City Council Decision

City Council on December 16, 17 and 18, 2013, adopted the following:

 

1.         City Council adopt the confidential instructions to staff contained in Confidential Attachment 1 to the report (December 9, 2013) from the City Solicitor.

 

2.         City Council authorize the public release of Recommendations 1, 2 and 3 in Confidential Attachment 1 to the report (December 9, 2013) from the City Solicitor, as well as Confidential Appendix "1" to Confidential Attachment 1 to the report (December 9, 2013) from the City Solicitor.

 

The following confidential Recommendations 1, 2 and 3 contained in Confidential Attachment 1 to the report (December 9, 2013) from the City Solicitor were adopted by City Council and are now public:

 

1.      City Council authorize the City Solicitor to accept the owner's without prejudice settlement offer, dated December 6, 2013, as set out in Confidential Appendix "1" to Confidential Attachment 1 to the report (December 9, 2013) from the City Solicitor and to finalize and execute the draft Minutes of Settlement also submitted which are in a form satisfactory to the City Solicitor.

 

2.      City Council authorize the City Solicitor to incorporate into the proposed Zoning By-law Amendment included with the settlement offer and which is to be presented to the Ontario Municipal Board, such technical and stylistic amendments as well as general amendments as may be necessary to implement and give effect to the intent of the terms of settlement, including the details of the proposed indoor amenity space for the existing rental buildings as may be agreed upon or directed by the Board.

 

3.      City Council authorize and direct City Planning staff, in advance of the Ontario Municipal Board hearing, to continue to negotiate with the appellant in an effort to resolve the details of the indoor amenity space as part of the improvements to the existing rental housing.
