CC3.1 - 693 Bathurst Street - Central Tech Dome - OMB Hearing - Request for Directions Report - Status

City Council Decision

City Council on February 10 and 11, 2015, adopted the following:

 

1.         City Council adopt the recommendations in Confidential Attachment 2 to the report (February 9, 2015) from the City Solicitor.

 

2.         City Council authorize the public release of the recommendations in Confidential Attachment 2 to the report (February 9, 2015) from the City Solicitor.

 

3.         City Council authorize the public release of Confidential Attachments 2-A, 2-B, 2-C and 2-D to the report (February 9, 2015) from the City Solicitor at the discretion of the City Solicitor.

 

The following recommendations in Confidential Attachment 2 to the report (February 9, 2015) from the City Solicitor were adopted by City Council and are now public:

 

1.         City Council endorse the Settlement Proposal as described in Confidential Attachment 2-A.

 

2.         City Council authorize the City Solicitor to enter into Minutes of Settlement with the other Parties to the OMB appeal, in order to implement the Settlement Proposal.

 

3.         City Council authorize the City Solicitor and appropriate City staff to attend the Ontario Municipal Board and not oppose the requested minor variance, provided that it is subject to the agreed-to conditions, as per the Settlement Proposal and Minutes of Settlement.

 

4.       City Council request the Ontario Municipal Board to withhold its Order approving the minor variance until the Toronto District School Board and Raizenne Inc. have entered into one or more agreements with the City pursuant to Section 45(9.1) of the Planning Act to the satisfaction of the Chief Planner and Executive Director of City Planning and the City Solicitor, to ensure that appropriate conditions of approval are secured.

 

Confidential Attachments 2-A, 2-B, 2-C and 2-D to the report (February 9, 2015) from the City Solicitor remain confidential in their entirety at this time in accordance with the City of Toronto Act, 2006, as they pertain to a litigation matter before the Ontario Municipal Board and advice that is subject to solicitor-client privilege.  Confidential Attachments 2-A, 2-B, 2-C and 2-D to the report (February 9, 2015) from the City Solicitor will be made public at the discretion of the City Solicitor.

February 10, 2015 at 7:15 p.m. - Speaker Nunziata advised that City Council had completed its closed session consideration of Item CC3.1 headed "693 Bathurst Street - Central Tech Dome - OMB Hearing - Request for Directions Report - Status".  No motions were made in closed session. Council would now proceed with the public debate on the Item.
