1.   Refuse to grant the application for an exemption permit, by the property owner of 34 Wooster Wood, for a proposed 3.25m high wood fence that fails to comply with the provisions of Toronto Municipal Code, Chapter 447, Fences.

The purpose of this report is to advise Council concerning an application by the property owner of 34 Wooster Wood for a site-specific Fence Exemption, pursuant to Section 447-2 of the Toronto Municipal Code, Chapter 447- Fences.  The property owner is seeking Council's permission for an exemption for a proposed wood fence which does not comply with maximum fence height restrictions contrary to Section 447-2 of the by-law.
         
The definition of a Fence: "A barrier, including one for noise attenuation, or any structure, that wholly or partially screens from view, encloses or divides a yard or other land, or marks or substantially marks the boundary between adjoining land, and includes any hedge or shrub that has the same effect."

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately‑owned tree located at 61 Fenwood Heights. The arborist report submitted with the application indicates the reasons for tree removal are its over-maturity, declining health, and dropping of branches and cones onto an existing house and deck.


The subject tree is a Norway spruce (Picea abies) measuring 52 cm in diameter. Urban Forestry does not support the removal of this tree as it is healthy and maintainable.

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately-owned tree located at 27 Tivoli Court. The application indicates the reasons for removal are the tree’s poor vigour, and excessive trunk secretions of sap which is dripping from the tree onto the house and driveway.

 

The subject tree is a Norway spruce (Picea abies) measuring 51 cm in diameter. Urban Forestry does not support the removal of this tree as it is healthy and maintainable.

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately-owned tree located at 45 Whiterock Drive. The application indicates the main reasons for requesting tree removal are due to concerns over the tree's proximity to the house and the concern that the tree may fail during a wind storm and fall towards the house. Falling needles and security due to the tree blocking the view of the house are additional concerns.


The subject tree is a Colorado spruce (Picea pungens) measuring 38 cm in diameter. Urban Forestry does not support the removal of this tree as it is healthy and maintainable.

Toronto Building recommends that the Scarborough Community Council give consideration to the demolition application for 6435 Kingston Road and decide to:

 

1. Refuse the application to demolish the single family dwelling because there is no permit to replace the building on the site; or

 

2. Approve the application to demolish the single family dwelling without condition; or

 

3. Approve the application to demolish the single family dwelling with the following conditions:

 

a. that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official;

 

b. that all debris and rubble be removed immediately after demolition;

 

c. that sod be laid on the site and be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5, and 629-10, paragraph B;

 

d. that any holes on the property be backfilled with clean fill;

 

e. that all privately and publicly owned trees, which are protected by the City of Toronto By-laws, be protected in accordance with the By-laws during the demolition process;

 

f. that the applicant for the demolition permit construct and substantially complete the new building to be erected on the site of the residential property where the house is to be demolished not later than two years from the day demolition of the existing building is commenced; and

 

g. that on failure to complete the new building within the time specified in (f) above, the City Clerk shall be entitled to enter on the collector’s roll, to be collected in like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit contained in the residential property in respect of which the demolition permit is issued and that such sum shall, until payment, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued.

Summary

1.   Designate an accessible parking space to operate at all times on the west side of Greyabbey Trail, between a point 65 metres north of Fintona Avenue (west intersection) and a point 6 metres further north.

This staff report is about a matter that Community Council has delegated authority from City Council to make a final decision.

 

This report recommends the adoption of a by-law to designate an accessible parking zone on the west side of Greyabbey Trail where there is currently unposted three-hour limit parking permitted.

Financial Impact

The financial cost of installing the accessible parking zone signs is approximately $500.00. Funding for the signs is available in the Transportation Services 2016 Operating Budget, within Cost Centre TP0397.

This report responds to a request by Scarborough Community Council, at its meeting on April  5, 2016, for a report from the Director, Transportation Services, Scarborough District on a proposal to enact an amendment to the Municipal Code that would permit the use of the "driveway apron" (the section between the curb and sidewalk) for parking purposes on Painted Post Drive in Ward 38. The Municipal Code currently prohibits the use of this area for parking purposes across the City, with the exception of one street in Ward 8 (Shoreham Drive).

 

The exemption to the Municipal Code for Shoreham Drive was enacted by City Council in April 2015.  Therefore, the full implications of this "apron parking" on Shoreham Drive are not yet known due, in part, to the relatively moderate winter the city experienced last season.  Nevertheless, based on an assessment of the potential impacts of parked vehicles on traffic operations, pedestrian activity, and winter maintenance, and the potential safety implications, staff have concerns with the proposed exemption.  The implications of this proposal and the basis of these concerns are presented in this report for information.

Financial Impact

There is no financial impact associated with this report. However, should Council approve the installation of a pedestrian crossover or traffic control signals, the cost would be approximately $95,000.00 and $160,000.00 respectively. Summary

This report recommends that the existing eastbound right-turn lane pavement markings and regulatory signage at the intersection of Steeles Avenue East and Staines Road be by-lawed to make the existing regulations enforceable. The existing right turn lane signs and pavement markings define the lane usage in order to mitigate conflicts and define turning movements but, the corresponding regulations are not currently included in Toronto Municipal Code Chapter 950.  Staff also recommend general changes to the pavement markings for eastbound and westbound through traffic in order to make lane usage clearer and safer.

Financial Impact

The financial costs of modifying the pavement markings is approximately $7,000.00. The funds for these pavement markings is available in the Transportation Services 2016 Operating Budget, within Cost Centre TP0398. There are no costs associated with right- turn lane regulatory signage since it is existing.

Summary

The purpose of this report is to obtain City Council direction on a request by the Owner that the Ontario Municipal Board impose conditions of site plan approval that would require the Owner to convey a wooded portion of the subject lands to the City, for nominal consideration, at an upcoming site plan condition appeal hearing of the Ontario Municipal Board scheduled for August 4 and 5, 2016.  The proposal is a response to conditions the Toronto and Region Conservation Authority has indicated would apply to a future fill permit for the development before the Board at this hearing.

Financial Impact

The applicant will be responsible for the closing costs and environmental remediation (if required) of the proposed conveyance.  The nominal payment of $2 will be funded from the Parkland Acquisition – General Services Capital Project account.

 

The future operating impact for this Property will be reviewed and added to the following year's Operating Budget submission after the conveyance is completed and when full maintenance services are expected to commence.  It is also noted that this report proposes the Ontario Municipal Board apply a site plan condition requiring the Owner to contribute $80,000 to the City to be used toward the renaturalization of this Property. 

 

The Deputy City Manager and Chief Financial Officer have reviewed this report and agree with the financial impact information.

Summary

This report recommends steps to be taken to harmonize the policies respecting the alternative parkland dedication rate as set out in the Scarborough Centre Secondary Plan and the Warden Woods Community Secondary Plan with the alternative parkland dedication policies as set out in the Official Plan by initiating an amendment to the Scarborough Centre and Warden Woods Community Secondary Plans.  Further, this report outlines the steps to be taken to ensure these policies are consistent with the City of Toronto Municipal Code Chapter 415, Development of Land (Article III: Conveyance of Land for Park Purposes as a Condition of Development).

 

City Planning recommends that a community consultation meeting be held. A final report and Public Meeting is targeted for the 4th quarter of 2016.

Financial Impact

An amendment to the alternative rate of the parkland dedication policies in the Scarborough Centre Secondary Plan (See Attachment 1: Scarborough Centre Secondary Plan) and the Warden Woods Community Secondary Plan (See Attachment 2: Warden Woods Community Secondary Plan) by bringing into effect the City-wide alternative rate parkland dedication policies which provide for a "cap" on the amount of parkland and cash-in-lieu, could have an impact on future cash-in-lieu revenues.  Currently, the Scarborough Centre Secondary Plan and the Warden Woods Community Secondary Plan do not contain a policy which provides for a "cap" on the alternative rate for parkland dedication as is provided in the Official Plan.

 

The principal effect of any proposed amendment would be to bring the amount of parkland dedication (including cash-in-lieu of parkland) received from development in both the Scarborough Centre and Warden Woods Community Secondary Plan areas consistent with other areas of the City of Toronto.  This may result in a different amount of cash-in-lieu received for parkland than otherwise currently provided in each of the Secondary Plans where no cap is provided.  However, potential changes to the amount of cash-in-lieu are uncertain as it depends upon the scale and rate of development in the Scarborough Centre and the Warden Woods Community.  The financial impact of any proposed amendment may need to be assessed by the Deputy City Manager and Chief Financial Officer and included in any subsequent final report to Community Council.

Summary

This application proposes to amend the Zoning By-law by replacing existing Place of Worship zoning with an appropriate residential zone to permit a single-family dwelling having a second suite.

  

The existing structure on the site has been used solely for residential purposes since the early 1970's.  Approval of the application would establish new residential zoning generally consistent with that currently applying to the immediate neighbourhood.

 

The proposal complies with the Official Plan, conforms to the Growth Plan for the Greater Golden Horseshoe and is consistent with the Provincial Policy Statement.

The land use proposed is compatible with adjacent and nearby land uses and adequately addresses applicable development criteria. The redevelopment is appropriate given the area context and will result in no adverse impacts.

Recommendations

Toronto Building recommends that the Scarborough Community Council give consideration to the demolition application for 1390 Kingston Road and decide to:

 

1.  Refuse the application to demolish the building containing two vacant residential units because there is no permit to replace the building on the site; or

 

2.  Approve the application to demolish the building containing two vacant residential units without conditions; or

 

3.  Approve the application to demolish the building containing two vacant residential units with the following conditions:

                                                                                                                             

a.  that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III; if deemed appropriate by the Chief Building Official;

 

b.  that all debris and rubble be removed immediately after demolition;

 

c.  that sod be laid on the site and the site be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5 and 629-10, paragraph B;

 

d.  that any holes on the property are backfilled with clean fill;

 

e.  that all privately and publicly owned trees, which are protected by the City of Toronto By-laws, be protected in accordance with the By-laws during the demolition process;

 

f.  that the applicant for the demolition permit construct and substantially complete the new building to be erected on the site of the property where the building is to be demolished not later than two years from the day demolition of the existing building is commenced; and

 

g.  that on failure to complete the new building within the time specified in (f) above, the City Clerk shall be entitled to enter on the collector’s roll, to be collected in like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit contained in the residential property in respect of which the demolition permit is issued and that such sum shall, until payment, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued.

This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision.

 

In accordance with Section 33 of the Planning Act and the former City of Toronto Municipal Code Ch. 363, Article II “Demolition Control”, the application for the demolition of the vacant commercial building containing two vacant residential units at 1390 Kingston Road is referred to the Scarborough Community Council to refuse or to grant the application as a building permit has not been issued for a replacement building.

 

If the Scarborough Community Council grants issuance of the demolition permit, it may impose conditions if any, to be attached to the demolition permit.
