City Council Decision

City Council on December 11, 2014, adopted the following:

 

1.         City Council direct the City Clerk to advise the Registrar of the Alcohol and Gaming Commission of Ontario that the issuance of a liquor licence for Nine at 9 Roncesvalles Avenue is not in the public interest having regard to the needs and wishes of the residents unless conditions are placed on the licence and that the Registrar should issue a Proposal to Review the liquor licence application.

 

2.         City Council request the Alcohol and Gaming Commission of Ontario to provide the City of Toronto with an opportunity to participate in any proceedings with respect to the Premises.

 

3.         City Council authorize the City Solicitor to attend all proceedings before the Alcohol and Gaming Commission of Ontario in this matter and direct the City Solicitor to take all necessary actions to give effect to Council's decision, including adding conditions to any liquor licence issued for the Premises.

 

4.         In the event the Registrar of the Alcohol and Gaming Commission of Ontario does not provide the City with an opportunity to register conditions on this licence, City Council direct the City Manager to:

 

a.         write to the Premier and the Attorney General of Ontario to request regulatory changes that require the Alcohol and Gaming Commission of Ontario to notify the City of liquor licence applications upon receipt of the applications; and

 

b.         write to the Registrar of the Alcohol and Gaming Commission of Ontario requesting a change to the administrative practice to ease the process of granting the City standing at Liquor Licence Hearings.

 

5.         City Council direct the Executive Director, Municipal Licensing and Standards to take Council's decision into consideration and conduct a multi-stakeholder review of issues related to this liquor licence.

Speaker Nunziata advised Council that the provisions of Chapter 27, Council Procedures, require that Motion MM2.3 be referred to the Toronto and East York Community Council. A two-thirds vote of the Council Members present is required to waive referral.
