City Council Decision

City Council on July 4, 5, 6  and 7, 2017, adopted the following:

 

1.  City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (June 27, 2017) from the City Solicitor.

 

2.  City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (June 27, 2017) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 to the report (June 27, 2017) from the City Solicitor remain confidential as it contains advice which is subject to solicitor-client privilege.

 

The following confidential instructions to staff in Confidential Attachment 1 to the report (June 27, 2017) from the City Solicitor were adopted by City Council and are now public:

  

1.  City Council direct the City Solicitor, together with City Planning staff and other appropriate staff, to attend the Ontario Municipal Board hearing on August 30 to September 1, 2017 to support the Zoning By-law Amendment and Site Plan applications for 57, 59, 61 and 63 Finch Avenue West in their revised form.

 

2.  City Council instruct the City Solicitor to request the Ontario Municipal Board to withhold its Order on the Zoning By-law amendments until such time that:

 

a.  the Ontario Municipal Board has been advised by the City Solicitor that the proposed zoning by-law amendments are in a form satisfactory to the City;

 

b.  the Hydrogeological Assessment and Geotechnical Investigation and revised Functional Servicing Report have been submitted to the City to the satisfaction of the Executive Director, Engineering and Construction Services;

 

c.  the owner has completed, or the owner has provided satisfactory financial security for, any improvements to services that are identified as necessary in the revised Hydrogeological Assessment and Geotechnical Investigation and revised Functional Servicing Report, to the satisfaction of the Executive Director, Engineering and Construction Services, at no cost to the City; and

 

d.  the City Solicitor has forwarded to the Ontario Municipal Board conditions of site plan approval, satisfactory to the Director, Community Planning, North York District.

 

3.  City Council instruct the City Solicitor to request the Ontario Municipal Board to withhold its Order on the Site Plan application until such time as the Ontario Municipal Board has been advised by the City Solicitor that all pre-approval conditions have been satisfied.

 

The balance of Confidential Attachment 1 to the report (June 27, 2017) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice which is subject to solicitor-client privilege.
