Item - 2015.MM10.16

City Council on November 3 and 4, 2015, adopted the following:

1.  City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor.

2.  City Council direct that the confidential instructions to staff in Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor and Appendix 1 be made public and City Council direct that the balance of Confidential Attachment 1 remain confidential. 

The following confidential instructions to staff  in Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor were adopted by Council and are now public:

1.  City Council authorize the City Solicitor and the Chief Planner and Executive Director, City Planning to attend before the Ontario Municipal Board, including the Ontario Municipal Board pre-hearing on November 5 and 6, 2015, in support of  amendments to: Section 2.4, Objectives; Section 6.1, Heritage Policies; and Section 6.3.16, The Public Realm, of Official Plan Amendment 183 (By-law 1507-2013) substantially as set out in Appendix "1" to Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor and all in a form satisfactory to the City Solicitor and the Chief Planner and Executive Director, City Planning and subject to such revisions as are acceptable to both the Chief Planner and Executive Director, City Planning and the City Solicitor.

2.  City Council direct the Chief Planner and Executive Director, City Planning to amend Schedule 4 and Maps 7a and 7b of the Official Plan to incorporate the described views set forth in Section 6.3.16 as amended of Official Plan Amendment 183 (By-law 1507-2013) upon the coming into force of Section 6.3.16 as amended.

Appendix 1 to Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor is now public and can be accessed under Background Information (City Council).

The balance of Confidential Attachment 1 to the report (November 3, 2015) from the City Solicitor remains confidential in accordance with the provision of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board and it contains advice that is subject to solicitor-client privilege.
