North York Community Council:

 

1. Granted the application for a fence exemption permit for the property at 2100 Avenue Road subject to the following conditions:

 

a. that the owner maintain a minimum of 0.5m setback between the fence and the south edge of the sidewalk adjacent to the travelled portion of Carmichael Avenue;

 

b. that the owner reduce the height of the fence to less than 0.9m on the City Right-of-Way adjacent to the travelled portion of Carmichael Avenue;

 

c. that the owner reduce the height to under .9m for the first 2.4m in length of the fence on private property, (measured southerly, from the 2100 Avenue Road north property line);

 

d. that the applicant cut down the height of the fence from 1.9m to 0.9m within the public right of way, in addition the first 4 metres of hedges shall be reduced to 0.9 metres on the east side of the driveway, and the applicant be authorized to enter into an encroachment agreement for the hedges to be maintained at 2.0m in height with Transportation Services of the City of Toronto, according to the following conditions:

 

i. the property owner will enter into an encroachment agreement with the City of Toronto, at the applicant's expense, and assume all liability and damages related to the encroachments;

 

ii. the property owner must retain, as long as the encroachments are maintained, valid property insurance in case there are any claims initiated due to the encroachments; and

 

iii. the property owner accepts that the City and/or utility companies may remove the encroachments in order to install or maintain services within the affected public right of way.

The purpose of this report is to advise Community Council concerning an application by the property owner's solicitor concerning 2100 Avenue Road for a site-specific Fence Exemption, pursuant to Section 447-5.C of Toronto Municipal Code, Chapter 447- Fences.  The property owner is seeking Community Council's permission to maintain the rear yard wooden fences, particularly abutting # 1 Carmichael Avenue that violates the regulations stipulated in City of Toronto Municipal Code, Chapter 447.

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately-owned tree located at 11 Brooke Avenue. The application indicates the reasons for removal are due to concerns over injury that was sustained due to falling walnuts, staining of the patio deck and outdoor furniture, the resulting restricted use of the patio deck and backyard, and heaving of stones around the base of the tree.

 

The subject tree is a black walnut (Juglans nigra) tree measuring 61 cm in diameter. Urban Forestry does not support removal of the tree as it is healthy and maintainable.

Summary

On February 4, 2016, a request was made to rename the park located at 99 Caribou Avenue to honour Phil Givens.

 

Property naming and renaming are a matter for which a Community Council has delegated authority from City Council to make a final decision.

 

The Parks, Forestry and Recreation Division has reviewed this renaming proposal and acknowledges the significant contributions of Phil Givens to the Caribou Park neighbourhood and the City of Toronto.  As part of its due diligence, Parks, Forestry and Recreation reviewed the Council approved City of Toronto Property Naming Policy and found that this naming proposal meets the policy criteria and process.

The Parks, Forestry and Recreation Division initiated a naming process outlined in the Council-approved City of Toronto Property Naming Policy in consultation with the local Councillor, including the creation of a list of potential names and community consultation on the options.

Summary

This application is to amend former City of North York Zoning By-law 7625 and City of Toronto Zoning By-law 560-2013 to permit the infill addition of 260 new apartment units in a stacked townhouse form, 3 and 4 storeys in height, on underutilized space on an existing apartment building site.  The proposed new gross floor area for the site would be 27,756 m2.  The three existing 18 storey rental apartment buildings with 409 rental units would be maintained.  The overall total gross floor area of the existing and proposed development would be 77,004 m2 resulting in a density of 2.47 FSI with a total of 669 dwelling units.  A total of 775 parking spaces would serve the entire site with access provided from York Mills Road and Farmstead Road.

 

The proposed development is appropriate as it provides for sensitive and compatible infill development on a site containing existing apartment buildings with sufficient underutilized space to accommodate development.  In addition, the proposal provides for new and consolidates existing amenity space, screens garbage and loading areas, introduces pedestrian mews, and provides for a more efficient internal driveway network eliminating multiple access points along Farmstead Road. 

 

This report reviews and recommends approval of the application to amend the Zoning By-law.

2. Should the Ontario Municipal Board (OMB) approve the applications, City Council authorize the City Solicitor to request that the OMB withholds its Order(s) approving the application until such time as the Board has been advised by the City Solicitor that:

 

a. the proposed zoning by-law amendment is in a form satisfactory to the City;

 

b. the applicant has submitted an application for Site Plan Control for the townhouse portion of the proposed development and all pre-approval conditions have been met; and

North York Community Council:

 

1. Deleted Part 1 of the decision on Item NY12.23, and adopted instead, the following:

 

"1. Authorize a parking prohibition in effect from 7:00 a.m. to 6:30 p.m., on both sides of Sunnydene Crescent, between a point 65 metres west of Bayview Avenue and the remainder of the road further west."

Summary

At a North York Community Council meeting earlier this year, we approved a Stopping Prohibition for Sunnydene Crescent.

 

Unfortunately, the community support for this change was based on a miscommunication of the parking allowances under No Stopping. As a result, the neighbourhood is requesting the prohibition be returned to No Parking.

 

Traffic Operations have also been consulted and are in favour of the changes.

Community Council Decision

North York Community Council directed that:

 

1. City Planning staff schedule a community consultation meeting for the lands at 1325 Lawrence Avenue East and 30 Railside Road.
 

2. City Planning staff give notice for the community consultation meeting to landowners, residents and tenants within the area bounded by the Don Valley Parkway to the west, the Canadian Pacific Railway line to the south and east, and the properties on the north side of Cassandra Boulevard to the north.
 

3. City Planning staff contact the local Member of Parliament for the purposes of obtaining the date and time that the local Member of Parliament can attend the community consultation meeting and invite her to attend.

Summary

Dare to Dream Aviation Two LP submitted an application to Transport Canada for the Issuance of a Heliport Certificate for 1325 Lawrence Avenue East and 30 Railside Road. This location is only 140 metres away from a residential neighbourhood, at the rear parking lot of a commercial building that is also the home of a Tesla car dealership. Section CAR 305.08(1)(d) of the Canadian Aviation Regulations requires the applicant to, among other items, provide proof to the Minister of Transport that the applicant has consulted with the local government authority relating to the proposed heliport and adjacent land in accordance with the requirements of the applicable heliport standard.

 

At its meeting of January 19, 2016, North York Community Council adopted, with amendments, the recommendations in a report from the Director of Community Planning, North York District, dated January 19, 2016. These recommendations included requests for further information from the applicant, upon receipt of which, staff would arrange a community consultation meeting with area landowners, residents, and tenants. The requested information was not provided. The City of Toronto has since been advised by Transport Canada that the Heliport Certificate has been issued.

 

In reviewing the potential impacts of this helipad, the property's current zoning may be affected, including by what City Staff estimate is the removal of approximately 86 parking spaces out of the 205 spaces required on site to accommodate existing uses. Despite not receiving the requested materials and not carrying out a public consultation suitable to the City's standards, it would be beneficial to advise the local community of the approved heliport.
