Recommendations

Municipal Licensing and Standards recommends that the Scarborough Community Council:

 

1.  Refuse to grant the application for an exemption permit, by the property owner of 64‑70 Raleigh Avenue, for a proposed fence that fails to comply with the provisions of Toronto Municipal Code, Chapter 447, Fences.

 

OR

 

2.  Grant the application for a fence exemption permit, thereby allowing the fence to be constructed as proposed.  Direct and require that the installation be maintained in good repair without alteration.  Direct and require that at such time as replacement of the fence is required that such installation will comply with Municipal Code Chapter 447, or its successor by-law.

The purpose of this report is to advise Council concerning an application by the property owner of 64-70 Raleigh Avenue for a site-specific Fence Exemption, pursuant to Section 447-5.C of Toronto Municipal Code, Chapter 447- Fences.  The property owner is seeking Council's permission to install a fence which does not comply with maximum fence height restrictions and is topped with barbed wire contrary to Section 447-2 of the by-law.

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately-owned tree located at 41 Ferncroft Drive.  The owner is requesting removal of this tree because of the condition of the tree, concerns over potential tree failure, and the cost to maintain the tree.


The subject tree is a silver maple (Acer saccharinum), measuring 107 cm in diameter.  Urban Forestry does not support the removal of this tree as it is healthy, maintainable and growing in an appropriate location.

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately-owned tree located at 50 McCowan Road.  The application indicates the reasons for removal are to accommodate construction of a new home and to address the nuisance from shade, falling needles and dripping sap.

 

The subject tree is a white spruce (Picea glauca), measuring 63 cm in diameter.  Urban Forestry does not support the removal of this tree as it is healthy, maintainable and growing in an appropriate location.

Toronto Building recommends that the Scarborough Community Council give consideration to the demolition application for 17 Fishleigh Drive and decide to:

 

1.  Refuse the application to demolish the single family dwelling because there is no permit to replace the building on the site; or

 

2.  Approve the application to demolish the single family dwelling without condition; or

 

3.  Approve the application to demolish the single family dwelling with the following conditions:

 

a.  that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official;

 

b.  that all debris and rubble be removed immediately after demolition;

 

c.  that sod be laid on the site and be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5, and 629-10, paragraph B; and

 

d.  that any holes on the property be backfilled with clean fill.

In accordance with Section 33 of the Planning Act and the former City of Toronto Municipal Code Ch. 363, Article II “Demolition Control”, the application for the demolition of a vacant single family dwelling at 17 Fishleigh Drive is referred to the Scarborough Community Council to refuse or to grant the application as a building permit has not been issued for a replacement building.

 

If the Scarborough Community Council grants issuance of the demolition permit, it may impose conditions if any, to be attached to the demolition permit.

Financial Impact

Future property tax revenues may be reduced due to a change in the property’s classification.

This report recommends that minor street stop signs be deployed at the intersection of Lily Cup Avenue and Nixon Heights as well as at Belanger Crescent at Lily Cup Avenue, which are currently uncontrolled three-way "T-type" intersections in this new subdivision, in order to clearly define the right-of-way and to regulate traffic flow. The minor street stops will also require motorists to stop before the sidewalk to enhance pedestrian safety.

Financial Impact

The financial cost of installing the subject recommended stop controls is approximately $500.00.  The funding for the signs is available in the Transportation Services 2015 Operating Budget, within Cost Centre TP0397.

1.   Prohibit standing at all times from December 1 of one year to April 15 of the next following year, inclusive, on the north side of Kawneer Terrace, from Great West Drive to Zezel Way.

 

2.   Prohibit standing from 2:00 a.m. to 6:00 a.m., from December 1 of one year to April 15 of the next following year, inclusive, on the south side of Kawneer Terrace, from Great West Drive to Zezel Way.


3.   Prohibit standing at all times from December 1 of one year to April 15 of the next following year, inclusive, on the north side of De Jong Street, from Great West Drive to Zezel Way.

 

4.   Prohibit standing from 2:00 a.m. to 6:00 a.m. from December 1 of one year to April 15 of the next following year, inclusive, on the south side of De Jong Street, from Great West Drive to Zezel Way.

This staff report is about a matter that the Community Council has delegated authority from City Council to make a final decision.

 

This report recommends the adoption of a by-law to prohibit standing on both sides of Kawneer Terrace, De Jong Street, and Zezel Way during the winter periods from December 1 to April 15.  One side of these streets will have no standing throughout the day, while the other will have no standing from 2:00 a.m. to 6:00 a.m. daily, in order to provide a nightly time window for snow clearing operations, and a snow storage area on one side of these streets.  The other side of the streets will have the default 3-hour parking rules in effect to provide short-term parking for this community from 6:00 a.m. to 2:00 a.m. daily.  There is currently unposted 3‑hour parking along these streets that causes operational issues during the winter due to the narrow pavement widths and sidewalks on both sides of these streets situated immediately adjacent to the roadway.

Financial Impact

The cost of installing the No Standing signs is approximately $5,000.  These funds are available in the Transportation Services 2015 Operating Budget, within cost centre TP0397.  However, the cost of clearing snow after snow events from the No Standing zones where parking will still be allowed from 6:00 a.m. to 2:00 a.m. is expected to cost approximately $9,500 per snow event.

The report recommends that lane designations be deployed along Milliken Boulevard between Finch Avenue East and McNicoll Avenue.  The proposed two-way left turn lane, right-turn lane and left-turn lane designations will facilitate safe and efficient movement of traffic using this new road extension when the road becomes open for operation.

Financial Impact

The financial cost of installing the recommended lane designation signs is approximately $4,000. The funding for these lane designation signs is available in the Transportation Services 2015 Operating Budget, within Cost Centre TP0397.

1.  City Council designate the southerly westbound lane on Middlefield Road, between McCowan Road and a point 150 metres east, for westbound left turns only.

 

2.  City Council designate the northerly westbound lane on Middlefield Road, between McCowan Road and a point 150 metres east, for westbound through and right turns only.

Summary

This report recommends that the existing westbound left-turn lane and the westbound shared through/right-turn lane pavement markings and regulatory signage at the Middlefield Road and McCowan Road intersection be by-lawed to make the existing regulations enforceable. The existing signs and markings clearly define lane usage in order to mitigate conflicts and define turning movements but corresponding regulations are not currently included in Toronto Municipal Code Chapter 950.

Financial Impact

There are no financial costs to Transportation Services 2015 Operating Budget, because the existing lane designation and regulatory signage are already in place having been installed several years ago.

Summary

This staff report is about a matter that the Community Council has delegated authority from City Council to make a final decision.

 

During an operational review, Transportation Services Staff identified five uncontrolled three-way intersections in the area of Woodgrove Drive.  This report recommends that minor street stop signs be installed at these five uncontrolled three-way intersections. 

 

It is also recommended that the existing heavy vehicles prohibition be modified to reflect the new extension of Woodgrove Drive.  The prohibition of heavy vehicles will conform to the standard practice for local roads.

 

The proposed minor street stop signs and heavy vehicles prohibition are anticipated to clearly define the right-of-way to regulate traffic flow, maintain two-way traffic flow and discourage heavy trucks from parking on Woodgrove Drive.

Financial Impact

The financial cost for minor street stop controls at four (non-development related) uncontrolled three-way intersections is approximately $1000.00. Funding for these stop controls are available in the Transportation Services 2015 Operating Budget, within cost centre TP0397.

 

There is no cost to install the stop control sign and the heavy vehicle prohibition on Woodgrove Drive (east/west leg) because the funding has been secured from the developer of the new subdivision in this area.

Summary

This application proposes a zoning by-law amendment to permit redevelopment of the north portion of the site with two seniors 'life lease' residential buildings of 25 and 30 storeys containing a total of 448 residential units, along with at-grade commercial units and amenity areas at 1250 Markham Road.  The application also includes a proposal to construct a four-level above ground parking structure on the southwest portion of the site to provide replacement parking to serve the existing place of worship (see Attachment 1: Site Plan).

 

This report provides preliminary information on the above-noted application and seeks Community Council's directions on further processing of the application and on the community consultation process.

 

The subject application should proceed through the standard planning review process including the scheduling of a community consultation meeting.  A final report and public meeting is targeted for the 3rd Quarter of 2016 assuming that all required information is provided by the applicant in a timely manner and all issues raised during the review process are satisfactorily resolved.

The City Planning Division recommends that:

 

1.   City Council authorize the City Solicitor together with City Planning staff and other staff as appropriate to oppose the applicant's appeal respecting Official Plan and Zoning By-law Amendment Application No. 14 265429 ESC 40 OZ at 3105 to 3133 Sheppard Avenue East and attend any Ontario Municipal Board hearing in opposition to such appeal, for the reasons discussed in the report (October 23, 2015) from the Director, Community Planning, Scarborough District and any additional issues identified through the detailed review of these applications.

 

2. City Council authorize City staff to continue discussions with the applicant on a revised proposal which addresses the issues set out in the report (October 23, 2015) from the Director, Community Planning, Scarborough District and if necessary, for the City Solicitor to report further to City Council if a settlement is reached.

 

3. City Council direct the City Solicitor to advise the Ontario Municipal Board that the zoning by-law should not be approved without the provision of such services, facilities or matters pursuant to Section 37 of the Planning Act as may be considered appropriate by the Chief Planner in consultation with the applicant and the Ward Councillor.

Summary

This application proposes to amend the Official Plan and Zoning By-law to permit a 30-storey mixed use building including a 6-storey podium at 3105 to 3133 Sheppard Avenue East.  The proposal consists of 365 apartment dwelling units and ground floor commercial uses fronting Sheppard Avenue East.  Three levels of underground parking are proposed with driveway access proposed from Pharmacy Avenue.

 

On June 29, 2015, the owner appealed the Official Plan and Zoning By-law Amendment applications to the Ontario Municipal Board citing City Council's failure to make a decision within the prescribed time frames set out in the Planning Act.   A pre-hearing conference was held on September 29, 2015 with a second pre-hearing conference scheduled on January 26, 2016.  A full hearing at the Scarborough Civic Centre is scheduled for 10 days beginning April 18, 2016.

 

This report seeks Council's direction to oppose the applications at the Ontario Municipal Board. 

 

The applications do not represent an appropriate redevelopment of the site and do not represent good planning for the reasons discussed in this report.  It is recommended that the City Solicitor be directed to attend the OMB Hearing to oppose the development, in its current form and that staff be authorized to continue discussions on a revised proposal which addresses the issues set out in this report.

The redevelopment is appropriate given the area context and will result in no adverse impacts.

Toronto Building recommends that the Scarborough Community Council give consideration to the demolition application for 1320 Kingston Road and decide to:

2.  Approve the application to demolish the single family dwelling without condition; or

 

3.  Approve the application to demolish the single family dwelling with the following conditions:


a.  that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official;

Councillor Gary Crawford recommends that:

 

1.  City Council exempt the implementation of permit parking on Meadow Avenue, between Victoria Park Avenue and Blantyre Avenue, from the requirements of subsection 925-4B of City of Toronto Municipal Code Chapter 925, Permit Parking, until such time as Scarborough Community Council considers a request for implementation of permit parking at that location.

Summary

Subsection 925-4B of City of Toronto Municipal Code Chapter 925, Permit Parking, provides that:

 

Where permit parking is not currently available and where a petition requesting permit parking signed by the residents of a minimum of 25% of the total number of residential premises having a residential address on the street or the flank of the street is submitted to the General Manager, a poll shall be conducted in accordance with Chapter 190, Polling and Notification, to determine if the residents wish to have permit parking on their road or area, as the case may be. In the event of a positive polling result, the General Manager shall report such result to the appropriate community council, which community council under delegated authority, shall be authorized to pass any necessary by-laws to implement permit parking on the road or area. In the event of a negative result, permit parking shall not be extended to the road or area, and no further permit parking poll shall be conducted for a period of two years.

 

A poll regarding permit parking was conducted by the City Clerk's office on September 16, 2015 of the residents with residential premises having a residential address on Meadow Avenue or flanking Meadow Avenue between Victoria Park Avenue and Blantyre Avenue.

 

The minimum response rate of 25% contained in subsection 190-8A of Municipal Code Chapter 190, Polling and Notification, was not met. Further, the accepted ballots from respondents were divided equally between those responding in the affirmative and those responding in the negative.

 

This motion seeks an exemption from Subsection 925-4B of City of Toronto Municipal Code Chapter 925, Permit Parking, to allow Scarborough Community Council to consider a request to implement permit parking on Meadow Avenue, between Victoria Park Avenue and Blantyre Avenue.
