City Council on November 8 and 9, 2016, adopted the following:

1.  City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (November 1, 2016) from the City Solicitor.

2.  City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (November 1, 2016) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 and Confidential Attachments 2 and 3 to report (November 1, 2016) from the City Solicitor remain confidential at the discretion of the City Solicitor.

The following confidential instructions to staff in Confidential Attachment 1 to the report (November 1, 2016) from the City Solicitor were adopted by City Council and are now public:

1.  City Council not accept the without prejudice offer to settle contained in the letter dated September 15, 2016, as amended by email dated November 1, 2016 and City Council direct the City Solicitor to continue to oppose the appeals of Official Plan Amendment 231, Official Plan Amendment 271, Zoning By-law No. 1011-2014, and the site specific Official Plan Amendment and rezoning applications at the Ontario Municipal Board.

The balance of Confidential Attachment 1 and Confidential Attachments 2 and 3 to report (November 1, 2016) from the City Solicitor remain confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as they pertain to litigation that affect the City and they contain advice or communications that are subject to solicitor-client privilege. The balance of Confidential Attachment 1 and Confidential Attachments 2 and 3 to report (November 1, 2016) from the City Solicitor will be made public at the discretion of the City Solicitor.
