City Council Decision
City Council on June 7, 8 and 9, 2016, adopted the following:
1. City Council adopt the confidential recommendations contained in Confidential Attachment 1 to the report (May 31, 2016) from the City Solicitor and the Deputy City Manager and Chief Financial Officer.
2. City Council direct that the confidential recommendations contained in Confidential Attachment 1 to the report (May 31, 2016) from the City Solicitor and the Deputy City Manager and Chief Financial Officer, as well as Confidential Appendix A to Confidential Attachment 1 to the report (May 31, 2016) from the City Solicitor and the Deputy City Manager and Chief Financial Officer, be made public, and City Council direct that the balance of Confidential Attachment 1 to the report (May 31, 2016) from the City Solicitor and the Deputy City Manager and Chief Financial Officer remain confidential.
The following confidential recommendations contained in Confidential Attachment 1 to the report (May 31, 2016) from the City Solicitor and the Deputy City Manager and Chief Financial Officer were adopted by City Council and are now public:
1. City Council accept the Offer to Settle set out in Appendix A to Confidential Attachment 1 to the report (May 31, 2016) from the City Solicitor and the Deputy City Manager and Chief Financial Officer, and City Council authorize the City Solicitor to execute Minutes of Settlement as necessary to give effect to a settlement.
2. City Council authorize the City Solicitor and appropriate City Staff to attend at the Ontario Municipal Board hearing into this matter in support of the settlement set out in Part 1 above.
Confidential Appendix A to the report (May 31, 2016) from the City Solicitor is now public and can be accessed under Background Information (City Council).
The balance of Confidential Attachment 1 to the report (May 31, 2016) from the City Solicitor and the Deputy City Manager and Chief Financial Officer remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation that affects the City and it contains advice or communications that are subject to solicitor-client privilege.

City Council recessed its public session and met as Committee of the Whole in closed session on June 7, 2016, to consider confidential information on this Item as it contains advice or communications that are subject to solicitor-client privilege and it pertains to potential litigation.

June 7, 2016 at 6:50 p.m. - Speaker Nunziata advised that City Council had completed its closed session consideration of Item CC19.13 headed "Scarborough Subway Extension Development Charges By-law - a request for directions on an Ontario Municipal Board hearing. No motions were made during closed session. Council would now proceed to the public debate on the item.
