Item - 2015.EX4.4

That City Council amend Executive Committee Recommendation 1 by:

a. adding the words “utilization and” in the lead in phrase; and

b. adding the following two new parts:

d. recommends changes to the “pupil accommodation” formula and Regulation 444/98 of the Education Act to address issues of common concern related to utilization of school space for education and community use;

e. develops a new model for more coordinated capital and land-use planning;

so that Recommendation 1 now reads:

1. City Council direct the City-School Boards Advisory Council to prioritize in its 2015- 2016 work plan, the development of a new multilateral, consultative relationship for the City of Toronto, the School Boards and the Province of Ontario with respect to schools lands utilization and disposition that:

a. takes into consideration the full value of schools as community assets, in addition to their value as educational institutions;

b. provides a viable framework for retaining public ownership of former school properties when there is agreement among the parties that the site should be retained;

c. identifies alternative funding sources beyond municipal funding to keep schools as community assets;

d. recommends changes to the “pupil accommodation formula" and Regulation 444/98 of the Education Act to address issues of concern related to utilization and funding of school space for educational and community uses;

e. develops a new model for more coordinated capital and land-use planning;

That City Council amend Executive Committee Recommendation 3 by deleting the words “studies of potential school sales and closures” and replaceing them with “Pupil Accommodation Review studies, reviews of sites transferred to Toronto Lands Corporation and other processes” so that the recommentation now reads:

3.  City Council request the Province and the Toronto District School Board (TDSB) to engage the City of Toronto as a strategic partner in the 2014-2016 Pupil Accommodation Review studies, reviews of sites transferred to Toronto Lands Corporation and other processes.

That City Council amend Executive Committee Recommendation 2 by adding the words "and to also consider compliance with Access for Ontario with Disability Act (AODA) requirements" so that it now reads as follows:

2.  City Council direct the City-School Boards Advisory Council to report back to Executive Committee on these issues by the fourth quarter of 2015 and to also consider compliance with Access for Ontario with Disability Act (AODA) requirements.

That City Council request that this Item be forwarded to the Association of Municipalities of Ontario to support a new multi-lateral consultative relationship between municipalities, school boards and the Province of Ontario.

That City Council direct the City Solicitor to report to the September 3, 2015 meeting of the Planning and Growth Management Committee on the ability of the City to require an application to be in place before a demolition permit is issued for a school site.

That City Council direct the Acting Deputy City Manager, Cluster A report to the City-School Boards Advisory Committee, as part of its 2015-2016 Workplan:

1.  with a site location map that shows proximity of schools with utilization rates of 65% or lower to the nearest subject or replacement school, and the ability to locate an existing day care centre in any and all new destination neighbourhood schools.

2.  on potential restitution or compensation options to the City of Toronto for capital investments made in such schools subject to disposition, including, but not restricted to, day care centres, pools, playground improvements and reading gardens.

3. on school catchment and bussing policies and whether such can be amended to build capacity and increase enrollment in schools with low utilization rates.

That Recommendation 1.c be amended so that it now reads as follows:

1.c.  identifies alternative funding sources beyond municipal funding to keep schools as community assets.
