City Council Decision

City Council on March 9, 2022, adopted the following:

 

1. City Council adopt the confidential instructions to staff attached to motion 1 by Councillor Mark Grimes.

 

2. City Council direct that the confidential instructions to staff adopted by City Council remain confidential at the discretion of the City Solicitor.

 

3. City Council direct that Confidential Attachment 1 to the report (March 2, 2022) from the City Solicitor remain confidential.

 

The Confidential Instructions to staff attached to motion 1 by Councillor Mark Grimes were adopted by City Council and remain confidential at this time in accordance with the provisions of the City of Toronto Act, 2006. The Confidential Instructions to staff attached to motion 1 by Councillor Mark Grimes will be made public at the discretion of the City Solicitor. 

 

Confidential Attachment 1 to the report (March 2, 2022) from the City Solicitor remains confidential in its entirty in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.

March 9, 2022 at 5:29 p.m. - Speaker Nunziata advised that City Council had completed its closed session consideration of Item CC41.16 headed "80 Thirtieth Street - Zoning Amendment Application - Request for Direction". No motions were placed in the closed session. City Council will now proceed with the public debate on the Item.


1 - Motion to Adopt Item as Amended moved by Councillor Mark Grimes (Carried)

That:

 

1. City Council delete the recommendations in the Item and adopt instead the confidential instructions to staff attached to this motion.

 

2. City direct that the confidential instructions to staff remain confidential at the discretion of the City Solicitor.

 

3. City Council direct that Confidential Attachment 1 to the report (March 2, 2022) from the City Solicitor remain confidential.

Point of Privilege by Councillor Gord Perks

Councillor Perks, on a Point of Privilege, stated that when confidential instructions on an item are circulated in the Clerk's Meeting Portal during the meeting, Members are not automatically notified by the system and therefore would not know to review an item that has been added in this way.

Ruling by Councillor Frances Nunziata
Speaker Nunziata accepted the Point of Privilege and requested the City Clerk to respond. John D. Elvidge, City Clerk, advised City Council that staff will review the issue and develop a new process to notify Members.
