TE31.16 - 794 Gerrard Street East - Zoning Amendment - Request for Direction Report

City Council Decision
City Council on April 24, 25, 26 and 27, 2018, adopted the following:
1. City Council direct the City Solicitor and other appropriate staff to attend the Local Planning Appeal Tribunal in support of the revised application by the applicant for 794 Gerrard Street East described in the report (April 23, 2018) from the Chief Planner and Executive Director, City Planning.
2. In the event that the Local Planning Appeal Tribunal allows the appeal in whole or in part, City Council direct the City Solicitor to request the Local Planning Appeal Tribunal to withhold the issuance of its final Order until:
a. the Zoning By-Law Amendment is prepared to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning;
b. submission and acceptance of a revised Site Servicing and Stormwater Report to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services;
c. the applicant pays for and constructs, or enters into a financially secured agreement to secure, any necessary improvements to the municipal infrastructure in connection with the Functional Plan, and Site Servicing and Stormwater Report, to be submitted for review and acceptance by the Chief Engineer and Executive Director, Engineering and Construction Services; and
d. the applicant installs a minimum of one electric car charging station in the development's visitor parking; the Chief Planner and Executive Director, City Planning to secure further charge stations for resident parking through site plan approval as appropriate.
3. City Council direct the Chief Planner and Executive Director, City Planning to report to the Toronto and East York Community Council on the installation of two dedicated car share service locations and two electric vehicle plug in stations as well as any opportunities for Green P parking on Logan Avenue between Gerrard Street East and Dundas Street East.

Motions (City Council)
That:
1. City Council adopt the following recommendations contained in the supplementary report (April 23, 2018) from the Chief Planner and Executive Director, City Planning, as amended by adding a new Part 2.d. as follows [TE31.16a]:
1. City Council direct the City Solicitor and other appropriate staff to attend the (Local Planning Appeal Tribunal) LPAT in support of the revised application by the applicant for 794 Gerrard Street East described in the report from the Chief Planner & Executive Director, City Planning Division (April 23, 2018).
2. In the event that the LPAT allows the appeal in whole or in part, City Council direct the City Solicitor to request the LPAT to withhold the issuance of its final Order until:
a. the Zoning By-Law Amendment is prepared to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning;
b. submission and acceptance of a revised Site Servicing and Stormwater Report to the satisfaction of the Chief Engineer and Executive Director, Engineering and Construction Services;

The Toronto and East York Community Council requested the Chief Planner and Executive Director, City Planning to report directly to City Council regarding any further resolution of the issues identified in the report (March 29, 2018) from the Acting Director, City Planning, Toronto and East York District on the following matters:
a. the incorporation of car-share spaces in the development at 794 Gerard Street East; and
b. the provision of plug-ins for electric vehicles.
Origin
Summary
This application proposes the construction of a 6-storey mixed-use building containing 58 residential units and 650 square metres of retail at grade. The application includes 38 parking spaces in a parking stacker and 62 bicycle parking spaces accessed via Logan Avenue. The proposed density is 3.58 times the lot area.
The applicant has appealed the application to the Ontario Municipal Board (OMB) due to Council's failure to make a decision within the time prescribed by the Planning Act. The hearing is scheduled to commence May 29, 2018.
The purpose of this report is to recommend directions to City Council's with respect to its position at the upcoming Ontario Municipal Board hearing.
City staff continue to work with the applicant in regards to a number of unresolved technical issues. Staff are requesting City Council direction to continue these discussions and if unresolved, to attend the Ontario Municipal Board to oppose this development.
