Recommendations

The Budget Committee recommends that: 
 

1. In respect of calculations to establish 2022 tax rates and tax ratios, City Council elect the following in order to determine the notional tax rates to raise the previous year's levies:

 

a. to adjust the total assessment for property in a property class so that the assessment excludes changes to the tax roll for the previous year resulting from eligible assessment-related losses from prior years, in accordance with an election under subsection 19 (4) of O. Reg. 121/07 to make subsections 19 (4.2), (4.3) and (4.4) apply.

 

2. City Council adopt the 2022 tax ratios shown in Column II for each of the property classes set out below in Column I:

3. City Council elect to raise the tax rates as follows

 

a. on the restricted property classes:

 

1. on the Commercial Property Classes, by one-half of the percentage tax rate increase on the residential (and new multi-residential, pipelines, farmlands, and managed forests) property class; and

 

2. on the Multi-Residential Property Classes, no tax increase; and

 

b. on the Industrial Property Classes, by one-third of the percentage tax rate increase on the residential (and new multi-residential, pipelines, farmlands, and managed forests) property class.

 

4. City Council adopt:

 

a. the tax rates set out below in Column IV, which will raise a general local municipal tax levy for 2022 of $4,827,200,581 inclusive of a 2.9% residential, new multi-residential, pipeline, farmlands and managed forest tax rate increase, a 1.45% commercial tax rate increase, and a 0.97% industrial tax rate increase;

 

b. the additional tax rates set out below in Column V, which will raise an additional special general tax levy of $51,599,014  dedicated for priority transit and housing capital projects (the "City’s Building Fund levy"), in accordance with Council adopted Recommendation 6 of Executive Committee Report EX22.2 (February 15, 2017) and Item EX11.26 (December 17, 2019).

6. City Council determine that the 2022 Non-Program Tax Account for Rebates to Charities in the Commercial and Industrial Property Classes be set in the amount of $6,822,690 to fund the mandatory 2022 property tax rebates to registered charities in the commercial and industrial property classes, which provision is to be funded, for a net impact on the 2022 operating budget of zero, by the following:

 

a. an additional tax rate of 0.005482% be levied as part of the general local municipal levy on the commercial class to raise a further additional local municipal tax levy of $6,729,454 to fund the total estimated rebates to registered charities for properties in the commercial class in 2022; and

 

b. an additional tax rate of 0.001118% be levied as part of the general local municipal levy on the industrial class to raise a further additional local municipal tax levy of $93,236 to fund the total estimated rebates to registered charities for properties in the industrial class in 2022.

 

7. City Council allocate $4,992,011 to the SmartTrack Funding Reserve Fund (XR1731), in accordance with Council adopted Recommendation 19 (e) of Executive Committee Report EX33.1 (April 24, 2018), which  is comprised of the accumulated base of $2,725,393 plus $2,266,618, equivalent to 15 percent of all incremental municipal tax revenue arising from commercial and residential assessment growth in the Tax Increment Financing Zones for 2021, net of any Imagination, Manufacturing, Innovation and Technology Grants attributable to this assessment growth.

 

8. City Council direct the Chief Financial Officer and Treasurer to report to Executive Committee, or directly to Council or a special meeting of Council if necessary, on the 2022 tax rates for school purposes, and the 2022 percentage of the tax decreases required to recover the revenues foregone as a result of the cap limit on properties in the commercial, industrial and multi-residential property classes (the 2022 ‘clawback’ rates).

 

9. City Council determine that:

 

a. the instalment dates for the 2022 final tax bills be set as follows:

 

1. the regular instalment dates be July 4, August 2, and September 1 of 2022;

 

2. for taxpayers who are enrolled in the monthly pre-authorized property tax payment program, the instalment dates be July 15, August 15, September 15, October 17, November 15 and December 15 of 2022; and

 

3. for taxpayers who are enrolled in the two installment program, the final instalment date be July 4, 2022; and

 

b. the collection of taxes for 2022, other than those levied under the interim levy By-law 1086-2021, be authorized.

 

10. City Council temporarily suspend the following eligibility criteria requirements for the Creative Co-Location Facilities Subclasses in the Toronto Municipal Code, Chapter 767, Taxation, Property Tax, in 2022, in order to continue to assist creative enterprises to remain in the subclass while the COVID-19 pandemic and public health emergency orders are obstructing them from meeting these criteria:

 

a. for the Tenant-Based Model:

 

1. that a minimum of 51 percent of the tenants of the property be tenant creative enterprises;

 

2. that tenant creative enterprises must occupy at least 51 percent of the property's net rentable area; and

 

3. that a minimum of 12 cultural programs be offered free of charge to the public at the property over a minimum of 10 months in each calendar year; and

 

b. for the Membership-Based Model:

 

1. that the operator must provide members access to and use of the following shared resources for a minimum of 8 hours per day, 5 days per week:

 

a. work space consisting of office or production space;

 

b. meeting or conference space;

 

c. high-speed wireless internet access that meets minimum standards established by the Canadian Radio-Television and Telecommunication; and

 

d. office equipment; and

 

2. that a minimum of 25 professional development programs, services or events must be offered to members, in the calendar year.

 

11. City Council amend City of Toronto Municipal Code Chapter 767-5.4, to update the Tax Cancellation program eligibility for 2022 to increase the household income threshold for eligible persons to $46,305, and the assessed value for eligible property to $975,000.

 

12. City Council authorize the appropriate officials to take the necessary actions to give effect to City Council's decision and authorize the introduction of the necessary bills in Council.

Summary

At its meeting on February 7, 2022, the Budget Committee considered Item BU45.2 headed "2022 Property Tax Rates and Related Matters" and made recommendations to the Executive Committee. The Executive Committee will make recommendations on this Item to City Council for its consideration at its meeting on February 17, 2022.

 

Summary from report (January 14, 2022) from the Chief Financial Officer and Treasurer

 

This report recommends the 2022 municipal tax ratios and tax rates arising from the concurrent adoption of the City of Toronto's 2022 tax supported Operating and Capital Budgets.

                                                        

For 2022, staff recommend an overall average budgetary tax rate increase of 2.11 per cent as shown below in Table 1, which includes an inflationary increase of 2.90 per cent for residential properties, a 1.45 per cent increase for commercial properties, and a 0.97 per cent increase for industrial properties. In compliance with provincial regulations, there is no increase recommended for multi-residential properties. The report also recommends the adoption of an incremental increase of 1.5 per cent to the City Building Fund Levy, as approved by City Council in 2019.

As the next property value reassessment date has been postponed by the Province, property assessments in 2022 will reflect the same assessment value as 2020 and 2021.

Financial Impact

The tax ratios and rates recommended in this report reflect tax policy decisions previously adopted by City Council as permitted and/or mandated by recent or pending Provincial regulatory changes, including:

 

- allowing one-half of the tax rate increase on the Residential property class to be applied to the Commercial property class;


- continuing to apply one-third of the tax rate increase on the Residential property class to the Industrial property class;


- freezing of the tax burden on the Multi-Residential property class for 2022, as mandated by the Province;


- making a property tax rate calculation adjustment to reflect the year-end assessment used in the notional property tax rate calculation to offset changes resulting from certain in-year assessment-related changes (i.e. adjustment for appeals)

As a result of the postponement of the planned property tax reassessment by the Province, assessments for the 2022 taxation year continue to be based on the same current assessment value that was in effect for the 2021 and 2020 taxation years, unless there was a change to the assessed value or tax classification. The average residential property value for tax assessment purposes for 2022 is $697,185.

Corporate Initiatives

 

215. City Council approve 2022 Staff Recommended Capital Budget for Corporate Initiatives with cash flows and future year commitments totaling $3.355 million (including $1.835 million of carry forward) as detailed by project in appendix 2.1.1 to the report (January 13, 2022) from the Chief Financial Officer and Treasurer.

 

216. City Council, in approving the 2022-2031 Capital Budget and Plan, express its intent to ensure that:

 

a. the increase in need for services attributable to anticipated development will be met; and

 

b. any future excess capacity identified will be paid for by development charges or other similar charges.

 

217. City Council approve contributions and withdrawals to/from reserves in Corporate Accounts as indicated in Appendix 3 to the report (January 13, 2022) from the Chief Financial Officer and Treasurer.

 

218. City Council authorize the Mayor (or as an alternate to the Mayor, either the Deputy Mayor or the Chair of the Budget Committee) and the Chief Financial Officer and Treasurer, during 2022, to enter into agreements for the sale, or the issuance and sale, of debentures, and revenue bonds and for entering into bank loan agreements, upon such terms and conditions, including price, as they deem expedient, for the purposes of borrowing money to obtain or provide long-term financing of any capital work, in an annual amount not to exceed $2.0 billion per year provided that such debt issue is in compliance with the Council approved existing debt guidelines.

 

219. City Council amend Municipal Code Chapter 30, Debenture and other Borrowing, to reflect Recommendation 218 above, and authority be granted for the introduction of the necessary Bills in Council to give effect to the foregoing. 

  

Service Levels

 

220. City Council approve the 2022 service levels for Tax Supported Programs as outlined in Appendix 1 to the report (January 13, 2022) from the Chief Financial Officer and Treasurer, titled "Recommended 2022 Service Levels - Tax Supported Programs".

Summary

At its meeting on February 7, 2022, the Budget Committee considered Item BU45.1 headed "2022 Capital and Operating Budgets " and made recommendations to the Executive Committee. The Executive Committee will make recommendations on the 2022 Capital and Operating Budgets to City Council for its consideration at its meeting on February 17, 2022.

Staff Recommended Tax Supported 2022 Operating Budget and 2022-2031 Capital Budget and Plan Summary

 

This report seeks Council approval of the 2022 Corporate Accounts Budget for expenditures and revenues totalling $2.153 billion and $3.413 billion respectively. 

 

Corporate Accounts include Capital and Corporate Financing, and Non Program expenditures and revenues that are detailed in Appendix 1. 

 

This report also seeks authority for approval of corporate capital initiatives totalling $3.355 million (including $1.835 million of carry forward) as detailed in Appendix 2.1.1.

 

Capital Financing and Non Program expenditures and revenues forms part of the overall City's Operating Budget and corporate capital initiatives for part of the City's overall 10-year capital program, as summarized below.

2022 Staff Recommended Tax Supported Operating Budget Overview

 

The 2022 Staff Recommended Tax Supported Operating Budget is $13.026 billion gross and $4.645 billion net. The budget preserves existing essential services, while adhering to health guidelines; addresses continued COVID-19 pressures; maintains an inflationary residential tax rate increase for City Operations; focuses on equity and prosperity for all; and includes $54 million in new or enhanced investments.

 

Continuous and new investments include a $1.4 billion to manage COVID-19 through continued partnerships with the Government of Canada, and $135.0 million to support building a prosperous Toronto including $71 million in equity initiatives, $35 million in a safe a livable city and $29 million in modernization.   These have been offset with $494 million in savings through City-led mitigation strategies.

  

The Staff Recommended Operating budget primarily allocates funds to social programs (29.0%), TTC services (17.2%), and emergency services (15.9%), with the funding coming from property taxes (35.7%), Federal and Provincial revenues, which includes continued COVID-19 support (31.3%), Land Transfer Tax (7.3%), TTC fares which remain lower than pre-pandemic levels (6.1%) and Fee and Fine revenues (6.1%).

 

2022-2031 Staff Recommended Capital Budget and Plan Overview

 

The 2022-2031 Staff Recommended Capital Plan focuses on investments in transit funding ($13.4 billion), transportation ($5.4 billion), environment ($3.4 billion) and housing ($3.3 billion and a further $4.7 billion in incentives); and includes increased investments for new capital projects such as trails & pathways, park development and community centres and special facilities as well as the Toronto Zoo, Children’s Service and Exhibition Place.   The 10 Year Capital Plan also includes new investments in mobility, housing, modernization and transformation and has applied a lens that ensures considerations of infrastructure investment involve a climate focus as part of the decision making process climate change emergency.

 

The Staff Recommended 10 Year Capital Budget and Plan addresses achievability and affordability, continues to allocate funds generated from the increase to the City Building Fund, addresses recent Council commitments and reflects government partnerships.

1. City Council approve the Toronto Public Health 2022 Operating Budget Submission of $362,678.1 thousand gross, $128,753.0 thousand net and 2,736.7 positions, as summarized in Table 1, Overview of the Toronto Public Health 2022 Operating Budget Submission in the report (October 12, 2021) from the Medical Officer of Health, which includes the following incremental increases (and decreases, as outlined in Recommendations 1.e. and 1.k. below) from the Toronto Public Health 2021 Council Approved Operating Budget:

 

a. an increase of $403.4 thousand gross and net for inflationary cost increases in the Student Nutrition Program;

 

b. an increase of $922.0 thousand gross, $0 net and 9.0 positions to annualize the Overdose Prevention Site Program;

 

c. an increase of $3,422.5 thousand gross and $0 net for the Toronto Voluntary Isolation Centre;

The attached report provides information supporting the Auditor General's 2022 Operating

Budget request of $7.658 million. This includes $675,000 to restore the Auditor General's budget to pre-pandemic (2020) levels and an additional $325,000 in temporary funding for a pandemic related audit requested by City Management. The Auditor General's budget request reflects funding needed to help address some of the following:

 

- responding to an expanded mandate and inflow of requests for audits;

 

- providing valuable independent oversight of critical systems to ensure the City is well-positioned to detect, mitigate, and respond to IT and cybersecurity risks;

 

- conducting investigations on serious, time-sensitive issues;

 

- undertaking the City-wide COVID-19 Continuous Improvement Audit.

 

In light of funding issues brought on by the pandemic, the Auditor General worked on delivering a larger mandate within a reduced 2021 budget. While she and her dedicated staff accomplished important work on this expanded mandate in 2021, some of that work carries on and more issues are being identified, so support is needed to meet critical emerging issues, in addition to working on projects in this expanded mandate. The Auditor General is requesting a return to her 2020 budget level by adding back $675,000 to her budget.

 

The Auditor General is also considering an audit that stems from a special request from the City Manager, the Fire Chief and General Manager of Emergency Management and COVID-19 Incident Commander, and the Medical Officer of Health. They have requested an audit of how the City performed during the pandemic, with a goal of also identifying how to be better prepared in the future. Should City Council support this request, the Auditor General would need additional temporary funding of $325,000 to conduct this work. This amount is already included in the Auditor General's 2022 budget request.

 

The Auditor General's Office provides City Council with an independent assessment of the safeguarding of public funds and whether the City is achieving value for money in operations by conducting performance, cybersecurity, financial, operational and compliance audits and reviews, and forensic investigations of City divisions and certain City agencies and corporations. As reported in her past Annual Reports, the Auditor General continues to demonstrate her value to City Council through the net positive return on quantifiable and non-quantifiable benefits to the City.

 

The Auditor General's 2022 Work Plan is being presented to the Audit Committee at the

same meeting as her 2022 Operating Budget. The 2022 budget request supports 11 in-progress and ongoing projects that will be completed in 2022, and five new projects to commence in late 2021 or 2022. City Council's support to restore the Auditor General's budget to pre-pandemic (2020) levels and provide additional temporary funding for an audit of the City's COVID-19 response, helps to address the 2022 Work Plan, including the requested audit of the City's COVID-19 response, as well as commence projects in the following areas:

 

- cybersecurity assessment of a critical system – possibly the 911 system;

 

- Information Technology - Enterprise Work Management System;

 

- additional investigations related to allegations of fraud or other wrongdoing.

The City Manager recommends that:

 

1. City Council approve the Toronto Local Appeal Body variable decision rates outlined in this report, and authorize the Director, Court Services to include these rates as part of its 2022 budget submission effective April 1, 2022.

Summary

This report responds to City Council's direction through PH23.13 to report back through the 2022 budget process on the financial implications of amending the decision writing stipend accorded to Toronto Local Appeal Body Members from a rate of $200 per decision to a varied rate with a maximum of $400. The Toronto Local Appeal Body is an independent, quasi-judicial tribunal established through the City of Toronto Municipal Code Chapter 142, City of Toronto Act, and other provincial legislation.

 

The City Manager's Office, Court Services, City Clerk's Office and the Chair of the Toronto Local Appeal Body were consulted on the proposed variable decision rates. Compensation rates of other municipal and provincial tribunals were also taken into consideration to determine the appropriate remuneration for Toronto Local Appeal Body decisions. The proposed remuneration reflects the complexity of the decision and the effort required to produce a decision.

Financial Impact

 

City Council approval of the proposed Toronto Local Appeal Body variable decision rates will have an impact on the expenditures of Toronto Court Services as outlined below in Table 1.

This report, completed on an annual basis as part of the budget process, summarizes federal and provincial infrastructure funding programs which are identified in the 2022-2031 Staff Recommended Capital Budget and Plan.

The current 10 Year Capital Plan includes intergovernmental funding commitments of $5 billion over 10 years, however the City will continue to seek funding partnerships towards transit needs; opportunities to advance the provincial and national climate goals; and to address regional housing and shelter needs. These projects rely on successful partnerships with other orders of government and require committed funding from the provincial and federal governments to deliver.

 

The Government of Canada and the Ontario Government are expected to contribute approximately $5.0 billion (11%) towards the City of Toronto's $46.6 billion 2022-2031 Staff Recommended Tax and Rate Supported Capital Budget and Plan (federal: $3.4 billion; provincial: $1.6 billion over the 10 year planning period).

Financial Impact

In total, the Government of Canada and the Ontario Government are expected to contribute $5.0 billion (11%) towards the $46.6 billion 2022-2031 Staff Recommended Tax and Rate Supported Capital Budget and Plan (federal: $3.4 billion; provincial: $1.6 billion).

 

Additionally, the City will continue to seek funding partnerships with the government of Canada and province of Ontario towards capital infrastructure needs including investments in our transit system; opportunities to advance the city's, provinces and nations climate goals; and to invest in affordable housing needs in the region.

In addition to the funding programs discussed in this report, the 2022-2031 Staff Recommended Tax and Rate Supported Capital Budget and Plan and appropriate budget notes provide details on intergovernmental funded infrastructure projects and programs comprising the $5.0 billion total in expected intergovernmental infrastructure funding. Federal and provincial funding is summarized in Table 1 below.

Intergovernmental funding programs often require the City of Toronto to commit to providing matching funds or a percentage of total eligible project costs in order to receive provincial or federal funding. The City-funded portions of the above funding programs are included in the 10 Year Capital Plan.

In addition, the City proactively commits funding for capital projects to leverage anticipated future provincial and federal funding programs. The current 10 Year Capital Plan includes intergovernmental funding commitments of $5 billion over 10 years, however the City will continue to seek funding partnerships towards transit needs; opportunities to advance the provincial and national climate goals; and to address regional housing and shelter needs. These projects rely on successful partnerships with other orders of government and committed funding from the provincial and federal governments to deliver.

Recommendations

The Two-Spirit, Lesbian, Gay, Bisexual, Transgender and Queer Advisory Committee recommends that:

 

1. City Council direct the City Manager to demonstrate that an intersectional Two-Spirit, Lesbian, Gay, Bisexual, Transgender and Queer lens is incorporated in the preparation and adoption of the City's Operating and Capital Budgets to remove structural barriers that have historically excluded and harmed the diverse Two-Spirit, Lesbian, Gay, Bisexual, Transgender and Queer communities.

At its meeting on February 10, 2022, the Two-Spirit, Lesbian, Gay, Bisexual, Transgender and Queer Advisory Committee considered Item QS5.4 and made recommendations to City Council.

Recommendations

The Budget Committee recommends that:

 

1. City Council receive the report (January 24, 2022) from the Chief Financial Officer and Treasurer for information.

Summary

At its meeting on February 7, 2022, the Budget Committee considered Item BU45.3 headed "Response to Ontario Regulation 286/09 Budget Matters - Expenses" and made recommendations to the Executive Committee. The Executive Committee will make recommendations on this Item to City Council for its consideration at its meeting on February 17, 2022.

 

Summary from report (January 24, 2022) from the Chief Financial Officer and Treasurer

 

Ontario Regulation 286/09 "Budget Matters - Expenses" (Regulation) permits the City of Toronto (City) to exclude the following expenses from its annual budget:

 

- amortization expenses;

 

- post-employment benefits expenses; and

 

- solid waste landfill closure and post-closure expenses.
 

In addition, the Regulation requires that the City:

 

- prepare a report about the excluded expenses which contains:

 

- an estimate of the change in accumulated surplus as a result of the exclusion of the above expenses; and

 

- an analysis of the estimated impact of the exclusion of these expenses on future tangible capital asset funding requirements; and

 

- adopt the report prior to the adoption of its annual budget.
 

This report is presented to Budget Committee and City Council in response to the Regulation.

 

The City's annual balanced budget outlines the funds required to support the City's anticipated operating expenses for the fiscal year, along with funds required to support the planned acquisition or development of tangible capital assets.  The balanced budget, which is prepared using a cash basis of accounting versus the accrual basis used for financial reporting purposes, excludes the above expenditures, estimated at $1.56 billion for 2022.  The excluded expenses result in a reduction to the City's accumulated surplus balance.  The City's accumulated surplus represents the amount the City has invested in its tangible capital assets.  These expenses represent non-cash accounting expenditures required for financial reporting.

Financial Impact

There are no current or known future year financial impacts arising from the recommendation contained in this report.

 

The expenditures excluded from the City's budget do not require immediate cash outlays; rather, they represent financial reporting allocations or increases to liabilities that will be exhausted at a future date. The $1.56 billion estimated value of these expenses for 2022 will reduce the City's accumulated surplus balance, which is comprised mainly of the net value of the City's historical investments in tangible capital assets.

 

The Chief Financial Officer and Treasurer has reviewed this report and agrees with the financial impact information as identified in this section.
