Etobicoke York Community Council recommends that:

 

1.  City Council amend the former City of Etobicoke Zoning Code for the lands at 325 Horner Avenue substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 1 to the Supplementary Report of the Director, Community Planning, Etobicoke York District dated May 9, 2016.

 

2.  City Council amend City of Toronto Zoning By-law No. 569-2013, for the lands at 325 Horner Avenue substantially in accordance with the draft Zoning By-law Amendment attached as Attachment No. 2 to the Supplementary Report of the Director, Community Planning, Etobicoke York District dated May 9, 2016.

 

3. City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required.

Summary

This application proposes to amend the former City of Etobicoke Zoning Code and City of Toronto Zoning By-law No. 569-2013 to permit the construction of a new gasoline service station with a convenience retail store at 325 Horner Avenue. Community Council Recommendations

Etobicoke York Community Council recommends that:

 

1.  City Council state its intention to designate the property at 260 High Park Avenue under Part IV, Section 29 of the Ontario Heritage Act, in accordance with the Statement of Significance: 260 High Park Avenue (Reasons for Designation) attached as Attachment 3 to the report (March 30, 2016) from the Chief Planner and Executive Director, City Planning Division.

 

2.  If there are no objections to the designation in accordance with the Ontario Heritage Act, City Council authorize the City Solicitor to introduce the bill in Council designating the property under Part IV, Section 29 of the Ontario Heritage Act.

 

3.  If there are objections to the designation in accordance with the Ontario Heritage Act, City Council direct the City Clerk to refer the designation to the Conservation Review Board.

 

4.  If the designation is referred to the Conservation Review Board, City Council authorize the City Solicitor and appropriate staff to attend any hearing held by the Conservation Review Board in support of Council's decision on the designation of the property.

Summary

This report recommends that City Council state its intention to designate the property at 260 High Park Avenue under Part IV, Section 29 of the Ontario Heritage Act.  The site

contains the former High Park-Alhambra United Church, which was listed on the City of Toronto Inventory of Heritage Properties (now known as the Heritage Register) in 1990.

 

Following research and evaluation, staff have determined that the property meets Ontario Regulation 9/06, the provincial criteria prescribed for municipal designation under Part IV, Section 29 of the Ontario Heritage Act.  The designation will help to ensure that all of the cultural heritage values and attributes of the property are identified and conserved.

Community Council Recommendations

Etobicoke York Community Council recommends that:

 

1.  City Council amend Schedule "A" to By-law No. 821-2015 to add Parts 230, 231, 232, 234, 237 and 239 on Plan 66R-26186 to the lands that are subject to Part Lot Control Exemption.

 

2.  City Council amend By-law No. 821-2015 to extend the expiration of part lot control exemption until July 9, 2017 with respect to the lands formerly known as 115 Torbarrie Road (Parts 1-20, 29-30, 32-34, 36-42, 49-50, 60, 109-114, 150-151, 155-183, 185-188, 191-193, 221-224, 230-232, 234, 237 and 239 of Block 152 on Plan 66M-2436).

Summary

This application requests an amendment to By-law No. 821-2015 to provide for an extension of part lot control exemption for an additional year with respect to a portion of the lands formerly known as 115 Torbarrie Road (Parts 1-20, 29-30, 32-34, 36-42, 49-50, 109-114, 150-151, 155-183, 185-188, 191-193, 221-224, 230-232, 234 and 239 of Block 152 on Plan 66M-2436). The extension would only apply to lots which are still under construction or have not yet been conveyed to the individual purchasers. The exemption from the Part Lot Control provisions of the Planning Act would permit the creation of conveyable lots for the development of 82 townhouse dwelling units.
 
The proposal complies with the Official Plan and Zoning By-law. The extension of the expiry of the part lot control exemption for an additional year is considered appropriate for the orderly development of these lands.

 

This report reviews and recommends approval of the extension to the expiry of the Part Lot Control exemption.

Summary

By-law No. 821-2015 lifted Part Lot Control for several Parts on Plan 66R-26186 in order to allow for the creation of freehold lots to be sold to the public. The legal description in Schedule "A" to By-law 821-2015 inadvertently left out six parts (Parts 230-232, 234, 237 and 239) on Plan 66R-26186 that are very small portions of future freehold lots. Therefore, an amendment to Schedule "A" is required to add these parts to the legal description to which the By-law applies.

Summary

At its meeting on June 16, 2015, Etobicoke York Community Council requested that Municipal Licensing and Standards staff grant homeowners on Weston Road, between Wilson Avenue and Bradstock Road who had been issued Notices of Violation, an extension beyond 30 days to comply with the Zoning By-law.  Etobicoke York Community Council also requested that City Planning and Municipal Licensing and Standards staff prepare a report for consideration at the September 8, 2015 meeting of the Etobicoke York Community Council, with a view of either exempting the homeowners or amending the Zoning By-law in order to bring the driveways into compliance.

 

At its meeting on October 6, 2015, Etobicoke York Community Council deferred consideration of this Item until its January 19, 2016 meeting.

 

This report describes the Zoning By-law performance standards related to driveways and front yard landscaping and provides information with respect to the Notices of Violation that have been issued for certain homeowners on Weston Road between Wilson Avenue and Bradstock Road.

Summary

At its meeting of June 16, 2015, Etobicoke York Community Council considered Item EY7.52, headed "Homes on Weston Road between Wilson Avenue and Bradstock Avenue".  A number of homes on this portion of Weston Road had received violation notices relating to driveway widths.  The Community Council, among other things, requested staff to report on options to bring these driveways into compliance.

 

City staff have conducted a preliminary investigation of non-conforming driveways on this portion of Weston Road.  Accordingly, I would like to re-open the June 16, 2015 decision of the Community Council, and instead request City staff work to with property owners to bring these driveways into compliance.

Summary

A Final Report on the subject application was considered by Etobicoke York Community Council on September 8, 2015.  The report recommended that City Council amend former City of North York Zoning By-law No. 7625 for the lands at the southeast corner of Weston Road and Sheppard Avenue West (formerly known as 2277 Sheppard Avenue West, 100 Mainshep Road and 3035 Weston Road) to permit larger rear yard decks.  Etobicoke York Community Council recommended the staff recommendations be approved by City Council, but added a recommendation that City Council approve reimbursement of Committee of Adjustment fees charged to applicants whose Minor Variance applications would not have been required had the proposed Zoning By-law been in force and effect at the time the applications were made.  

 

At its meeting on September 30, 2015, City Council adopted the recommendations to amend the Zoning By-law, but directed the Chief Planner and Executive Director, City Planning to report to Etobicoke York Community Council on the recommendation that Committee of Adjustment fees be reimbursed.

Summary

This application proposes to amend the City of Toronto Zoning By-law No. 569-2013 and the former City of Etobicoke Zoning Code to permit a phased mixed use development at 2 Gibbs Road.  Phase 1 would consist of two 10-storey residential rental buildings with retail uses at grade on the eastern portion of the site. Subsequent phases would include three residential condominium towers (46, 37 and 31 storeys in height) above a 5-storey podium containing retail and office space and 14 townhouse units on the western portion of the site. The proposed development would contain a total of 1,500 residential units (including 420 rental units) and have a total gross floor area of 99,400 m², of which 6,400 m² would be comprised of non-residential uses. The development would have a Floor Space Index of 3.74 times the lot area.

 

Vehicular access is proposed via a new private road accessed from Gibbs Road and a new one way private road for servicing and loading along the eastern boundary of the site. A total of 1,713 parking spaces are proposed within a below and above grade garage. Also, a central privately owned publically accessible (POPS) open space is proposed.


This report provides preliminary information on the above-noted application and seeks Community Council's directions on further processing of the application and on the community consultation process.

 

The site is located on the boundary between Wards 3 and 5.  A community consultation meeting scheduled by staff in consultation with the Ward Councillors is intended to be held in the second quarter of 2016. A Final Report and statutory public meeting under the Planning Act to consider this application is targeted for the first quarter of 2017. This target assumes the applicant will provide all required information in a timely manner.

Summary

The application to amend the Zoning By-law proposes the redevelopment of the northern portion of the site at 8, 12 and 14 High Park Avenue and the rear of 1908, 1910, 1914 and 1920 Bloor Street West.  A three-storey building, containing retail uses at grade and a day nursery use on the second and third levels would front High Park Avenue and a one storey building containing 15 'micro-retail/service' units would front the TTC High Park Station bus platform.  Outdoor recreation space for the day nursery would be provided on the roof of the 'micro-retail/service' building.  A rear garage which serves the five residential buildings on site would be demolished. 

 

An application has also been filed under Section 111 of the City of Toronto Act for the demolition of 10 residential rental units located in 12 and 14 High Park Avenue.  The residential rental units are proposed to be relocated to a mixed-use development at 2265-2279 Bloor Street West, which is under the same ownership as the subject site.

 

This report provides preliminary information on the above-noted applications and seeks Community Council's directions on further processing of the applications and on the community consultation process.

 

A community consultation meeting scheduled by staff, in consultation with the Ward Councillor, is targeted to be held in the second quarter of 2016. This application proposes a Zoning By-law Amendment to maintain a place of worship use at 1736 Weston Road.  A Zoning By-law Amendment to permit the place of worship use was approved by City Council in 2003, subject to a number of conditions that were never fulfilled.  Between 2003 and 2008, the applicant requested through Etobicoke York Community Council and City Council that the condition related to off-site parking be amended to be less onerous.  The request was deferred by City Council and Etobicoke York Community Council several times and ultimately considered by City Council in 2008.  In 2008, City Council approved a Temporary Use By-law, with no requirement for off-site parking, for a period of three years.  The Temporary Use By-law was enacted by City Council in 2010 and it expired in 2013.  The subject application is to permit the place of worship as a permanent use.

To address safety concerns and congestion in the area of Second Street Junior Middle School (71 Second Street), it is recommended a change from the current "No Parking Anytime" regulation to a "No Stopping, 8:00 a.m. to 5:00 a.m., Monday to Friday" regulation on the west side of Second Street, between Birmingham Street and Maple Boulevard. The extension of the current school bus loading zone is also required in order to accommodate increased enrollment at the school. In addition, northbound and southbound U-turns should be prohibited on Second Street in this area.

 

These amendments will improve traffic operations and will address concerns regarding traffic congestion and safety in the area for school children and residents. This recommendation is the result of consultations with school officials and the area Councillor.

Summary

In the past few weeks, my office has been contacted by residents on Usher Avenue who were frustrated to learn that a sidewalk would be constructed on the south side of the existing road on Usher Avenue from Royal York Road to the Kingsway.

 

I have received a petition demonstrating that all of the homes affected on Usher Avenue are opposed to the installation of sidewalks.

 

Despite the City's policy to build a physical environment which supports walking and accessibility, the City's policy also states that any proposed sidewalks can only be installed on an existing local street after the Ward Councillor completes a consultation of the neighbourhood and receives consensus to support the installation. Although Usher Avenue is a collector road, the residents have been overwhelmingly clear that they do not support the installation. Note that The Kingsway to the south – a street that is far more heavily used – does not have sidewalks as the residents of the area have historically opposed their installation. It is also my understanding that there have been no formal studies by staff to examine a need for a sidewalk on Usher Avenue.

 

I was initially instructed to put forward this motion at Public Works and Infrastructure Committee on April 25th. At Committee, it was indicated by Clerks that the procedural bylaw requires that local and collector road sidewalks be dealt with at Community Council. It is with this direction that I am submitting this motion to Etobicoke York Community Council.

1.  Approved the application to demolish the single family dwelling at 23 Riverside Crescent with the following conditions:

 

a. A construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III, if deemed appropriate by the Chief Building Official.

 

b. The Owners construct and substantially complete the construction of the new single family dwelling authorized by the building permit folder number 16- 135558 BLD 00 NH on the site of the existing building to be demolished by no later than two (2) years from the day the demolition is commenced.

 

c. The failure to complete the construction within the time specified, shall entitle the City Clerk to enter on the collector's roll, to be collected in like manner as a municipal taxes, the sum of twenty thousand dollars ($20,000.00) for each dwelling unit in respect of which a demolition permit is issued, and that such sum shall, until payment, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued.

 

d. All debris and rubble be removed immediately after demolition.

This staff report is about a matter for which Community Council has delegated authority from City Council to make a final decision.

 

In accordance with section 33 of the Planning Act and the Municipal Code Chapter 363,

Article II “Demolition Control” the application for the demolition of a residential dwelling at 23 Riverside Crescent is referred to the Etobicoke York Community Council for consideration for the issuance of a demolition permit because the property is located in the Former City of Toronto and a written notice of objection to the issuance of demolition permit was received.

 

The owner requires permission to demolish the existing building in order to construct a new two storey single family dwelling.

 

If the Etobicoke York Community Council grants issuance of the demolition permit, it may impose conditions, if any, to be attached to the demolition permit.

The application (Application A23/16EYK) proposal was to legalize and to maintain a storage shed in the rear yard that is currently under construction.  The applicant's proposal was approved by the Committee of Adjustment and I submitted a letter of support that the variance was in keeping with the character of the surrounding neighbourhood. The Committee of Adjustment's decision has been appealed to the Ontario Municipal Board (Case# PL160344 with no hearing scheduled yet).

1.         Requested the Director, Public Realm Section, Transportation Services, in consultation with the Director, Transportation Services, Etobicoke York District, to report to the June 14, 2016 meeting of Etobicoke York Community Council with an analysis of the advantages and disadvantages of preventing pedestrian through-traffic on the public laneway running from Macdonald Avenue to Lawrence Avenue West by replacing the existing guard rails with fencing.

Summary

The City laneway which runs from Macdonald Avenue to Lawrence Avenue West, east of Ralph Street, is used by abutting property owners to access their private garages by way of easement agreements over the laneway. Vehicles are prevented by driving through the entirety of the laneway with guard rails in the middle to prevent through-fare; as a result of the limited vehicular traffic, the laneway also serves as a walkway for pedestrians, and students of the local schools.

 

In 2008 my office was contacted by a number of property owners whose homes abut the public laneway that runs between Macdonald Avenue and Lawrence Avenue West, with the request that the City close the laneway to the public due to issues with pedestrians vandalising their private property, conducting illegal activity in the laneway, and throwing garbage and debris over the fence onto private property. After meeting with area residents, Transportation Services explained that they would not close the public lane; however, they could declare the land surplus if all eight abutting property owners agreed to purchase the portion adjacent to their properties at fair market value plus all costs incurred by the City as a result of the transaction (i.e. closing costs, transaction fees, cost of relocating utilities, etc.).  Consensus could not be reached among the eight abutting property owners so the laneway remained open to the public and in 2009 this laneway which was previously scheduled for reconstruction, was reconstructed.

 

In 2012 I was asked by area residents to revisit the request to close the laneway; at that time, all property owners abutting the section of the laneway from Boyd Avenue to Lawrence Avenue West indicated their willingness to purchase the sections of the laneway abutting their properties. After considering the request, Transportation Services reported that they would no longer consider declaring the land surplus due to the City's recent (2009) investment in reconstructing the laneway, as well as wanting to maintain the pedestrian connection from Lawrence Avenue West into the community.

 

Earlier this year, the request to close the laneway resurrected once more as problems with vandalism, loitering, and disruptive activity in the laneway have continued to persist; in response, a community meeting was held with representatives from Transportation Services. Residents in attendance expressed frustration with the negative affect the pedestrians using the laneway are having on their private property and on their ability to enjoy their property. Residents expressed the desire to see the City maintain ownership over the laneway, but to replace the existing guardrails with fences so that pedestrians would not have through-access and consequently, would no longer use the laneway.

Summary

The owners of the land municipally known as 2 Ash Crescent applied to the Committee of Adjustment to obtain a consent to sever (Application B75/15EYK) and a number of associated minor variances (Applications A667/15EYK, A668/15EYK) in order to build two new detached dwellings, one with an attached garage and one with a detached garage in the rear yard.

 

City Planning staff prepared a report recommending refusal of the consent, and the local community and I submitted concerns that the consent and minor variances are not in keeping with the intent and purpose of the zoning by-laws, nor the existing physical character of the surrounding neighbourhood.

 

On April 14th, 2016, the Committee approved the consent and the variances related to the severance (lot frontage and lot area), however, refused the variances related to the construction of the new dwellings.  In essence, the applicant would have to construct two new dwellings within full compliance of the zoning by-laws.

 

The COA’s decision has been appealed to the Ontario Municipal Board.  To-date, a hearing date has not yet been scheduled.

Summary

As a result of the Federal Liberal government promising to legalize marijuana, the City of Toronto has seen a rash of marijuana dispensaries/pharmacies opening their doors for business. These establishments are opening at an alarming rate across the City of Toronto, without a legal license to operate. 

 

Health Canada has authorized 27 licensed producers across Canada with just 15 of them operating in Ontario. These licensed establishments are allowed to sell/dispense marijuana to those with verified prescriptions. According to Health Canada, Toronto Police and City of Toronto, all other establishments are operating illegally.

 

As of April, two locations are operating within Ward 17, 1326 St. Clair Avenue West and 1715 St. Clair Avenue West. These two properties are subjected to the former City of Toronto Zoning By-law 438-86 only; not to the new City-wide Zoning By-law 569-2013. Under the Toronto Zoning By-law 438-86, these properties are zoned MCR whereby a marijuana dispensary is not a permitted use.
