1.  Refuse to grant the application for an exemption permit, by the property owner of 64‑70 Raleigh Avenue, for a proposed fence that fails to comply with the provisions of Toronto Municipal Code, Chapter 447, Fences.

 

OR

 

2.  Grant the application for a fence exemption permit, thereby allowing the fence to be constructed as proposed.  Direct and require that the installation be maintained in good repair without alteration.  Direct and require that at such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, or its successor by-law.

The purpose of this report is to advise Council concerning an application by the property owner of 64-70 Raleigh Avenue for a site-specific Fence Exemption, pursuant to Section 447-5.C of Toronto Municipal Code, Chapter 447- Fences.  The property owner is seeking Council's permission to install a fence which does not comply with maximum fence height restrictions and is topped with barbed wire contrary to Section 447-2 of the by-law.

Recommendations

The General Manager of Parks, Forestry and Recreation recommends that:

 

1.   City Council deny the request for a permit to remove one (1) privately-owned tree located at 51 Silversted Drive.

Summary

This report recommends that City Council deny the application for a permit to remove one (1) privately-owned tree located at 51 Silversted Drive. The application indicates that the reason for removal is to address concerns that the tree may fail and damage a buried gas line. The owner has also raised concerns that tree's roots are damaging a neighbour's driveway.

 
The subject tree is a Colorado blue spruce (Picea pungens var. glauca), measuring 37 cm in diameter.  Urban Forestry does not support the removal of this tree as it is healthy, maintainable and growing in an appropriate location.

2.  City Council authorize the Legal Services Division to release the portion of the performance guarantee held with respect to this Plan of Subdivision.

 

3.  City Council direct that an assumption By-law be prepared to assume the public highway and municipal services within the Subdivision at Midland Avenue and St. Clair Avenue East.

 

4.  City Council authorize and direct the City Solicitor to register the assumption By-law in the Land Registry Office at the expense of the Owner.

2.   Prohibit standing from 2:00 a.m. to 6:00 a.m., from December 1 of one year to April 15 of the next following year, inclusive, on the south side of Kawneer Terrace, from Great West Drive to Zezel Way.

This report recommends the adoption of a by-law to prohibit standing on both sides of Kawneer Terrace, De Jong Street, and Zezel Way during the winter periods from December 1 to April 15.  One side of these streets will have no standing throughout the day, while the other will have no standing from 2:00 a.m. to 6:00 a.m. daily, in order to provide a nightly time window for snow clearing operations, and a snow storage area on one side of these streets.  The other side of the streets will have the default 3-hour parking rules in effect to provide short-term parking for this community from 6:00 a.m. to 2:00 a.m. daily.  There is currently unposted 3‑hour parking along these streets that causes operational issues during the winter due to the narrow pavement widths and sidewalks on both sides of these streets situated immediately adjacent to the roadway.

Financial Impact

The cost of installing the No Standing signs is approximately $5,000.  These funds are available in the Transportation Services 2015 Operating Budget, within cost centre TP0397.  However, the cost of clearing snow after snow events from the No Standing zones where parking will still be allowed from 6:00 a.m. to 2:00 a.m. is expected to cost approximately $9,500 per snow event.

1.   Not approve the installation of an All-Way Stop Control at the intersection of Dorcot Avenue and Munson Crescent.

Summary

This staff report is about a matter for which the Community Council has delegated authority from City Council to make a final decision.

 

This report responds to a request from Councillor Michael Thompson to review the feasibility of installing an all-way stop control at the Dorcot Avenue/Munson Crescent intersection.  Currently, this location is controlled by a southbound compulsory stop control where Munson Crescent meets Dorcot Avenue; there is also a school crossing located on the east side of this intersection.  Based on an assessment of the pedestrian and traffic volumes and conditions at this intersection, it has been determined that the technical warrants for the installation of an all-way stop control are not met.  This is consistent with the results of two similar studies previously undertaken of this intersection.  Therefore, this report recommends that all-way stop control not be installed at this intersection.

Financial Impact

There would be no financial impact associated with the staff recommendations.  However, should an all-way stop control be approved, the financial cost of installing the additional signage and associated pavement markings would be approximately $750.00.

This report recommends that the existing No Parking, 7:00 a.m. to 6:00 p.m., Monday to Friday zone on both sides of Brian Avenue from Pharmacy Avenue to Gooderham Drive be replaced with the proposed No Stopping, 7:00 a.m. to 6:00 p.m. Monday to Friday zone.  This report is in response to a request from Councillor Michael Thompson to review these parking regulations.  Staff have confirmed the need for these proposed changes to the regulations in this area in order to maintain safe and efficient two-way traffic and adequate sight lines, while facilitating roadway maintenance.

Financial Impact

The financial cost of installing these stopping regulation signs is approximately $1,500.00.  The funding for the signs has been requested in the Transportation Services Division's 2016 Operating Budget, within Cost Centre TP0397.

1.   Not prohibit northbound and southbound U-Turns on Silver Springs Boulevard, from Dancy Avenue to Rakewood Crescent (south intersection).

This staff report is about a matter for which the Community Council has delegated authority from City Council to make a final decision.

 

This report responds to a request from Councillor Jim Karygiannis to review the need and feasibility of installing U-Turn prohibitions on Silver Springs Boulevard from Dancy Avenue to Rakewood Crescent (south intersection) in the vicinity of the Silver Springs Public School.  Based on staff observations and an assessment of the traffic conditions and movements in this area, it has been determined that U-turns at this location are not frequent or problematic.  Furthermore, the U-turns provide safe and convenient access and egress to/from an existing layby on the west side of Silver Springs Boulevard.  As a result, a U-Turn prohibition is not justified nor recommended and other traffic management strategies can be explored with staff of Silver Springs Public School to address traffic and parking concerns in this area.

Financial Impact

There would be no financial impact associated with this report.  However, if U-Turn Prohibitions are approved, the financial cost of installing the appropriate signs would be approximately $1,500.00. The funding for such regulatory traffic signage has been requested in the Transportation Services 2016 Operating Budget, within Cost Centre TP0397.

1.   Approve the installation of traffic control signals at Milliken Boulevard approximately 320 metres south of Passmore Avenue.

This staff report is about a matter that the Community Council has delegated authority from City Council to make a final decision.

 

This report recommends the installation of pedestrian traffic control signals on Milliken Boulevard approximately 320 metres south of Passmore Avenue.  The need for these traffic control signals has been identified in a Traffic Impact Study submitted by the place of worship located at 3223 Kennedy Road, whose property is being bisected by the Milliken Boulevard extension from McNicoll Avenue to Passmore Avenue.  The signals will be located where the main pedestrian walkway from the place of worship property crosses the road extension to connect with its 420-space parking lot to the east.

Financial Impact

The cost of installation of these traffic controls signals is approximately $120,000. These funds have been requested in the Transportation Services 2016 capital budget.

This report recommends the adoption of a by-law to prohibit parking on both sides of the streets in the Silver Springs Boulevard Area during the winter periods from December 1 to April 15.  Both sides of these streets will have no parking from 2:00 a.m. to 6:00 a.m. daily, in order to provide the opportunity to conduct efficient snow clearing operations overnight.  This is a pilot study to determine the operational impacts of such an approach prior to any larger deployment of such a strategy.

Financial Impact

The cost of installing the parking prohibition signs is approximately $10,000.  These funds have been requested in the Transportation Services 2016 Operating Budget, within cost centre TP0397.

Transportation Services recommends that Scarborough Community Council:

 

1.  Not approve the installation of an all-way stop control at the intersection of Rouge River Drive and Savanna Drive.

It is recommended that an All-Way Stop Control not be installed on Rouge River Drive and Savanna Drive as existing conditions do not meet the required technical warrant for the installation of such a traffic control device in terms of traffic volumes or delays.  Currently, this location has a southbound stop sign on Savanna Drive at Rouge River Drive.

Financial Impact

There would be no financial impact associated with the staff recommendation regarding an unwarranted all-way stop control. However, should an all-way stop control be approved, then the financial cost of installing the two additional stop signs and associated pavement markings would be approximately $500.00.  The funds for such stop signs would be available in the recommended Transportation Services 2016 Operating Budget.

Summary

This application proposes to delete permissions for both heavy industrial uses and sensitive uses from the Zoning By-laws for the lands at 43 Upton Road. Submission of the subject application was one of the conditions of the negotiated settlement of the Ontario Municipal Board (OMB) appeals on the lands immediately south of the subject property known as 743 Warden Avenue.

 

The proposal complies with the Official Plan, conforms to the Growth Plan for the Greater Golden Horseshoe and is consistent with the Provincial Policy Statement.

1.  City Council amend the definition of "Excluded Area" as found in Subsection 925-1B in the City of Toronto Municipal Code Chapter 925, to insert a new subsection (g) in Subsection (2) to read:
