EX34.4 - Impacts from the July 8, 2013 Storm Event on the City of Toronto

City Council Decision
City Council on October 8, 9, 10 and 11, 2013, adopted the following:
1. City Council reiterate its request to the Provincial and Federal governments for financial assistance to address the damage to property caused by the severe storm event on July 8, 2013.
2. City Council request the Provincial Government to enact legislation to require the insurance companies to develop a system of insurance premium credits to offer home-owners risk based incentives for investing in a range of flood mitigation measures.
3. City Council request the Provincial Government to require insurance companies to:
a. increase policyholder awareness at the point of sale or renewal with regards to flood insurance; and
b. provide easily understood contracts.
4. City Council request the Provincial and Federal governments to develop new programs for future disaster mitigation, including urban flooding (particularly in older cities), that reflect the reality of climate change and include investments for municipal water and sewer infrastructure including larger sized and new water holding tanks that can mitigate the risks from future storm events that are anticipated to increase both in frequency and severity.
5. City Council request the Provincial Government to enact legislation mandating back-up generators for food retailers.
6. City Council request the Provincial Government to ensure Preparedness Guidelines for Retailers are developed which can be provided to retailers in anticipation of extreme weather events.
7. City Council request the Provincial Government to reinstate the historical municipal/provincial capital cost shared funding arrangement for the Toronto and Region Conservation Authority (TRCA) most urgently required for erosion control and flood management and the related impacts on municipal infrastructure.
8. City Council reiterate its support for the Toronto and Region Conservation Authority's Watershed Protection Program to maintain the quality of our drinking water.
9. City Council request the Executive Committee as part of the Toronto Water 2014-2023 Capital Plan budget process, to consider the advancement of basement flooding remediation for those properties in floodplain areas of the City of Toronto.
10. City Council request the Executive Committee, as part of the 2014 Toronto Water Capital Budget process, to give consideration to restoring full funding to the Source Water Protection Program.
11. City Council direct the General Manager, Toronto Water, in preparation of the Toronto Water 2014-2023 Capital Plan, to report to the Public Works and Infrastructure Committee with recommendations to improve education and uptake on the Basement Flood Subsidy Program.
12. City Council direct the General Manager, Toronto Water to report on ways to improve the time required to process basement flooding subsidy applications as part of the 2014 budget process.
13. City Council direct the General Manager, Toronto Water to consult with the Ministry of the Environment on options available to the City of Toronto to reduce or eliminate the delay caused by adherence to the provisions of the Environmental Assessment Act for municipal or conservation authority projects needed to reduce the risk of residential flooding from severe rain storms.
14. City Council request the General Manager, Transportation Services and the General Manager, Toronto Water to report to the Public Works and Infrastructure Committee on the findings of the review that is currently underway on the flooding incidents on Lower Simcoe Street.
15. City Council request the General Manager, Toronto Water to renew Toronto Water's efforts to demonstrate to Infrastructure Ontario that the construction of the storm water pond on Ridge Park contributed to the flooding of homes in the Downsview Avenue community.
16. City Council request the General Manager, Toronto Water to demand that the storm water pond in Ridge Park be rebuilt to appropriate City of Toronto engineering specifications.
17. City Council request Infrastructure Ontario to reimburse Downsview Avenue area residents for losses and damages incurred as a result of the Infrastructure Ontario-built storm water pond on Ridge Park.
18. City Council request the General Manager, Toronto Water to make a presentation to the Public Works and Infrastructure Committee before the end of 2013, on international best practices for stormwater management and green infrastructure, and on the Wet Weather Flow Master Plan, and authorize the General Manager, Toronto Water to invite and arrange for local and international experts to participate in the presentation.
19. City Council request the General Manager, Toronto Water to report to the March 4, 2014 meeting of the Public Works and Infrastructure Committee on construction of detention tanks in the Don River Watershed as part of implementation of the Wet Weather Flow Master Plan.
20. City Council request the Deputy City Manager and Chief Financial Officer to develop an insurer engagement campaign to inform insurance providers about the comprehensive measures the City is taking to minimize loss and disruption from climate change risks.
21. City Council request the Deputy City Manager and Chief Financial Officer to report back on insurance and risk management matters related to basement flooding including options for potential mitigating measures; such report to address properties that do not have insurance due to previous flooding.
22. City Council convey this decision to the Association of Municipalities of Ontario, the Regional Public Works Commissioners of Ontario, the Regional Planning Commissioners of Ontario, and the Toronto and Region Conservation Authority.

That:
1. City Council direct the General Manager, Toronto Water to take steps to ensure that:
a. catch basins in the area bounded by Blackthorn Avenue, Chambers Avenue, Rowntree Avenue, and Rogers Road along with Coates Avenue, be maintained in a clean condition at all times;
b. the sewer systems be flushed and maintained in a clean condition and roads swept and flushed to prevent accumulation of construction and leaf debris that could block catch basins;
c. sewage holding tanks are functional and be inspected frequently and cleaned as necessary and cleaning equipment and crews to be on standby when significant rainstorms are forecasted;
d. residents be encouraged to install back flow protection valves and sump pumps and be informed of subsidies available under the Basement Flooding Protection Subsidy Program; and
e. due consideration be given to installing additional catch basins to alleviate basement flooding hardships at Roseneath Gardens and Blackthorn Avenue.

Committee Recommendations
The Executive Committee recommends that:
1. City Council reiterate its request to the provincial and federal governments for financial assistance to address the damage to property caused by the severe storm event on July 8, 2013.
2. City Council request that the provincial and federal governments develop new programs for future disaster mitigation, including urban flooding (particularly in older cities), that reflect the reality of climate change and include investments for municipal water and sewer infrastructure that can mitigate the risks from future storm events that are anticipated to increase both in frequency and severity.
3. City Council request that the provincial government reinstate the historical municipal/provincial capital cost shared funding arrangement for the Toronto and Region Conservation Authority (TRCA) most urgently required for erosion control and flood management and the related impacts on municipal infrastructure.
4. City Council convey the above recommendations to the Association of Municipalities of Ontario, the Regional Public Works Commissioners of Ontario, the Regional Planning Commissioners of Ontario, and the Toronto and Region Conservation Authority.
5. City Council direct the General Manager of Toronto Water to consult with the Ministry of the Environment on options available to the City of Toronto to reduce or eliminate the delay caused by adherence to the provisions of the Environmental Assessment Act for municipal or conservation authority projects needed to reduce the risk of residential flooding from severe rain storms.

Summary
The City of Toronto experienced an extreme storm during the early evening on July 8, 2013. The storm produced record level rainfall in Toronto resulting in power outages and major disruptions to transportation, sewer and water systems.
The storm event caused significant flooding that resulted in damage to both public and private property, including erosion damage to ravines, parks and roadways, which resulted in disruption and costs for the City, its residents and businesses. Other non-city owned infrastructure such as railways and electrical systems were damaged. The storm event highlighted the need for accelerated investment in infrastructure improvements required to prevent and/or mitigate risks from future storm events.
At its meeting of July 16, 17, 18 and 19, 2013, City Council passed a number of resolutions related to the storm event. Council directed staff to complete a full assessment of damage caused by the storm, seek financial assistance from the provincial and federal governments for damage to property and to report back on options for increased investment in infrastructure for Toronto Water, Toronto Hydro and the Toronto and Region Conservation Authority (TRCA) amongst other recommendations.
The purpose of this report is to:
- provide an initial update on private and public costs related to the storm;
- detail the expedited process for responding to insurance claims;
- update Council on steps taken to request assistance from the provincial and federal governments; and
- detail the schedule of staff activities that will address the balance of the storm related resolutions adopted by Council at its July meeting.
A report responding to Council's request for details on the condition of the sewer systems and storm water storage capabilities within the City and in particular in the west end will be considered at the September 20, 2013 meeting of the Public Works and Infrastructure Committee.
