The purpose of this report is to advise Council concerning an application by the Property Manager of 3110-3120 Sheppard Avenue East for a site-specific Fence Exemption, pursuant to Section 447-2 of Toronto Municipal Code, Chapter 447- Fences.  The property owner is seeking Council's permission to be exempt concerning a proposed 1.8m high wood fence screen enclosure located in the front yard which does not comply with restrictions contrary to Section 447-2 of the bylaw.

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately-owned tree located at 45 Whiterock Drive. The application indicates the main reasons for requesting tree removal are due to concerns over the tree's proximity to the house and the concern that the tree may fail during a wind storm and fall towards the house. Falling needles and security due to the tree blocking the view of the house are additional concerns.


The subject tree is a Colorado spruce (Picea pungens) measuring 38 cm in diameter. Urban Forestry does not support the removal of this tree as it is healthy and maintainable.

Summary

This report responds to a request by Scarborough Community Council, at its meeting on April  5, 2016, for a report from the Director, Transportation Services, Scarborough District on a proposal to enact an amendment to the Municipal Code that would permit the use of the "driveway apron" (the section between the curb and sidewalk) for parking purposes on Painted Post Drive in Ward 38. The Municipal Code currently prohibits the use of this area for parking purposes across the City, with the exception of one street in Ward 8 (Shoreham Drive).

 

The exemption to the Municipal Code for Shoreham Drive was enacted by City Council in April 2015.  Therefore, the full implications of this "apron parking" on Shoreham Drive are not yet known due, in part, to the relatively moderate winter the city experienced last season.  Nevertheless, based on an assessment of the potential impacts of parked vehicles on traffic operations, pedestrian activity, and winter maintenance, and the potential safety implications, staff have concerns with the proposed exemption.  The implications of this proposal and the basis of these concerns are presented in this report for information.

This report recommends that neither traffic control signals nor a pedestrian crossover be approved near the intersection of Kennedy Road at Perthshire Street.  The assessment concludes that based on current peak vehicular and pedestrian volumes and delays and conflicts at this intersection, neither traffic control signals nor a pedestrian crossover is warranted at this time.

Financial Impact

There is no financial impact associated with this report. However, should Council approve the installation of a pedestrian crossover or traffic control signals, the cost would be approximately $95,000.00 and $160,000.00 respectively. Funding for either of these alternatives is not included in the Transportation Services 2016 Capital Budget.

1.   Prohibit heavy trucks at all times on Neelands Crescent, from Keeler Boulevard (west intersection) to Keeler Boulevard (east intersection).

 

2.   Rescind the existing school bus loading zone in effect from 8:00 a.m. to 5:00 p.m., on the south side of Keeler Boulevard, between a point 274 metres east of Skyridge Road and a point 69 metres further east.

This report recommends the adoption of a by-law to prohibit trucks and other heavy vehicles along Neelands Crescent in order to prevent the use and parking of such vehicles along this new local road.  Also recommended is the removal of a school bus loading zone by-law on Keeler Boulevard because the new subdivision has replaced a previous school.

The City Planning Division recommends that:

 

1.   Staff be directed to schedule a community consultation meeting for the lands at 253 Markham Road and 12, 20 and 30 Dunelm Street together with the Ward Councillor.

 

2.   Notice for the community consultation meeting be given to landowners and residents within 120 metres of the site.

 

3.   Notice for the public meeting under the Planning Act be given according to the regulations of the Planning Act.

Summary

This application proposes to amend the Official Plan and the relevant Zoning By-laws in order to permit the redevelopment of the subject lands with 431 new residential dwelling units comprised of 9-storey and 11-storey buildings, 4-storey, stacked townhouse blocks and a new city park. The application is required to establish the appropriate land use designation and relevant zoning provisions for the site. 

 

This report provides preliminary information on the above-noted applications and seeks Community Council's directions on further processing of the applications and on the community consultation process.

 

The application should proceed through the normal planning review process including the scheduling of a community consultation meeting.  A Final Report will be prepared and a public meeting is targeted for the 2nd quarter of 2017 assuming that the applicant provides all required information in a timely manner and all identified issues have been satisfactorily resolved.

Summary

This application proposes to amend the West Hill Community Zoning By-law, No. 10327, as amended, for the lands at 4569 Kingston Road, to permit a 12-storey mixed use building (37.5 metres plus 5.0 metre for a mechanical penthouse) having a total gross floor area of 9,397 square metres, including 9,197 square metre of residential floor space comprised of 98 one and two-bedroom dwelling units, and 200 square meters of ground floor commercial space.  The proposed density is 4.17 times the area of the lot, and all parking is proposed in a two-level underground garage containing 102 residential parking spaces.  The current zoning for the lands permits a maximum building height of 8-storeys plus rooftop mechanicals and specific performance standards.

 

This report provides preliminary information on the above-noted application and seeks Community Council's directions on further processing of the application and on the community consultation process.

Recommendations

The City Planning Division recommends that:

 

1.  In accordance with the delegated approval under By-law 229-2000, as amended, City Council be advised that the Chief Planner intends to approve the draft plan of common elements condominium for the lands at 3765 St Clair Avenue East, as generally illustrated on Attachment 1 to report dated August 5, 2016, from the Acting Director, Community Planning, Scarborough District, subject to:

 

a.  the conditions as generally listed in Attachment 2 to report dated August 5, 2016, from the Acting Director, Community Planning, Scarborough District, which except as otherwise noted must be fulfilled prior to the release of the plan of condominium for registration;  and

 

b.  any such revisions to the proposed condominium plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development.

 

2.  City Council enact a Part Lot Control Exemption By-law with respect to the subject lands at 3765 St. Clair Avenue East as generally illustrated on Attachment 3 to report dated August 5, 2016, from the Acting Director, Community Planning, Scarborough District, to be prepared to the satisfaction of the City Solicitor and to expire two years following enactment by City Council.

 

3.  City Council require the owner to provide proof of payment of all current property taxes for the subject lands to the satisfaction of the City Solicitor, prior to the enactment of the Part Lot Control Exemption By-law.

 

4.  Prior to the introduction of the Part Lot Control Exemption Bill, City Council require the owner to register, to the satisfaction of the City Solicitor, a Section 118 Restriction under the Land Titles Act agreeing not to transfer or charge any part of the lands without the written consent of the Chief Planner or  his/her designate.

 

5.  City Council authorize the City Solicitor to take the necessary steps to release the Section 118 Restriction from title at such time as confirmation is received that the Common Elements Condominium has been registered.

 

6.  City Council authorize and direct the City Solicitor to register the Part Lot Control Exemption By-law on title.

 

7.  City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Part Lot Control Exemption By-law as may be required.

Summary

This condominium application proposes to create common element driveways and visitor parking for a 21 unit townhouse development at 3765 St Clair Avenue East. The accompanying part lot control exemption application proposes to create one lot for each townhouse unit, for a total 21 conveyable lots.

 

The applications meet all of the applicable requirements and are consistent with the approved site plan.

 

This report reviews and recommends approval of the Draft Plan of Common Elements Condominium and Part Lot Control Exemption.
