City Council Decision
City Council on June 26, 27, 28 and 29, 2018, adopted the following:
1. City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (June 19, 2018) from the Interim City Manager and the City Solicitor, as amended by the confidential instructions to staff attached to motion 1 by Councillor Matlow, as amended in the closed session.
2. City Council direct that the confidential instructions to staff in Confidential Attachment 1 to the report (June 19, 2018) from the Interim City Manager and the City Solicitor, as amended, remain confidential at the discretion of the City Solicitor and City Council direct that the balance of Confidential Attachment 1 to the report (June 19, 2018) from the Interim City Manager and the City Solicitor remain confidential as it relates to potential litigation against the City and it contains advice that is subject to solicitor-client privilege.
Confidential Attachment 1 to the report (June 19, 2018) from the Interim City Manager and the City Solicitor remains confidential in its entirety at this time in accordance with the provisions of the City of Toronto Act, 2006 as it contains information about the proposed terms of a commercial transaction and it contains advice that is subject to solicitor-client privilege relating to the proposed transaction and potential litigation. The confidential instructions to staff in Confidential Attachment 1 to the report (June 19, 2018) from the Interim City Manager and the City Solicitor, as amended, will be made public at the discretion of the City Solicitor.

The following portions of the confidential instruction to staff in Confidential Attachment 1 to the report (June 19, 2018) from the Interim City Manager and the City Solicitor, as amended, are now public on the advice of the City Solicitor:
City Council direct that notice be given to 2500 Yonge Street Limited (the "Purchaser") that the City does not approve the Agreement of Purchase and Sale between Toronto Parking Authority ("TPA") and 2500 Yonge Street Limited dated December 22, 2016 (the "Agreement").
City Council direct that City staff take all appropriate steps to remove the "City-Owned Opportunity Site" label from the City Lands as now shown in the Midtown in Focus: Final Report and proposed Official Plan Amendment 405.
City Council Decision Advice and Other Information
City Council recessed its public session and met as Committee of the Whole in closed session on June 28 and 29, 2018, to consider confidential information on this Item as it contains information about the proposed terms of a commercial transaction and advice that is subject to solicitor-client privilege relating to the proposed transaction and potential litigation.
City Council issued confidential instructions to staff during closed session as permitted by Section 190(6)(b) of the City of Toronto Act.

City Council issued confidential instructions to staff in the closed session. City Council would now proceed with the public debate on the item.
That City Council amend the confidential instructions to staff in Confidential Attachment 1 to the report (June 19, 2018) from the Interim City Manager and the City Solicitor in accordance with the confidential instructions to staff attached to this motion.
