City Council Decision

City Council on March 31, April 1 and 2, 2015, adopted the following:

 

1.  City Council adopt the recommendations in Confidential Attachment 6 to the report (March 24, 2015) from the City Solicitor.

 

2.  City Council authorize the public release of the recommendations in Confidential Attachment 6 to the report (March 24, 2015) from the City Solicitor.

 

The following recommendations in Confidential Attachment 6 to the report (March 24, 2015) from the City Solicitor were adopted by City Council and are now public:

 

 1.  City Council authorize the City Solicitor and appropriate City staff to attend the Ontario Municipal Board hearing in support of the revised proposal for 2849, 2851, 2853, 2855 and 2857 Islington Avenue based on the following:

 

a.  The applicant's February 27, 2015 revisions and the applicant's correspondence dated February 27, 2015, as described in the Request for Direction Report dated March 24, 2015, from the City Solicitor.

 

2.  City Council authorize the City Solicitor to request the OMB to withhold its Order on the Official Plan Amendment and Zoning By-law Amendment appeal pending:

 

a.  Receipt of confirmation from the City Solicitor that the final form of the amendment to the former City of North York Zoning By-law No. 7625 and the City of Toronto Zoning By-law No. 569-2013 is to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor.

 

b.  Receipt of confirmation from the City Solicitor that the final form of the amendment to the City of Toronto Official Plan is to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor.

 

c.  Receipt of confirmation from the City Solicitor that the owner has submitted a revised Site Servicing and Stormwater Management Report to the satisfaction of the Executive Director of Engineering and Construction Services and that the owner has made satisfactory arrangements with Engineering and Construction Services staff for the construction of any improvements to the municipal infrastructure should it be determined that upgrades are required to the infrastructure to support this development, according to the Site Servicing and Stormwater Management Report accepted by the Executive Director of Engineering and Construction Services.

 

d.  Receipt of confirmation from the City Solicitor that the application for a Section 111 permit pursuant to Chapter 667 of the City of Toronto Municipal Code for the demolition of the existing rental units has been approved by City Council.

 

3.  City Council authorize the City Solicitor and other City staff to take such actions, as are required, to implement Council's decision.

 

The balance of Confidential Attachment 6 to the report (March 24, 2015) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006 as it pertains to litigation or potential litigation and contains advice that is subject to solicitor-client privilege.
