City Council Decision
City Council on August 25, 26, 27 and 28, 2014, adopted the following:
1. City Council amend former City of North York Zoning By-law 7625 for the lands at 228 Wilson Avenue substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 6 to the report (July 21, 2014, form the Director, Community Planning, North York District, with modifications to the community benefits provided under Section 37 of the Planning Act in Schedule 3 to the draft Zoning By-law Amendment as per Part 4 below.
2. City Council determine that, pursuant to Section 34(17) of the Planning Act, no further notice is to be given in respect of the changes provided in Schedule 3 of the draft Zoning By-law Amendment.
3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.
4. Before introducing the necessary Bills to City Council for enactment, City Council require the Owner to enter into an Agreement pursuant to Section 37 of the Planning Act to secure the following benefits:
a. Prior to issuance of an above grade building permit the owner shall provide a financial contribution to the City in the amount of $325,000.00 for the following community benefits:
i. Capital improvements to local parks in the vicinity of the site;
ii. Streetscape improvements in the vicinity of the site;
iii. Fully furnished and equipped non-profit child care facilities in the vicinity of the site;
iv. Public Art in the vicinity of the site; or
v. Other non-profit arts, cultural, community or institutional facilities in the vicinity of the site;
b. The decision on how to allocate the financial contribution to one or all of the benefits provided in subsection a. above shall be made by the Chief Planner and Executive Director, City Planning, in consultation with the local Councillor;
c. The financial contribution referred to in subsection a. above shall be indexed upwardly in accordance with the Statistics Canada [Non-Residential or Apartment Building] Construction Price Index for Toronto, calculated from the date of the Section 37 Agreement to the date the payment is made; and
d. The following matters are also recommended to be secured in the Section 37 Agreement to support development:
i. The owner shall construct and maintain the development in accordance with Tier 1 performance measures of the Toronto Green Standard, as adopted by Toronto City Council at its meeting of October 26 and 27, 2009; and
ii. The owner shall submit and implement a Construction Management Plan and Neighbourhood Communication Strategy, prior to the issuance of the first building permit (including demolition and/or excavation permit), to the satisfaction of the Executive Director, Engineering and Construction Services in consultation with the Chief Planner and Executive Director, City Planning.
5. City Council direct the Chief Planner and Executive Director, City Planning to initiate a zoning by-law amendment for the lands occupied by Armour Heights Pumping Station directly east of 226 Wilson Avenue to rezone the lands to Open Space Zone (O).
6. City Council direct the Chief Planner and Executive Director, City Planning to liaise with a working group of residents from the low density neighbourhood located south of Wilson Avenue to determine if revisions to By-law 569-2013 pertaining to height, rear yard setback and lot coverage should be initiated for the lots fronting on the south side of Wilson Avenue between Avenue Road and Highway 401 to ensure it remains a transition and buffer to cause no adverse impacts to the low density residential neighbourhood to the south as it redevelops.
7. City Council direct the Chief Planner and Executive Director, City Planning to continue working with the working group of residents and the developer of 228 Wilson Avenue to finalize the site plan application.

That:
1. Summary
The application proposes to amend the former City of North York Zoning By-law No. 7625 to permit a 17-storey (57 metre) condominium apartment building at 228 Wilson Avenue. The building will contain a total of 108 dwelling units which includes four 2-storey townhouses type units fronting Wilson Avenue. There are 130 parking spaces proposed within a 5 level below grade parking garage. Access to the site would be provided from a driveway off Wilson Avenue at the east end of the site.
This report reviews and recommends approval of the application to amend the North York Zoning By-law 7625 and permit a 17-storey apartment building at 228 Wilson Avenue.
