The garage restricts visibility of the pool from the rear door and rear window of the house and does not comply with Section 447-3. E (4) of the bylaw.

This report recommends that a No Parking zone be established on the south side of Fishleigh Drive at the access to a Toronto Water pumping station.  Staff have confirmed the need for these proposed changes to the regulations in this area to allow for safe and efficient access to the municipal facility.  Currently, this area has the unposted 3-hour parking regulation in effect, which often results in this access being impeded by parked vehicles.

Financial Impact

The financial cost of installing the subject recommended No Parking signage is approximately $500.00.  The funding for the signs has been requested in the Transportation Services 2016 interim Operating Budget, within Cost Centre TP0397.

This report recommends that the existing No Parking, 7:00 a.m. to 9:00 a.m., 4:00 p.m. to 6:00 p.m. Monday to Friday zone on the north side of McIntosh Street from Highview Avenue to Park Street be repealed and replaced with a default unposted 3-hour maximum parking zone.  Staff have confirmed that the proposed change to the regulation in this area is feasible because the TTC bus service on McIntosh Street, which necessitated the current parking restrictions, has been discontinued. Short term parking is feasible all day on the north side of this street and will not affect two-way traffic operations.

Financial Impact

The financial cost of removing the No Parking signs on the north side of McIntosh Street is approximately $1,000.00.  Funding for the sign removal has been requested in the Transportation Services 2016 interim Operating Budget, within Cost Centre TP0397.

This report recommends that a minor street stop sign be deployed at the intersection of Wynnview Court and Glen Everest Road, which is currently an uncontrolled three-way "T‑type" intersection, in order to clearly define the right-of-way and to regulate traffic flow.  The minor street stop will also require motorists to stop before the sidewalk to enhance pedestrian safety.

Financial Impact

1.   City Council not approve the installation of traffic control signals, a pedestrian crossover, or a pedestrian refuge island at the intersection of Birchmount Road and Beswick Park Court.

 

2.   City Council not approve the installation of traffic control signals, a pedestrian crossover, or a pedestrian refuge island on Birchmount Road at a point approximately 85 metres north of Beswick Park Court.

Summary

It is recommended that neither traffic control signals, a pedestrian crossover, nor a pedestrian refuge island be installed at this time on Birchmount Road in the vicinity of Beswick Park Court as the justifications/warrants are not met.  Currently, the area around this intersection is not controlled.

Financial Impact

There is no financial impact associated with this report.  However, should City Council approve Traffic Control Signals at either location, the cost would be approximately $150,000.  Should City Council approve a pedestrian crossover at either location, the cost would be approximately $100,000.  Should City Council approve a pedestrian refuge island at either location, the cost could be upward of $500,000 due to the necessary road widening required to accommodate such an island.  Funding for any of these possibilities has not been requested in the Transportation Services 2016 Capital Budget.

There would be no financial impact associated with the staff recommendation regarding the unwarranted pedestrian crossover.  However, should a pedestrian crossover be approved, then the financial cost of installing the pedestrian crossover, signs and associated pavement markings would be approximately $95,000.00.  The funding for such an unwarranted pedestrian crossover has not been requested in the 2016 Transportation Services Capital Budget.

Recommendations

The City Planning Division recommends that:

 

1. Staff be directed to schedule a community consultation meeting for the lands at 3201 to 3227 Eglinton Avenue East together with the Ward Councillor.

 

2. Notice for the community consultation meeting be given to landowners and residents within 120 metres of the site.

 

3. Notice for the public meeting under the Planning Act be given according to the regulations of the Planning Act.

Summary

This application proposes to place a Holding (H) provision on the existing zoning for portions of the property located at 3201 to 3227 Eglinton Avenue East in order to: ensure the sequential build-out of the lands, secure the orderly development of the site and provide further assurances that all City requirements will be satisfactorily addressed by the owner. Additional development and additional land uses are not being sought through the Zoning By-law Amendment application.

 

This report provides preliminary information on the above-noted application and seeks Community Council's directions on further processing the application and the related community consultation process.

 

The application should proceed through the planning review process including the scheduling of a community consultation meeting for the first quarter of 2016.  Provided all required information is submitted in a timely manner and all issues raised during the review process and consultation process have been satisfactorily resolved, a final report will be prepared and a public meeting is targeted for the fourth quarter of 2016.

3.  Notice for the public meeting under the Planning Act be given according to the regulations of the Planning Act.

Summary

This application proposes to amend the Zoning By-law to permit a wider range of commercial uses than are currently permitted under the by-law for the lands at 1100 Ellesmere Road, and to adjust development standards relating to landscaping and parking requirements.  Attachment 1:  Site Plan and Attachment 2: Elevations illustrate the proposed redevelopment of the property.

Recommendations

The City Planning Division recommends that:

 

1.   City Council amend Oakridge Community Zoning By-law No. 9812, as amended, for the lands at 35 and 45 Danforth Road substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 6 to report dated February 3, 2016 from the Acting Director, Community Planning, Scarborough District.

 

2.   City Council amend City of Toronto Zoning By-law 569-2013, as amended, for the lands at 35 and 45 Danforth Road substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 7 to report dated February 3, 2016 from the Acting Director, Community Planning, Scarborough District.

 

3.   City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required.

 

4.    Before introducing the necessary Bills to City Council for enactment, require the owner to revise and resubmit a Functional Servicing and Stormwater Management Report to the satisfaction of the Executive Director, Engineering and Construction Services.

Summary

This application proposes the development of 116, four-storey stacked townhouses configured in four buildings at 35 and 45 Danforth Road. Vehicular access would be provided from Danforth Road and a total of 140 parking spaces are proposed in an underground parking garage and at grade.

 

The proposal represents the redevelopment of a banquet hall site with residential infill.  The proposal is consistent with the 2014 Provincial Policy Statement and conforms to the Growth Plan and the policies of the City's Official Plan. This report reviews and recommends approval of the application to amend the Zoning By-law.

Scarborough Community Council recommends that:


1.  City Council authorize the City Solicitor and relevant staff to attend the Ontario Municipal Board (OMB) hearing in support of the Scarborough Committee of Adjustment's decision regarding the consent and minor variance application at 4 Lovering Road (File A324/15SC).

Summary

An application for consent and minor variance with respect to the property known as 4 Lovering Road (File A324/15SC) was heard by the Scarborough Committee of Adjustment on Thursday, January 21, 2016 for the permission to construct a new detached dwelling. On Thursday, January 21, 2016, the application was refused by the Committee of Adjustment on the following reasons:

 

-  The general intent and purpose of the Official Plan is not maintained.

-  The general intent and purpose of the Zoning By-law is not maintained.

-  The variances are not considered desirable for the appropriate development of the land.

-  In the opinion of the Committee, the variances are not minor.
