Item - 2017.CC35.5

City Council on December 5, 6, 7 and 8, 2017, adopted the following:

1.  City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (November 15, 2017) from the City Solicitor.

2.  City Council authorize the public release of:

a.  the confidential instructions to staff in Confidential Attachment 1 to the report (November 15, 2017) from the City Solicitor and City Council direct that the balance of Confidential Attachment 1 to the report (November 15, 2017) from the City Solicitor remain confidential as it pertains to litigation or potential litigation that affects the City or one of its agencies or corporations and it contains advice that is subject to solicitor-client privilege; and

b.  Confidential Attachment 2 to the report (November 15, 2017) from the City Solicitor.

The confidential instructions to staff in Confidential Attachment 1 to the report (November 15, 2017) from the City Solicitor were adopted by City Council and are now public, as follows:

1.  City Council agree to support the without prejudice and confidential request to modify Official Plan Amendment 231 and Site and Area Specific Policy 511 respecting Appeal 10 to Official Plan Amendment 231, dated September 20, 2017, as set out in Attachment 2 to the report (November 15, 2017) from the City Solicitor and direct the City Solicitor and other staff to attend at the Ontario Municipal Board in support of the request to modify Official Plan Amendment 231 and Site and Area Specific Policy 511.

The balance of Confidential Attachment 1 to the report (November 15, 2017) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation that affects the City or one of its agencies or corporations and it contains advice that is subject to solicitor-client privilege.

Confidential Attachment 2 to the report (November 15, 2017) from the City Solicitor is now public and can be accessed under Background Information (City Council).
