City Council on April 1, 2 and 3, 2014, adopted the following:

 

1.    City Council extend its congratulations to all of Canada's Olympic and Paralympic athletes for their inspiring performances at the 2014 Sochi Winter Games.

Speaker Nunziata advised Council that the provisions of Chapter 27, Council Procedures, require that Motion MM50.27 be referred to the Community Development and Recreation Committee. A two-thirds vote of the Council Members present is required to waive referral.

Point of Order by Mayor Rob Ford

Mayor Ford, rising on a Point of Order, stated that he had voted incorrectly on MM50.21 and MM50.27, and requested that Council reopen the Items so that he may vote correctly.

Speaker Nunziata accepted the Points of Order and ruled that the Items could not be re-opened at this time as the same Members of Council who were present for the previous votes were not in the Chamber.

Councillor McConnell, rising on a Point of Order, stated that Members must immediately advise when they have voted incorrectly on an Item and taking another vote now will change the history of the vote, as all the Members who voted on these Items are not present in the Chamber.

Speaker Nunziata accepted the Points of Order and ruled that Items MM50.21, MM50.27 and MM50.38 could not be re-opened at this time as the same Members of Council who were present for the previous votes were not in the Chamber.

Councillor Filion, rising on a Point of Order, asked the Speaker to clarify whether Mayor Ford's corrected votes on Items MM50.21 and MM50.27 could be included without a reconsideration of the Items.

Point of Order by Councillor Gord Perks
Councillor Perks, rising on a Point of Order, stated that the City Clerk should inform Members if they are going to make a procedural error.  Councillor Perks further stated that the vote is displayed in the Chamber so Members can see if an error has been made, and if so re-open the vote to fix the error, and that Council cannot re-open at a later time based on who is or who is not in the Chamber.  Councillor Perks requested the City Clerk to advise Council of the relevant provisions of Roberts Rules of Order.

Councillor Perks, rising on a Point of Order, stated that he wished to hear the City Clerk's advice.

Point of Order by Councillor Janet Davis

Councillor Davis, rising on a Point of Order, stated that with the re-opening of Items MM50.21, MM50.27 and MM50.38, Members of Council are unclear on the acceptable practice to re-open items when a Member has made an error in voting.

Speaker Nunziata accepted the Point of Order and ruled that Council previously considered a motion to re-open a vote on an Item on the day after the original vote had taken place.

Councillor Davis, rising on a Point of Order, stated that the City Clerk should provide Council with a procedural interpretation on this matter.
