EX23.3 - Provincial Transit-Oriented Communities Program

City Council Decision

City Council on May 5 and 6, 2021, adopted the following:

 

1.  City Council communicate to the Province of Ontario that the City's support for any Minister's Zoning Order or City-initiated planning approval regarding the development of Transit Oriented Communities proposals will be premised on:

 

a. robust and timely consultations with the local community and Councillor;

 

b. provision of the maximum possible number, affordability and tenure of affordable units on each development;

 

c. partnership with the City, to determine an approach to the Transit-Oriented Communities Program development that is consistent with the City's planning framework and policy intent for each site and, where consensus is not reached with the City, provides a rationale for the Province's actions;

 

d. high quality design standards for buildings and streetscapes, and appropriate consideration for heritage, consistent with the City's urban design guidance and respecting the existing and planned context; and

 

e. provision of a complete core submission package for each site early enough to allow City staff, communities and Councillors to consider and provide comment.

 

2.  City Council request the Province of Ontario to commit to an early discussion with the City of Toronto about potential transit-oriented community developments in order to shape commercial arrangements in ways that support the City's planning vision for the area and that City staff keep local Councillors informed about such discussions.

 

3.  City Council confirm its position on the south-of-Eastern-Avenue land-use designation as an employment area in the Official Plan and City Council confirm its support for the Province of Ontario's designation of the south-of-Eastern-Avenue as a PZ Provincially Significant Employment Zone.

 

4.  City Council request the Chief Planner and Executive Director, City Planning to report to the June 28, 2021 meeting of the Planning and Housing Committee on any proposed changes to the status of the land-use designation by the landowner and the Province of Ontario.

 

5.  City Council strongly express to the Province of Ontario that, as part of any transfer of City-owned land related to the First Parliament Site, the following three principles are maintained:

 

a. continued public ownership and public control of the First Parliament site;

 

b. in-situ protection for archaeological resources found at the First Parliament Site; and

 

c. long-term development of the First Parliament Site will reflect the key principles and design elements developed through the Master Planning Process of the First Parliament Project.


6.  City Council strongly express to the Province of Ontario that, in the event that the Province gains control of the City-owned properties at the First Parliament Site, and should the Ontario Line not be built, that ownership of the properties be returned to the City of Toronto at no additional costs.

 

7.  City Council direct the Chief Executive Officer, CreateTO, the Chief Planner and Executive Director, City Planning and the Executive Director, Transit Expansion Office to create a stakeholder process and working group with Infrastructure Ontario, Metrolinx and community organizations, including the St. Lawrence Neighbourhood Association, the Gooderham and Worts Neighbourhood Association, the Corktown Residents and Business Association, the West Don Lands Committee, the St. Lawrence Market Neighbourhood Business Improvement Area and other stakeholders that may be identified, to immediately begin consultation on current and future considerations for the redevelopment of the First Parliament Site on the proposal submitted by the Government of Ontario.

 

8.  City Council direct the City Manager to work with Infrastructure Ontario to secure a commitment that the development of the First Parliament site will include a Toronto Public Library regional library branch and any new residential component must include, in consultation with the Executive Director, Housing Secretariat, to secure as much affordable housing as possible, in addition to other significant community assets, as determined in the Master Plan.

 

9.  City Council request the Chief Executive Officer, CreateTO to complete the Master Planning Process on the First Parliament Project as quickly as possible.

 

10.  City Council direct the Executive Director, Corporate Real Estate Management and the Executive Director, Transit Expansion Office, in consultation with the Chief Executive Officer, CreateTO, to use the emerging and final recommendations of the Master Plan in ongoing negotiations with Metrolinx and Infrastructure Ontario and to report back on the outcomes of the negotiations and the final Master Plan to the July 6, 2021 meeting of the Executive Committee.


11.  City Council direct the Chief Executive Officer, CreateTO and the Chief Planner and Executive Director, City Planning to consult with the Federal Minister of the Environment and Historic Sites and Monuments Board of Canada on the inclusion of the First Parliament Site on the National Historic Sites of Canada due to its historical civic importance and to report back to the June 8 and 9, 2021 meeting of City Council on the potential nomination of the First Parliament Site through the Historic Sites and Monuments Board of Canada as a National Program of Historical Commemoration.

 

12.  City Council direct the Chief Executive Officer, CreateTO and the Chief Planner and Executive Director, City Planning to consult with the Federal Minister of the Environment on the potential physical and cultural heritage impacts to the First Parliament Site as well as its historical and archaeological significance under the Federal Impact Assessment Act and to report back to the June 8 and 9, 2021 meeting of City Council on the potential for a review of the First Parliament Site under the Impact Assessment Act.

That:

 

1. City Council direct the Chief Executive Officer, CreateTO, Chief Planner and Executive Director, City Planning and Executive Director Transit Expansion Office to create a stakeholder process and working group with Infrastructure Ontario, Metrolinx and community organizations including the St. Lawrence Neighbourhood Association, the Gooderham and Worts Neighbourhood Association, the Corktown Residents and Business Association, the West Don Lands Committee, the St. Lawrence Market Neighbourhood Business Improvement Area and other stakeholders that may be identified to immediately begin consultation on current and future considerations for the redevelopment of the First Parliament Site on the proposal submitted by the Government of Ontario.

Summary

All orders of government are currently making substantial investments in transit expansion in Toronto. Through their transit-oriented communities ("TOC") program, the Province is creating the opportunity for third-parties to also make investments in transit infrastructure, thereby offsetting capital costs. The TOC program applies to all transit expansion programs, including the Subway Program (i.e., Ontario Line, Scarborough Subway Extension, Eglinton Crosstown West Extension and Yonge North Subway Extension), the SmartTrack Stations Program, GO Expansion and the LRT Program. Through their agencies Infrastructure Ontario ("IO") and Metrolinx, the Province is pursuing agreements with third-party partners to integrate transit infrastructure with new development in various locations, thereby bringing more housing and jobs closer to transit.

 

The City and the Province share objectives related to TOC, as described in the Memorandum of Understanding on the TOC program (the "MOU on TOC") entered into by the two parties, effective February 14, 2020. The purpose of this report is to provide Council with an overview of work currently underway to operationalize the terms of the MOU on TOC, including the TOC review process being jointly developed by the City and the Province to address TOC proposals. The report also contains information known to-date on TOC proposals at the 271 Front Street East, 25 Berkeley Street and 44 Parliament Street (the "First Parliament Properties") and the East Harbour site.

 

In order to build on the progress the City and the Province have made related to operationalizing the TOC program, the City will continue discussions with Metrolinx and IO on the First Parliament Properties while ensuring that any agreement reflects strategic city-building priorities and the key principles and design elements set out in the Master Planning work completed to-date. Staff will report back to Executive Committee on the status of the TOC program by the fourth quarter of 2021, including recommendations for any authorities needed related to the program.
