City Council Decision

City Council on July 23, 24, 25, 26, 27 and 30, 2018, adopted the following:

 

1. City Council include the properties at 37, 39, 41 and 43 Mutual Street on the City of Toronto's Heritage Register, in accordance with the Statement of Significance (Reasons for Inclusion): 37, 39, 41 and 43 Mutual Street in Attachment 3 to the supplementary report (July 13, 2018) from the Chief Planner and Executive Director, City Planning.

 

2. City Council state its intention to designate the property at 37 Mutual Street under Part IV, Section 29 of the Ontario Heritage Act in accordance with the Statement of Significance (Reasons for Designation): 37, 39, 41 and 43 Mutual Street in Attachment 4 to the supplementary report (July 13, 2018) from the Chief Planner and Executive Director, City Planning.

 

3. If there are no objections to the designations in accordance with Section 29(6) of the Ontario Heritage Act, City Council authorize the City Solicitor to introduce the bill in Council designating the property at 37 Mutual Street under Part IV, Section 29 of the Ontario Heritage Act.

 

4. If there are objections in accordance with Section 29(7) of the Ontario Heritage Act, City Council direct the City Clerk to refer the designation to the Conservation Review Board.

 

5. If the designation is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend any hearing held by the Conservation Review Board in support of Council's decision on the designation of the property.

That City Council adopt the recommendations contained in the supplementary report (July 13, 2018) from the Chief Planner and Executive Director, City Planning [TE34.187b], as follows:

 

1. City Council include the properties at 37, 39, 41 and 43 Mutual Street on the City of Toronto's Heritage Register, in accordance with the Statement of Significance (Reasons for Inclusion): 37, 39, 41 and 43 Mutual Street in Attachment 3 to the report (July 13, 2018) from the Chief Planner and Executive Director, City Planning.

 

2. The Toronto and East York Community Council requested the Director, Urban Design, to report directly to City Council at its meeting of July 23, 24, and 25, 2018 on the inclusion of 37, 39, 41 and 43 Mutual Street on the City's Heritage Register and intention to designate 37 Mutual Street under Part IV, Section 29 of the Ontario Heritage Act.

Summary

The Toronto Preservation Board is scheduled to consider a report from the Director, Urban Design, Item PB36.2, at its meeting of July 12, 2018.  The McBurney & Saunders Row Houses (1889-1890) comprise a group of four attached properties, completed together in 1890, and containing two-and-a-half-storey brick row houses designed in the Second Empire style by Jackson A. McBurney and Joseph Saunders, two speculative builders who developed several groups of row houses in the immediate vicinity. These rare and well-preserved remnants of their type, built in the late-19th century for the city's new middle class, support and maintain the continuity of the historic character of this section of the Garden District, west of Jarvis Street.   

 

This report recommends that City Council include the properties at 37, 39, 41 and 43 Mutual Street on the City of Toronto Heritage Register and state its intention to designate the property at 37 Mutual Street under Part IV, Section 29 of the Ontario Heritage Act for its cultural heritage value. This staff report is scheduled to be considered by the Toronto and East York Community Council in the next term of Council.

 

The intent of this motion is to direct staff to report directly to the July 2018 City Council meeting so that the designation will not be delayed by the upcoming Council break.
