City Council Decision

City Council on May 24, 25 and 26, 2017, adopted the following:

 

1. City Council adopt the confidential recommendations in Confidential Attachment 1 to the report (May 17, 2017) from the City Solicitor.

 

2. City Council authorize the public release of the confidential recommendations in Confidential Attachment 1 and Confidential Attachment 2 to the report (May 17, 2017) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 to the report (May 17, 2017) from the City Solicitor remain confidential at the discretion of the City Solicitor.

 

3.  City Council request the Chief Planner and Executive Director, City Planning to work with local Resident Associations, the local councillor and the applicant to optimize the built form, where reasonable, and find further efficiencies that could include reductions to height and impacts on the neighbourhood and the Yonge-St. Clair Secondary Plan.

 

The following confidential recommendations contained in Confidential Attachment 1 to the report (May 17, 2017) from the City Solicitor were adopted by City Council and are now public:

 

1. City Council endorse the Settlement Offer in principle as described in Confidential Attachment 2 to the report (May 17, 2017) from the City Solicitor.

 

2. City Council authorize the City Solicitor and appropriate City staff to attend the Ontario Municipal Board hearing scheduled to commence on June 12, 2017 and support the Settlement Offer and modified building proposal, and ask the Ontario Municipal Board to withhold its order approving the final Official Plan Amendment and Zoning By-law Amendment for the lands at 1417, 1421-1425, 1427, 1429 and 1431 Yonge Street subject to negotiating appropriate tenant relocation packages to be secured through a Section 37 Agreement with the City, and City Council jointly authorize the City Solicitor and the Chief Planner and Executive Director, City Planning to support minor changes to the final built form of the development proposal.

 

3. City Council direct the City Solicitor and appropriate City staff to work with the applicant to finalize the elements of the settlement, including the Official Plan Amendment and Zoning By-law Amendment, in advance of the scheduled Ontario Municipal Board hearing, to the satisfaction of the Chief Planner and Executive Director, City Planning in accordance with the Settlement Offer.

 

Confidential Attachment 2 to the report (May 17, 2017) from the City Solicitor is now public and can be accessed under Background Information (City Council).

 

The balance of Confidential Attachment 1 to the report (May 17, 2017) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006 as it contains advice that is subject to solicitor-client privilege.  The balance of Confidential Attachment 1 to the report (May 17, 2017) from the City Solicitor will be made public at the discretion of the City Solicitor.
