Item - 2017.CC24.5

City Council on January 31, 2017, adopted the following:

1.  City Council adopt the confidential recommendations contained in Confidential Attachment 1 to the report (January 30, 2017) from the City Solicitor.

2.  City Council authorize the public release of the confidential recommendations contained in Confidential Attachment 1 and Confidential Attachments 2A and 2B to the report (January 30, 2017) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 to the report (January 30, 2017) from the City Solicitor remain confidential at the discretion of the City Solicitor.

The confidential recommendations contained in Confidential Attachment 1 to the report (January 30, 2017) from the City Solicitor were adopted by City Council and are now public:

1.  City Council endorse the Settlement Offer in principle as described in Confidential Attachments 2A and 2B to the report (January 30, 2017) from the City Solicitor. 

2.  City Council authorize the City Solicitor and appropriate City staff to attend the Ontario Municipal Board  hearing scheduled to commence on March 13, 2017 and not oppose the approval of the Zoning By-law Amendment for the proposed development of the lands at 50 Humberwood Boulevard in accordance with the Settlement Offer, and the City Solicitor and the Chief Planner and Executive Director, City Planning be jointly authorized to support minor changes to the final built form of the development proposal.

3.  City Council direct the City Solicitor and appropriate City staff to work with the applicant to finalize the elements of the settlement, including the Zoning By-law Amendment, the Plan of Subdivision, Draft Plan Conditions and Notice of Approval Conditions, in advance of the scheduled Ontario Municipal Board hearing, to the satisfaction of the Chief Planner and Executive Director, City Planning, in accordance with the Settlement Offer.

Confidential Attachments 2A and 2B to the report (January 30, 2017) from the City Solicitor are now public and can be accessed under Background Information (City Council).

The balance of Confidential Attachment 1 to the report (January 30, 2017) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice or communications that are subject to solicitor-client privilege. The balance of Confidential Attachment 1 to the report (January 30, 2017) from the City Solicitor will be made public at the discretion of the City Solicitor.
