Item - 2015.CC10.5

City Council, on November 3 and 4, 2015, adopted the following:

1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor.

2. City Council authorize the public release of the recommendations in Confidential Attachment 1 to the report (November 3, 2015) and City Council direct that the balance of Confidential Attachment 1 remain confidential at the discretion of the City Solicitor.

The following confidential instructions to staff in Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor were adopted by City Council and are now public:

1.  City Council accept the without prejudice offer to settle dated July 14, 2015 as amended by a without prejudice offer dated October 28, 2015 and further amended by letter dated October 29, 2015 and City Council direct the City Solicitor and other staff to attend at the Ontario Municipal Board hearing in support of the revised development proposal for 740 Dupont Street.

2.  City Council direct the City Solicitor to ask the Ontario Municipal Board to amend OPA 231 to allow the revised development proposal to proceed in conformity with the Official Plan.

The balance of Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor remains confidential at the discretion of the City Solicitor in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation that affects the City and it contains advice or communications that are subject to solicitor-client privilege.
