City Council Decision
City Council on February 19 and 20, 2014, adopted the following:
1. City Council amend former City of North York Zoning By-law 7625, for the lands at 784 Sheppard Avenue East substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 5 to the report (December 9, 2013) from the Director, Community Planning, North York District.
2. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.
3. As part of the Site Plan Approval, City Council direct that the applicant:
a. provide a pedestrian connection from the proposed development to Denrock Drive, including the legal arrangements necessary to have a portion of the existing reserve along the south limit of Denrock Drive to be dedicated for public highway purposes, to permit pedestrian access, only; and
b. provide lay-by parking on Sheppard Avenue East, fronting 784 Sheppard Avenue East.
4. City Council request the General Manager, Transportation Services to investigate the feasibility of extending and/or creating additional lay-by parking along Sheppard Avenue East, between Burbank Drive and Blue Ridge Road.
5. City Council direct that prior to the issuance of the first above grade building permit, the Owner shall convey off-site parkland to the satisfaction of the General Manager, Parks, Forestry and Recreation up to the value specified in the final appraisal from the Manager, Policy and Appraisal Services, Real Estate Services or provide the funds to the City's Parkland Acquisition Reserve Fund Account XR2216 for such acquisition to be carried out by the City; and that Chapter 415 of the Municipal Code, be amended, as may be required.

Summary
This application proposes to rezone the lands at 784 Sheppard Avenue East to permit the development of a two-storey retail building and a fifty unit stacked townhouse development of four-storeys in height with three levels of residential space, and one level with access to roof-top amenity space. The existing one-storey retail building would be demolished.
This report reviews and recommends approval of the application to amend the Zoning By-law.

Motions
That North York Community Council recommend that:
1. City Council adopt the staff recommendations in the Recommendations Section of the report (December 9, 2013) from the Director, Community Planning, North York District.
2. City Council adopt the following further recommendation:
"That prior to the issuance of the first above grade building permit, the Owner shall convey off-site parkland to the satisfaction of the General Manager, Parks, Forestry and Recreation up to the value specified in the final appraisal from the Manager, Policy & Appraisal Services, Real Estate Services or provide the funds to the City's Parkland Acquisition Reserve Fund Account XR2216 for such acquisition to be carried out by the City; and amend Chapter 415 of the Municipal Code, as may be required."
