Speaker Nunziata advised that Council gratefully acknowledges it is meeting on the traditional territory of the Mississaugas of the New Credit First Nation and home to many diverse Aboriginal peoples.

City Council Decision

Various presentations, introductions and announcements were made to City Council on March 10, 2016.

 

Speaker Nunziata invited Councillor Mike Layton to come forward to speak about the Sustainable Communities Award from the Federation of Canadian Municipalities.  The City of Toronto has received the award for the Home Energy Loan Program and the High-rise Retrofit Improvement Support Program.  Councillor Layton advised that both City programs provide low interest rates for residents which are paid over time by installments on the tax bill.  Councillor Layton further advised that the programs benefit the City of Toronto by reducing energy use and emissions.  Councillor Layton introduced a YouTube video detailing both programs.

 

Councillor Paul Ainslie advised Council that he had represented City Council at the first annual induction ceremony for the Toronto Sport Hall of Honour which is located at the Toronto Pan Am Sports Centre in Scarborough.  Councillor Ainslie advised that the Hall of Honour is a legacy initiative of the City as part of the host city showcase program from the 2015 Pan Am and Parapan Games which recognizes and celebrates individuals and groups for their sports contributions and accomplishments.  Councillor Ainslie announced the inductees for this year and asked Members to join him in congratulating the following:

EY12.1 - Final Report - 144 and 150 Berry Road - Zoning By-law Amendment Application

City Council Decision

City Council on March 10, 2016, adopted the following:

 

1.  City Council amend the former City of Etobicoke Zoning Code, for the lands at 144 and 150 Berry Road substantially in accordance with the Draft Zoning By-law Amendment attached as Attachment 9 to the report (February 12, 2016) from the Director, Community Planning, Etobicoke York District.

 

2.  City Council amend City of Toronto Zoning By-law 569-2013, for the lands at 144 and 150 Berry Road substantially in accordance with the Draft Zoning By-law Amendment attached as Attachment 10 to the report (February 12, 2016) from the Director, Community Planning, Etobicoke York District.

 

3.  City Council authorize the City Solicitor to make such stylistic and technical changes to the Draft Zoning By-law Amendments as may be required.

 

4.  In the event City Council allows the proposal in whole or in part, before introducing the necessary Bills to City Council for enactment, the owner shall:

  

a.  submit a Traffic Impact Study (TIS) addendum to the City for review and acceptance by the General Manager, Transportation Services.  Such report shall determine whether the existing road network can support the proposed development and whether improvements to the existing road network are required;

           

b.  revise the Site Servicing Assessment and the Downstream Sanitary/Combined and Storm Sewer Analysis, prepared by Masongsong Associates Engineering Limited, to the satisfaction of the Executive Director, Engineering and Construction Services, and require the owner to pay for and construct any improvements to the municipal infrastructure should the Site Servicing Assessment and the Downstream Sanitary/Combined and Storm Sewer Analysis as accepted by the Executive Director, Engineering and Construction Services show that upgrades are required to support this development to the satisfaction of the Executive Director, Engineering and Construction Services; and

 

c.  make arrangements for the environmental remediation of the lands (for the conveyance of the 6 m watermain easement and the 9 m sewer easement) to the satisfaction of the Executive Director, Engineering and Construction Services.        

 

5.  Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an Agreement pursuant to Section 37 of the Planning Act, satisfactory to the Chief Planner and Executive Director, City Planning and the City Solicitor, such Agreement to be registered on title to the lands at 144 and 150 Berry Road, in a manner satisfactory to the City Solicitor to secure the following facilities, services and matters at the owner's expense:

 

a.          

i.  leased Premises for a not-for-profit food co-operative in the project having an area of no less than 810 m2 to be constructed and provided on the terms set out in Schedules 'C' and 'A' respectively of the Draft Zoning By-laws (see Attachment 9 and Attachment 10 to the report (February 12, 2016) from the Director, Community Planning, Etobicoke York District) and the Section 37 Term Sheet for Leased Premises (see Attachment 11 to the supplementary report (March 8, 2016) from the Chief Planner and Executive Director, City Planning), at the expense of the owner, or such alternate cash contribution as is described in the attached Draft Zoning By-laws and Section 37 Term Sheet for Leased Premises; and

 

ii.  a splash pad within the privately-owned publicly-accessible space to be provided on the terms set out in Schedules 'C' and 'A' respectively of the Draft Zoning By-laws (see Attachment 9 and Attachment 10 to the report (February 12, 2016) from the Director, Community Planning, Etobicoke York District).  The public access easement(s) are to be conveyed to the City for nominal consideration and are to be free and clear of all physical and title encumbrances.  The owner shall own, operate, maintain and repair the splash pad;

 

b.  require that the cash amounts identified in Schedules 'C' and 'A' respectively of the Draft Zoning By-laws (see Attachment 9 and Attachment 10 to the report (February 12, 2016) from the Director, Community Planning, Etobicoke York District) and the Section 37 Term Sheet for Leased Premises (see Attachment 11 to the supplementary report (March 8, 2016) from the Chief Planner and Executive Director, City Planning) be indexed upwardly in accordance with the Non-Residential Construction Price Index for the Toronto CMA, reported quarterly by Statistics Canada in Construction Price Statistics Publication No. 62-007-XPB, or its successor, calculated from the date of execution of the Section 37 Agreement to the date of expenditure of the sum by the owner; and

 

c.  the following matters are also recommended to be secured in the Section 37 Agreement as a legal convenience to support development:

 

i.  the owner shall provide, at its own expense, a minimum area of 3,600 m2 of privately-owned publicly-accessible space (POPS) and public access easements to and over the POPS for members of the public.  The public access easements are to be conveyed to the City for nominal consideration and are to be free and clear of all physical and title encumbrances.  The owner shall own, operate, maintain and repair the POPS.  The owner shall install and maintain a centralized sign, at its own expense, stating that members of the public shall be entitled to use the POPS from 6:00 a.m. to 12:01 a.m. 365 days of the year;

 

               ii.   the owner shall design and construct a 2.1 m wide municipal sidewalk along the north side of Berry Road; the west side of Stephen Drive and the east side of Bell Manor Drive, all to the satisfaction of the Executive Director, Engineering and Construction Services and the General Manager, Transportation Services and at no cost to the City;

 

iii.  the owner shall construct and maintain the development in accordance with the Tier 1 performance measures of the Toronto Green Standard, as adopted by City Council at its meeting of October 26 and 27, 2009;

 

iv.  the owner shall satisfy the requirements of the Toronto District School Board regarding warning clauses and signage with respect to school accommodation issues; and

 

v.  the owner shall construct improvements and upgrades to the municipal water and sewer infrastructure at no cost to the City, should the Functional Servicing Report that has been submitted to the satisfaction of the Director, Engineering and Construction Services determine that the improvements and upgrades are necessary to accommodate the proposed development.

City Council Decision

City Council on March 10, 2016, adopted the following:

 

1.  City Council amend the former Etobicoke Zoning Code, for the lands at 1030 and 1040 Islington Avenue substantially in accordance with the Draft Zoning By-law Amendment attached as Attachment 1 to the report (February 22, 2016) from the Director, Community Planning, Etobicoke York District.

 

2,  City Council amend City of Toronto Zoning By-law 569-2013, for the lands at 1030 and 1040 Islington Avenue substantially in accordance with the Draft Zoning By-law Amendment attached as Attachment 2 to the report (February 22, 2016) from the Director, Community Planning, Etobicoke York District.

 

3.  City Council authorize the City Solicitor to make such stylistic and technical changes to the Draft Zoning By-law Amendments as may be required.

 

4.  Prior to site plan approval, City Council require the owner to construct and implement noise abatement measures as described in the Environmental Noise Feasibility Study prepared by Valcoustics Canada Ltd. dated December 11, 2013 to the satisfaction of the Executive Director, Engineering and Construction Services.

 

5.  Before introducing the necessary Bills to City Council for enactment, City Council require the owner to enter into an Agreement pursuant to Section 37 of the Planning Act, satisfactory to the Chief Planner and Executive Director, City Planning, and the City Solicitor, such agreement to be registered on title to the lands at 1030 and 1040 Islington Avenue, in a manner satisfactory to the City Solicitor to secure the following matters at the owner's expense:

 

a.  an indexed cash contribution of $325,000.00 to be paid to the City prior to the earlier of site plan approval or issuance of the first above-grade building permits, to be allocated in Ward 5, Etobicoke-Lakeshore, generally as follows:

 

i.   $315,000.00 towards streetscape improvements along The Queensway between Islington Avenue and Royal York Road; and

 

ii.  $10,000.00 towards capital improvements to Fairfield Park.

 

The cash contribution identified above shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Construction Price Index for Toronto from the date of execution of the Section 37 Agreement to the date of payment, all to the satisfaction of the Chief Planner and Executive Director, City Planning.

 

In the event the cash contributions referred to above have not been used for the intended purposes within three (3) years of the by-law coming into full force and effect, the cash contributions may be redirected for another purpose, at the discretion of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor, provided that the purposes are identified in the Toronto Official Plan and will benefit the community in the vicinity of the lands; and

 

b.  the following matters are also recommended to be secured in the Section 37 Agreement as a legal convenience to support the development:

 

i.  the owner shall construct and maintain the development in accordance with Tier 1 performance measures of the Toronto Green Standard, as adopted by Toronto City Council at its meeting held on October 26 and 27, 2009 through the adoption of Item PG32.3 of the Planning and Growth Management Committee.

City Council on March 10, 2016, adopted the following:

 

1.  City Council direct the Executive Director, Municipal Licensing and Standards, in conjunction with the General Manager, Solid Waste Management, to work with the owner of 29 Church Street, to take the necessary action to ensure garbage collection on the site to be collected off of George Street where the current visitor’s parking lot is (across from 69 George Street) with the following modifications:

 

a.  a new waste enclosure along with a concrete pad will need to be built;

 

b.  trees would need to be trimmed in order to safely collect the bins;

 

c.  site has an underground parking garage and therefore an Engineer’s Letter would be required to ensure that the structure can safely support a fully loaded collection vehicle (35000 kg);

 

d.  the fence will need to be taken down for a truck to enter site;

 

e.  some parking spaces will need to be removed; and

 

f.  overhanging wires will need to be checked.

 

In the event a solution is not worked out with the owner of 29 Church Street, City Council direct the Executive Director, Municipal Licensing and Standards, in conjunction with the General Manager, Solid Waste Management Services, to report back with remaining options for garbage collection on this site.

1. City Council approve the application to demolish the 19 existing residential rental units located in four buildings at 31, 33, 35 and 37 Helendale Avenue pursuant to Municipal Code Chapters 667 and 363 subject to the following conditions under Chapter 667 which provide for the replacement of nineteen (19) rental housing units as well as one (1) additional rental unit for a total of twenty (20) rental replacement units, but with substantially the same housing mix, as outlined in the report (February 4, 2016) from the Director, Community Planning, North York District:

 

a. the owner shall provide and maintain twenty (20) residential rental units as shown on the rental floor plans dated December 10, 2015 on the lot with any changes to the satisfaction of the Chief Planner and Executive Director, City Planning;

 

b. the owner shall provide the units in Part a. above as rental housing for a period of at least 20 years, comprising 18 one-bedroom units and 2 three-bedroom units, of which at least 10 one-bedroom units shall have affordable rents, 9 units shall have rents no higher than mid-range rents and 1 one-bedroom unit shall have no rent limit;

 

c. the owner shall enter into and register one or more Section 111 Agreement(s) to secure the conditions outlined in the report (February 4, 2016) from the Director Community Planning, North York District to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning; and

 

d. the owner shall enter into and register a Section 118 Restriction under the Land Titles Act (to the satisfaction of the City Solicitor) agreeing not to transfer or charge those parts of the lands, comprising the 20 replacement rental units, without the written consent of the Chief Planner and Executive Director, City Planning or designate, to assist with securing the Section 111 Agreement against future owners and encumbrances of the lands to be released only upon the owner obtaining the necessary approvals including the zoning by-law amendment.

 

2. City Council authorize the Chief Planner and Executive Director, City Planning to issue the Preliminary Approval of the Section 111 permit to the application under Municipal Code Chapter 667 after the latest of the following has occurred:

 

a. satisfaction or securing of the conditions in Part 1 above;

 

b. after the Zoning By-law amendment approved by the Ontario Municipal Board have come into full force and effect;

 

c. after the execution and registration of a Section 37 Agreement pursuant to the Planning Act securing Parts 1a to 1d above, and any other requirements of the Zoning-Bylaw amendment;

 

d. the issuance of the Notice of Approval Conditions for site plan approval by the Chief Planner and Executive Director, City Planning or designate, pursuant to Section 114 of the City of Toronto Act, 2006; and

 

e. the issuance of excavation and shoring permits for the approved structures on the site.

 

3. City Council authorize the Chief Building Official and Executive Director, Toronto Building to issue a Section 111 permit under Municipal Code Chapter 667 after the Chief Planner and Executive Director, City Planning has given the preliminary approval referred to in Part 2 above.

 

4. City Council authorize the Chief Building Official and Executive Director, Toronto Building to issue a permit under Section 33 of the Planning Act no earlier than issuance of the first building permit for excavation and shoring of the development, and after the Chief Planner and Executive Director, City Planning has given the preliminary approval referred to in Part 2 above, which permit may be included in the demolition permit for Chapter 667 under 363-11.1, of the Municipal Code, on condition that:

 

a. the owner erect a residential building on site no later than four (4) years from the day demolition of the buildings is commenced; and

 

b. should the owner fail to complete the new building within the time specified in condition 4a. above the City Clerk shall be entitled to enter on the collector’s roll, to be collected in a like manner as municipal taxes, the sum of twenty thousand dollars ($20,000.00) for each dwelling unit for which a demolition permit is issued, and that each sum shall, until payment, be a lien or charge upon the land for which the demolition permit is issued.

 

5. City Council authorize the appropriate City officials to take such actions as are necessary to implement the Council's decision, including execution of the Section 111 Agreements.

d.  consider securing in the Site Plan Agreement the applicant’s best efforts to secure and maintain 33 parking spaces at an off-site location to provide for overflow parking.

 

6.  City Council direct the General Manager, Transportation Services, in consultation with the local Councillor and area residents, to review parking and traffic operations on The Bridle Path between Bayview Avenue and Timberglade Court, with consideration to prohibiting parking on The Bridle Path, following the commencement of operation of the place of worship at 2437 Bayview Avenue, and recommend any modifications as necessary.

 

7.  City Council direct the General Manager, Transportation Services to work with the applicant to address traffic and congestion on Bayview Avenue and parking-related issues, and recommend any modifications as required.

City Council Decision

City Council on March 10, 2016, adopted the following:

 

1. City Council amend the Official Plan and Sheppard East Subway Corridor Secondary Plan for the lands at 1-35, 45-69, 6-66 Adra Villaway and 1-25, 2-24, 30-44, 37-53 Grado Villaway and 1-29, 2-28 Tomar Villaway substantially in accordance with the draft Official Plan Amendment 341 attached as Attachment 29 to the report (February 4, 2016) from the Director, Community Planning, North York District, with Attachment 29 amended as follows:

 

a.  the third paragraph of section 3, subsection 4.2.6.2 by, replacing "On" in the first line with: "Subject to Section 3.2.1.7 of the Official Plan, on",  and by adding after "lot" in the last line: " provided amongst other matters, an agreement pursuant to Section 37 of the Planning Act, to the satisfaction of the City shall be entered into and registered on title to the lands which shall include amongst other matters, a requirement that the owner of the lands provide and maintain replacement social housing dwelling units, all of which have rents geared to income".

 

2. City Council amend former City of North York Zoning By-law No. 7625 for the lands at 1-35, 45-69, 6-66 Adra Villaway and 1-25, 2-24, 30-44, 37-53 Grado Villaway and 1-29, 2-28 Tomar Villaway substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District.

 

3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Official Plan Amendment and draft Zoning By-law Amendment as may be required.

 

4. Before introducing the necessary Bills to City Council for enactment, require the Owner to:

 

a. enter into an Agreement pursuant to Section 37 of the Planning Act, to be registered on title, to the satisfaction of the City Solicitor, to secure the following:

 

i. prior to the issuance of the first above-grade building permit for any building on the Apartment Neighbourhood portion of the site, the owner shall pay to the City the sum of $1,100,000 to be allocated towards capital improvements in the vicinity of the development site and towards on-site public art, as follows:

 

a. improvements to the East Don River Trail system in the vicinity of the site including the removal of the existing stairs that connect the site to the existing trail system and the construction of new stairs that align with the proposed pedestrian walkway from the courtyard of the condominium;

 

b. streetscape improvements along the west side of Leslie Street between the development site and Sheppard Avenue East which include improvements to the existing pedestrian/cycling entrances to the East Don River Trail system, such streetscape improvements may also include removal of the existing guard rail on the Leslie Street public boulevard;

 

c. an on-site public art installation through Arts Starts, a non-profit community-building group within the Villaways; and

 

d. $200,000 of the contribution to be directed towards eligible on-site improvements to be identified through a participatory budgeting process with the Ward Councillor.

 

The allocation of the remaining $900,000 shall be determined in consultation with the Ward Councillor and appropriate City Divisions and external agencies and to the satisfaction of the Director, Community Planning, North York District.

 

The financial contribution shall be indexed in accordance with the Statistics Canada Non-Residential Building Construction Price Index for Toronto calculated from the date of execution of the Section 37 Agreement to the date of submission of the funds by the Owner to the City.

 

5. The following matters are also recommended to be secured in the Section 37 Agreement in support of the development:

 

a. the gross floor area of the indoor private recreational amenity area for the condominium building is exempted from the calculation of gross floor area;

 

b. prior to the issuance of the first building permit for the site, the Owner shall convey approximately 3,174m2 of land (Block E on the Draft Plan of Subdivision), at nominal cost, to the Toronto and Region Conservation Authority to the satisfaction of the City Solicitor and Toronto and Region Conservation Authority;

 

c. the Owner shall construct and maintain the development in accordance with Tier 1 performance measures of the Toronto Green Standard, as adopted by City Council at its meeting held on October 26 and 27, 2009 through the adoption of Item PG32.3 of the Planning and Growth Management Committee;

 

d. the provision and maintenance, including the conveyance to the City of a public easement and rights of support, at nominal cost of a Privately Owned Public Open Space (POPS) on the southern portion of the lands having a minimum area of 707m2 and designed to include a playground facility to be completed, ready for use and such conveyance to be completed, all to the satisfaction of the Chief Planner and Executive Director, City Planning and the City Solicitor;

 

e. the Owner shall provide and maintain one hundred and fifteen (115) replacement social housing units on the 1-35, 45-69, 6-66 Adra Villaway and 1-25, 2-24, 30-44, 37-53 Grado Villaway and 1-29, 2-28 Tomar Villaway site for a period of at least 25 years, all of which will have rents geared to income, comprising the following:

iii. with all detailed floor plans to the satisfaction of the Chief Planner and Executive Director, City Planning;

 

f. the Owner shall provide and maintain six (6) replacement social housing units on the 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road site for a period of at least 25 years, all of which will have rents geared to income, comprising the following:

The social housing units shall be provided in accordance with more detailed terms as set forth in the draft zoning by-law attached as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District, and also as set out below:

 

i. prior to any residential use of the market building approved for development, subject of the draft zoning by-law as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District, 115 social housing replacement units shall be completed and ready for occupancy; and

 

ii. prior to any residential use of "Building D" approved for development at 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road as referenced in By-law 615-2013 the remaining 6 social housing replacement units on the 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road site shall be completed and ready for occupancy; and

 

g. the Owner shall provide tenant relocation assistance for tenants in the existing buildings in accordance with the detailed terms set forth in the draft zoning by-law attached as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District; and

 

h. the Owner shall prepare a Construction Mitigation and Tenant Communication Strategy, prior to the issuance of the first building permit in each phase of the construction, to the satisfaction of the Chief Planner and Executive Director, City Planning.

 

6. City Council approve the application to demolish the 121 existing residential units located at 1-35, 45-69, 6-66 Adra Villaway and 1-25, 2-24, 30-44, 37-53 Grado Villaway and 1-29, 2-28 Tomar Villaway pursuant to Municipal Code Chapters 667 and 363 subject to the following conditions under Chapter 667 which provide for the replacement of rental housing:

 

a. the Owner shall provide and maintain one hundred and fifteen (115) replacement social housing units on the on the 1-35, 45-69, 6-66 Adra Villaway and 1-25, 2-24, 30-44, 37-53 Grado Villaway and 1-29, 2-28 Tomar Villaway site for a period of at least 25 years, all of which will have rents geared to income, comprising the following:

ii. where a 4-Bedroom replacement social housing unit shall not comprise less than 96.6 square metres, with all 4-Bedroom units having an average of 110 square metres; and

 

iii.with all detailed floor plans to the satisfaction of the Chief Planner and Executive Director, City Planning;

 

b. the Owner shall provide and maintain six (6) replacement social housing units on the 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road site for a period of at least 25 years, all of which will have rents geared to income, comprising the following:

c. the Owner shall provide tenant relocation assistance including the right for eligible tenants to return to a replacement social housing unit to the satisfaction of the Chief Planner and Executive Director, City Planning and the General Manager, Shelter Support and Housing Administration, and as further detailed in the draft by-law attached as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District;

 

d. the Owner shall enter into and register one or more Section 111 Agreement(s) to secure the conditions outlined in Parts 6.a., 6.b., and 6.c. above, and as described in the draft zoning by-law amendment (Attachment 30 to the report dated February 4, 2016, from the Director Community Planning, North York District) to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning; and

 

e. the Owner shall enter into and register, a Section 118 Restriction under the Land Titles Act (to the satisfaction of the City Solicitor) agreeing not to transfer or charge those parts of the lands, comprising the 115 replacement social housing units, without the written consent of the Chief Planner and Executive Director, City Planning or designate, to assist with securing the Section 111 Agreement against future Owners and encumbrances of the lands.

 

f.  the Owner shall provide and maintain six (6) replacement social housing units on the 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road site for a period of at least 25 years, all of which will have rents geared to income, comprising the following:

The social housing units shall be provided in accordance with more detailed terms as set forth in the draft zoning by-law attached as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District, and also as set out below:

 

i. prior to any residential use of the market building approved for development, subject of the draft zoning by-law as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District, 115 social housing replacement units shall be completed and ready for occupancy; and

 

ii. prior to any residential use of "Building D" approved for development at 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road as referenced in By-law 615-2013 the remaining 6 social housing replacement units on the 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road site shall be completed and ready for occupancy.

 

7. City Council authorize the City Solicitor to amend the Section 37, Section 118 and  Section 111 Agreements at 3, 5, 11, 17, 21 Allenbury Gardens and 3, 5 Kingslake Road to secure the matters in Part 6.b. above.

           

8. City Council authorize the Chief Planner and Executive Director, City Planning to issue preliminary approval to the application under Municipal Code Chapter 667 for any of the existing rental housing buildings in any specific phase of the development after the latest of the following has occurred:

 

a. the satisfaction of the conditions in Part 6 above;

 

b. the Official Plan and Zoning By-law Amendments in Parts 1 and 2 above have come into full force and effect; and

 

c.  the Owner has obtained site plan approval satisfactory to the Chief Planner and Executive Director, City Planning, for the development agreed to by City Council in this decision at 1-35, 45-69, 6-66 Adra Villaway and 1-25, 2-24, 30-44, 37-53 Grado Villaway and 1-29, 2-28 Tomar Villaway, subject of the draft zoning by-law as Attachment 30 to the report (February 4, 2016) from the Director, Community Planning, North York District.

 

9. City Council authorize the Chief Building Official and Executive Director, Toronto Building to issue a Section 111 permit under Municipal Code Chapter 667 after the Chief Planner and Executive Director, City Planning, has issued the preliminary approval in Part 8 above for any of the existing social housing buildings in any specific phase of the development.

 

10. City Council authorize the Chief Building Official and Executive Director, Toronto Building to issue a permit under Section 33 of the Planning Act no earlier than issuance of the first building permit for the foundation of the development, and after the Chief Planner and Executive Director, City Planning has given the preliminary approval in Part 8 above which permit may be included in the demolition permit for Chapter 667 under 363-11.1E, of the Municipal Code, on condition that:

 

a. the Owner erect a residential building on site no later than three (3) years from the day demolition of the buildings is commenced; and

 

b. should the Owner fail to complete the new building within the time specified in condition 10a. above, the City Clerk shall be entitled to enter on the collector's roll, to be collected in a like manner as municipal taxes, the sum of $20,000 for each dwelling unit for which a demolition permit is issued, and that such sum shall, until payment, be a lien or charge upon the land for which the demolition permit is issued.

 

11. City Council request the Executive Director, Social Development, Finance and Administration, to co-ordinate the corporate actions required for the Revitalization of 1-35, 45-69, 6-66 Adra Villaway and 1-25, 2-24, 30-44, 37-53 Grado Villaway and 1-29, 2-28 Tomar Villaway, in conjunction with appropriate City Divisions and the Toronto Community Housing Corporation.

 

12. City Council authorize the appropriate City officials to take such actions as are necessary to implement the Council's decision, including execution of the Section 37 and Section 111 Agreements.

 

13. In accordance with the delegated approval under By-law 229-2000, as amended, City Council be advised that the Chief Planner and Executive Director, City Planning intends to approve the draft plan of subdivision as generally illustrated on Attachment 3 to the report (February 4, 2016) from the Director, Community Planning, North York District, subject to:

 

a. the conditions as generally listed in Attachment 31 to the report (February 4, 2016) from the Director, Community Planning, North York District, which except as otherwise noted must be fulfilled prior final approval and the release of the plan of subdivision for registration; and

 

b. any such revisions to the proposed subdivision plan or any such additional modified conditions as the Chief Planner and Executive Director, City Planning may deem to be appropriate to address matters arising from the on-going technical review of this development.

 

14.  City Council request the Director, Affordable Housing Office to work with Toronto Community Housing Corporation staff to provide up to seven home ownership assistance loans to eligible Toronto Community Housing Corporation residents in the market building as part of the Leslie Nymark re-development.

City Council on March 10, 2016, adopted the following:

 

1.  City Council amend former City of Toronto Zoning By-law 438-86 for the lands at 40 to 60 McCaul Street and 10 Stephanie Street, substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 9 to the report (February 2, 2016) from the Director, Community Planning, Toronto and East York District.

 

2.  City Council amend City of Toronto Zoning By-law 569-2013 for the lands at 40 to 60 McCaul Street and 10 Stephanie Street, substantially in accordance with the draft Zoning By-law Amendment attached as Attachment 10 to the report (February 2, 2016) from the Director, Community Planning, Toronto and East York District.
 

3.  City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required.

 

4.  Before introducing the necessary Bills to City Council for enactment, City Council require the owner(s) to provide clarification and documentation with respect to the nature of the easements/rights-of-way set out in Instrument Nos. EP107976, CA750356 and CA779430, Instrument No. CA779428 (north-south right of way) and Instrument Nos. EP107976, CA779430, CA779431, and CA779428 (east-west right of way) and whether these easements/rights-of-way will have to be amended, or will still be required, as a result of the proposed redevelopment to the satisfaction of the Executive Director, Engineering and Construction Services.

 

5.  Before introducing the necessary Bills to City Council for enactment, City Council require the owner(s) to provide revised plans indicating a notation to convey and register to the City, at nominal cost, a non-exclusive easement in perpetuity in favour of the City, for use by the City and general public of a 5.0 metre corner rounding at McCaul Street and Stephanie Street at the south east limit of the property, and a 5.0 metre corner rounding required at McCaul Street and Grange Road at the north-east limit of the property, as identified as Area C on Attachment 8 to the report (February 2, 2016) from the Director, Community Planning, Toronto and East York Community Council, to the satisfaction of the Executive Director, Engineering and Construction Services.

 

6.  Before introducing the necessary Bills to City Council for enactment:

 

a.  City Staff obtain any required authorities and approvals in compliance with the City's real estate disposal process set out in Chapter 213 of the City of Toronto Municipal Code, to sell the east-west strip of City-owned land fronting McCaul Street, approximately 4.3 metres in width, to become part of the proposed development site, and complete such sale; and

 

b.  City Council authorize the Chief Corporate Officer and the Director, Real Estate Services to execute the documents required to implement the disposal and sale of the City-owned lands forming part of the proposed development site, including the execution of any required consents, approvals or permissions.

 

7.  Before introducing the necessary Bills to City Council for enactment, City Council require the owner(s) to enter into an Agreement pursuant to Section 37 of the Planning Act satisfactory to the City Solicitor to secure the following:

 

a.  Prior to issuance of an above grade building permit (other than a building permit for a temporary sales office/pavilion) the owner shall provide a financial contribution to the City to be used for community benefits in the amount of $1,000,000 to be used towards the following, all to the satisfaction of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor:

 

i.  a cash contribution of $600,000 towards community services, facilities, parkland acquisition and/or parkland improvements in the Grange Community to the satisfaction of the Chief Planner and Executive Director, City Planning and the General Manager, Parks, Forestry and Recreation in consultation with the Ward Councillor;

 

ii.  a cash contribution of $200,000 towards landscaping improvements in the public realm on McCaul Street and in the Grange Community, to the satisfaction of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor and the Grange Community Association;

 

iii.  a cash contribution of $100,000 for the provision of new affordable housing in Ward 20; and

 

iv.  a cash contribution of $100,000 for capital repairs to existing Toronto Community Housing buildings in Ward 20,

 

with such amount to be indexed upwardly in accordance with the Statistics Canada Construction Price Index for Toronto, calculated from the date of execution of the Section 37 Agreement to the date the payment is made.

 

b.  Prior to the issuance of any building permit (other than building permit for a temporary sales office/pavilion) the owner shall:

 

i.  convey and register, for nominal consideration, a non-exclusive easement in perpetuity in favour of the City, for use by the City, University Settlement House and the general public for a pedestrian thoroughfare, as identified as Area B on Attachment 8 to the report (February 2, 2016) from the Director, Community Planning, Toronto and East York District. The pedestrian thoroughfare will be to the satisfaction of the City Solicitor in consultation with the Chief Planner and Executive Director, City Planning, with the specific location, configuration and design to be determined to the satisfaction of the Chief Planner and Executive Director, City Planning, as part of the site plan approval process for all or any part of the site.  The maintenance of this pedestrian thoroughfare is to be the responsibility of the owner; and

 

ii.  convey and register, for nominal consideration, a non-exclusive easement in perpetuity in favour of the City, for use by the general public as publicly-accessible, privately-owned, open space at the south end of the site with a minimum area of 195 square metres, as identified as Area A on Attachment 8 to the report (February 2, 2016) from the Director, Community Planning, Toronto and East York District, to the satisfaction of the City Solicitor in consultation with the Chief Planner and Executive Director, City Planning.  The specific configuration and design to be determined to the satisfaction of the Chief Planner and Executive Director, City Planning, as part of site plan approval, and to come into effect on the first residential or non-residential occupancy.  The maintenance of this publicly-accessible, privately-owned, open space is to be the responsibility of the owner.

 

c.  The owner shall be financially responsible for all costs associated with the excavation, improvement, removal and/or relocation of any above or below-grade public or private utility resulting from the development of this property.

 

d.  Prior to the issuance of the first building permit, the owner will submit a Construction Management Plan, to the satisfaction of the Chief Planner and Executive Director, City Planning, the General Manager, Transportation Services, and the Chief Building Official and Executive Director, Toronto Building, in consultation with the Ward Councillor and thereafter in support of the development, will implement the plan during the course of construction.  The Construction Management Plan will include, but not limited to, details regarding size and location of construction staging areas, dates and significant concrete pouring activities, measures to ensure safety lighting does not negatively impact adjacent residences, construction vehicle parking locations, refuse storage, site security, site supervisor contact information, continued access to the emergency exit and daycare at University Settlement House, continued access to parking at St. George the Martyr Anglican Church, the impact of construction on the heritage building at St. George the Martyr Anglican Church, and any other matters deemed necessary.

 

e.  In the event the cash contribution(s) has not been used for the intended purpose within three (3) years of this By-law coming into full force and effect, the cash contribution may be redirected for another purpose, at the discretion of the Chief Planner and Executive Director, City Planning, in consultation with the local Councillor, provided that the purposes are identified in the Toronto Official Plan and will benefit the community in the vicinity of the lands.

 

f.  The owner agrees to install an interim landscape/plaza on the north portion of the site if construction of the proposed private art gallery does not commence within one year of completion of the mixed use building. Design of the interim landscape shall be to the satisfaction of the Chief Planner and Executive Director, City Planning, in consultation with the Ward Councillor and the local residents' association, and be secured through the site plan agreement, including construction securities.

  

8.  City Council require the applicant to provide and install public art, including mural artwork, onto every elevation of the hoarding board with adequate spotlighting for night-time illumination, at their sole cost, to the satisfaction of the Ward Councillor.

 

9.  City Council require the applicant to agree to make all reasonable efforts to work with the Church of St. George-the-Martyr to enter into appropriate agreements, regarding access to the Church parking lot, lighting of the east-facing stained glass windows, and construction management and potential damage to the Church, among other matters, prior to submission of the Bills to the May 3, 2016 meeting of City Council.

 

10.  City Council require that the parking provisions in the draft by-law be amended to reflect the owner's proposal to provide a minimum of 96 parking spaces, consisting of 85 residential spaces and 11 visitor spaces.

City Council Decision Advice and Other Information

During the review of the Order Paper on March 10, 2016, Speaker Nunziata ruled that Toronto and East York Community Council Recommendation 8 in this Item was not properly before City Council as this recommendation is a delegated traffic matter that must be decided by the Toronto and East York Community Council and not by City Council. Speaker Nunziata advised Members that the following Recommendation 8 will be resubmitted to the Toronto and East York Community Council:

 

8. City Council rescind the "one-way" designation for Stephanie Street, between the McCaul Street and the site driveway (a point 27 metres west of McCaul Street) and introduce "No Standing" regulations on the north and south side of Stephanie Street, from McCaul Street and a point 27 metres further west, and that all costs associated with implementing the change will be borne by the applicant, secure through the Site Plan approval process.

City Council Decision

City Council on March 10, 2016, adopted the following:

 

1.  City Council approve the application to demolish the two 3-bedroom residential rental units located at 86 and  88 Soudan Avenue pursuant to Municipal Code Chapters 667 and 363 pursuant to Section 111 of the City of Toronto Act and Section 33 of the Planning Act respectively, subject to the following conditions:

 

a.  the owner shall provide and maintain 324 existing dwelling units on the site as rental housing for the period of at least 20 years, from the date of the Zoning By-Law being in force and effect, with all the associated facilities and amenities of the buildings to be secured for the rental housing units;

 

b.  the owner shall provide tenant relocation assistance including an extended notice period, and financial assistance beyond the minimums of the Residential Tenancies Act in the amount of a $500 moving allowance to any tenant of a "dwelling room" within the residential rental unit on the date that the Notice of Termination is given, to the satisfaction of the Chief Planner and Executive Director, City Planning; and/or

 

c.  the owner shall provide tenant relocation assistance including, an extended notice period, and financial assistance beyond the minimums of the Residential Tenancies Act, in the amount of $2,100 to any tenant household who is resident of the rental housing unit on the date that the Notice of Termination is given, to the satisfaction of the Chief Planner and Executive Director, City Planning;

 

d.  the owner shall provide a Tenant Assistance Package, including rent abatement measures, and eligibility for early termination of leases, to the satisfaction of the Chief Planner, Executive Director, City Planning;
 

e.  the owner shall provide a Construction Mitigation Plan, including and not limited to, two respite rooms, and noise cancelling headphones for each unit for the residents of 33 Holly Street and 44 Dunfield Avenue, to the satisfaction of the Chief Planner, Executive Director, City Planning;

 

f.  the owner shall provide a Tenant Communication Plan to the satisfaction of the Chief Planner, Executive Director, City Planning;

 

g.  the owner shall enter into and register one or more Section 111 Agreement(s) to secure the conditions outlined in Parts 1.a, b, c, d, e and f above and as described in the Zoning By-law Amendment, and Section 37 Agreement, substantially in accordance with the confidential attachment to the report (January 28, 2016) from the City Solicitor, titled "33 Holly Street, 44 Dunfield Avenue, 86 and 88 Soudan Avenue - Zoning Amendment Application - Request for Directions Report" (Item CC12.9), to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning; and

 

h.  the owner shall enter into and register, a Section 118 Restriction under the Land Titles Act (to the satisfaction of the City Solicitor) agreeing not to transfer or charge those parts of the lands, comprising the single family rental dwelling units at 86 and 88 Soudan, without the written consent of the Chief Planner and Executive Director, City Planning or designate, to assist with securing the Section 111 Agreement against future owners and encumbrances of the lands until such time as the City Solicitor determines that its registration on title is no longer required to secure the provisions of the Section 111 Agreement.

 

2.  City Council authorize the Chief Planner and Executive Director, City Planning to issue preliminary approval to the application under Municipal Code Chapter 667 after the following has occurred:

 

a.  satisfaction or securing of the conditions in Part 1 above;

 

b.  the Zoning By-law amendment is approved in principle by the Ontario Municipal Board;

 

c.  after the execution and registration of a Section 37 Agreement pursuant to the Planning Act securing the conditions in Parts 1.a. to h. above and any other required conditions of the Zoning By-law Amendment; and

 

d.  the issuance of the Notice Of Approval Conditions for site plan approval by the Chief Planner and Executive Director, City Planning or designate, pursuant to Section 114 of the City of Toronto Act, 2006.

 

3.  City Council authorize the Chief Building Official and Executive Director, Toronto Building to issue a Section 111 permit under Municipal Code Chapter 667 after the Chief Planner and Executive Director, City Planning has given the preliminary approval referred to in Part 2 above, and no earlier than the issuance of the first building permit.

 

4.  City Council authorize the appropriate City Officials to take such actions as are necessary to implement the foregoing, including execution of the Section 111 Agreements.

City Council on March 10, 2016, adopted the following:

 

1.  City Council approve the alterations to the heritage property at 160 Gerrard Street East, in accordance with Section 33 of the Ontario Heritage Act, to allow for the replacement of the existing link building between the Palm House and the Boiler House with construction of a new glazed vestibule, the construction of new washrooms in the existing Administrative Building, and the construction of a new glazed addition at the southeast corner of the Administrative Building, with such alterations substantially in accordance with the Heritage Impact Assessment (HIA), prepared by Baird Sampson Neuert Architects Inc., dated December 2015, and on file with the Senior Manager, Heritage Preservation Services; and plans and drawings dated January 21, 2015, prepared by Baird Sampson Neuert Architects Inc., and on file with the Senior Manager, Heritage Preservation Services, subject to the following condition:

 

a.  That prior to the issuance of any permit for all or any part of the alterations as set out in the report (January 7, 2016) from the Chief Planner and Executive Director, City Planning, for the alterations to the designated heritage property at 160 Gerrard Street East, including a heritage permit or a building permit, but excluding permits for repairs and maintenance and usual and minor works as are acceptable to the Senior Manager, Heritage Preservation Services:

 

i.  Provide full building permit drawings including a landscape plan with notes and specifications for the conservation, stabilization and protective measures substantially in accordance with the Heritage Impact Assessment (HIA), prepared by Baird Sampson Neuert Architects Inc., dated December 2015, and on file with the Senior Manager, Heritage Preservation Services; and plans and drawings dated January 21, 2015, prepared by Baird Sampson Neuert Architects Inc., and on file with the Senior Manager, Heritage Preservation Services, including a description of materials and finishes, to be prepared by the project architect and heritage consultant to the satisfaction of the Senior Manager, Heritage Preservation Services.

10.  City Council direct the applicant, in consultation with Transportation Services, to maintain any bike lanes, and install appropriate signage to inform drivers and cyclists of any changes to the cycling lanes.
 

11.  In areas where no cycling lanes exist, City Council direct the applicant, in consultation with Transportation Services, to install sharrow markings onto the roadway and display appropriate signage on the hoarding board to inform motorists and cyclist to safely share the road.
 

12.  City Council direct the applicant to ensure that the existing sidewalks or the proposed pedestrian walkway have proper lighting to ensure safety and visibility at all times of the day and night.
 

13.  City Council direct the applicant to clearly consult and communicate all construction, parking and road occupancy impacts with local business improvement areas and resident associations in advance of any physical road modifications.
 

14.  City Council direct the applicant to install appropriate signage and converging mirrors to ensure that pedestrians, cyclists and motorists safety is considered at all times.
