EX12.3 - Toronto-Ontario Transit Partnership - Status Update

City Council Decision
City Council on January 29, 2020, adopted the following:
1. City Council advise the Province of Ontario of its expectation that inclusionary zoning be applied in Major Transit Station Areas, as articulated in Bill 108, and is prioritized in the review of Transit Oriented Development proposals in order to ensure that we are building as many permanently and deeply affordable housing units along major transit lines as possible in Toronto.
2. City Council request the Province of Ontario to require a full, formal Transit Project Assessment Process, as detailed in the current Ontario Regulation 231/08, Transit Projects and Metrolinx Undertakings (Transit Projects Regulation) and the Environmental Assessment Act, for the Ontario Line.
3. City Council request the Province of Ontario, if it makes changes to environmental assessment legislation for the delivery of transit projects, to retain the best practices and community consultation principles that are foundational to the Transit Project Assessment Process.
4. City Council request Metrolinx, in the environmental assessment process for the Ontario Line, to consider alternatives for the technology, station locations and alignment, including putting underground those sections proposed to be above ground in the Ontario Line Initial Business Case.
5. City Council direct the City Manager to include in the negotiation of Toronto-Ontario Transit Partnership agreements with the Province, a provision for Provincial funding and/or programs to mitigate the impacts of construction on small and medium-sized enterprises, including options for compensation for lost business.
6. City Council request the City Manager to negotiate with the Province of Ontario to accelerate the three-stop Scarborough Subway.
7. City Council direct the Deputy City Manager, Infrastructure and Development Services, in the formulation of any agreements between the City and the Province related to the approval process for Transit Oriented Development, to ensure that the following principles are included:
a. the City's land use authority and responsibility for planning approvals are respected;
b. Transit Oriented Development project sites are appropriately scoped as properties above or in close proximity to transit stations with development directly related to the transit stations; and
c. Transit Oriented Development proposals take into account potential adverse precedents and implications for other development sites.
8. City Council request the City Manager to write to Infrastructure Ontario and Metrolinx requesting them to make public all of the preliminary reports, studies and all related information used in the development of the Ontario Line Initial Business Case, and if any of these documents in whole or in part are deemed confidential and cannot be made public, that they be released to the City Manager.
9. City Council request the City Manager to report to City Council on each of the "four provincial priority projects" when sufficient information is made available by the Province of Ontario.

Councillor Bailao, rising on a Point or Order, stated that she had asked for the Item to be timed for tomorrow after Members' Motions, but that Council could deal with it now, if Council so wishes.
Councillor Perks, rising on a Point of Privilege, stated that he was sure it wasn't Mayor Tory's intention, but Mayor Tory had said that Councillor Perks' remarks were misleading to the public, and Councillor Perks asked that Mayor Tory withdraw those remarks.
Mayor Tory, rising on a Point of Privilege, stated that he was kidding but that he would withdraw his remarks and further stated that the public will have been left with the wrong impression by some of the remarks made in the Chamber.

Committee Recommendations
The Executive Committee recommends that:
1. City Council advise the Province of Ontario of its expectation that consideration of inclusionary zoning in Major Transit Station Area's as articulated in Bill 108, is included in the review of Transit Oriented Development proposals.
Origin
Summary
The purpose of this report is to provide an update to Council on the status of discussions with the Province through the ‘Ontario-Toronto Executive Steering Committee’. The report includes an update on agreements, including the Memorandum of Understanding for Transit Oriented Development, and information related to measures and enabling authorities the Province plans to introduce in order to provide itself with an enhanced ability to accelerate transit delivery.
With respect to agreements, recent discussions with the Province have resulted in:
- the completion of a ‘Memorandum of Understanding on Transit Oriented Development’ which establishes a series of shared objectives for Transit Oriented Development and identifies the roles and responsibilities of the City and Province for Transit Oriented Development specific to the four provincial priority projects (Ontario Line, Line 2 East Extension, Yonge North Subway Extension, and Eglinton Crosstown West Extension); and
- the upcoming finalization of the Preliminary Agreement, which will reflect and formalize the terms of the agreement approved by Council (EX9.1). This agreement is expected to be completed by the end of the first quarter of 2020.
In parallel to the development of these agreements, City staff have also continued to work with the Province to identify opportunities to accelerate the delivery of their transit expansion projects. In the course of these discussions, the Province has identified the intent to bring forward a series of measures that will enhance the Province’s ability to meet committed timelines. City staff understand these measures may require a combination of legislative changes, enabling authorities, and enforcement mechanisms.
To this end, the Province has provided to the City a ‘Statement of Intent’, which provides a high-level overview of provincial objectives and goals, as well as a formal commitment to consultation and engagement with the City prior to and following the introduction of legislation in the first quarter of 2020.
