accepted the Point of Order and asked the City Solicitor to respond.

The City Solicitor advised City Council that she is not in a position to offer any Member of Council advice as to whether or not they should declare an interest and recommended that Members of Council consult with their own lawyers for advice.

Speaker Nunziata subsequently advised Mayor Ford that the City Clerk similarly could not provide advice as to whether or not he should declare an interest and suggested that Mayor Ford consult with his lawyer.


Point of Order by Mayor Rob Ford

Mayor Ford, rising on a Point of Order, requested that the Integrity Commissioner be contacted so that he could consult with her.

Ruling by Speaker Frances Nunziata
Speaker Nunziata accepted the Point of Order and suggested that Mayor Ford ask his staff to contact the Integrity Commissioner on his behalf.


Point of Privilege by Councillor Karen Stintz

Councillor Stintz, rising on a Point of Privilege, stated that Councillor Ford was disrupting the meeting and asked the Speaker to issue a warning to Councillor Ford.  Councillor Stintz further stated that in the previous meeting she had risen on a Point of Privilege concerning Councillor Ford's interuptions and asked the Speaker to rule on that Point of Privilege now.

Ruling by Speaker Frances Nunziata
Speaker Nunziata did not accept the Point of Privilege regarding the previous meeting and advised City Council that she would rule on that matter once meeting 41 has resumed.

Speaker Nunziata asked Councillor Ford to respect the proceedings and advised that if he continued to disrupt other Members, she would have to ask him to apologize.
