2.         The Conservatory Group pay the estimated cost of $4,200.00 for the fabrication and installation of the street name signs.

 

3.         The owners of the subject lands, their agents or successors, shall maintain, at their own risk, the signage installed under section 2 of this By-law.

Community Council Recommendations

Etobicoke York Community Council recommends that:

 

1.         In accordance with the delegated approval under By-law 229-2000, City Council be advised that the Chief Planner intends to approve the Draft Plan of Common Elements Condominium for the lands at 700 Trethewey Drive, as generally illustrated on Attachment 1 to the report (August 17, 2011) from the Director, Community Planning, Etobicoke York District, subject to:

 

a.         the conditions as generally listed in Attachment 3 to the report (August 17, 2011) from the Director, Community Planning, Etobicoke York District, which except as otherwise noted, must be fulfilled prior to the release of the plan of condominium for registration;  and

 

b.         any such revisions to the proposed condominium plan or any such additional or modified conditions as the Chief Planner may deem to be appropriate to address matters arising from the on-going technical review of this development.

 

2.         City Council direct that confirmation be provided by the applicant and verified by the City Solicitor that a Section 118 restriction under the Land Titles Act has been registered for the lands.

This application proposes a 44-unit residential development comprising 12 detached houses and 32 semi-detached houses for the lands known municipally as 755 Humberwood Boulevard.

 

The subject property is vacant and represents an infill opportunity in the West Humber neighbourhood.  The proposed development complies with the Official Plan policies and is in keeping with the general intent of the zoning by-law.  The development is an appropriate extension of the existing residential community to the north.

Summary

This application proposes the construction of 66 townhouse units at 636 Evans Avenue.

 

The proposed built form and relationship to the public street fits with the existing residential developments located along Evans Avenue and is similar in scale and form to the townhouse developments located immediately to the east on both the north and south sides of Evans Avenue.  The proposed development is appropriate for the area.

 

This report reviews and recommends approval of the application to amend the Zoning By-law.

Community Council Recommendations

Etobicoke York Community Council recommends that:

2.         City Council amend the Etobicoke Zoning Code for the lands at 5485 and 5487 Dundas Street West (Alder Place) substantially in accordance with the draft Zoning By-law Amendment as described in the report dated October 17, 2011 from the Director, Community Planning, Etobicoke York District.

 

3.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required.

 

4.         Before introducing the necessary Bills to City Council for enactment, City Council require the Owners to enter into individual Agreements pursuant to Section 37 of the Planning Act as follows:

 

a.         The community benefits recommended to be secured in the Section 37 Agreements are as follows:

 

i.          $1,250,000 from the Owner of Dunshorn to be used for improvements, above base condition as established by Parks, Forestry and Recreation, to the new park to be created on the Dunshorn site and/or for improvements to Cloverdale Park, paid prior to the issuance of an above-grade building permit, and indexed upwardly in accordance with the Non-Residential Construction Price Index for Toronto from the date of execution of the Section 37 agreement to the date of payment.

 

ii.         $250,000 from the Owner of Alder Place to be used for improvements, above base condition as established by Parks, Forestry and Recreation, to the new park to be created on the Dunshorn site and/or for improvements to Cloverdale Park, paid prior to the issuance of an above grade building permit, and indexed upwardly in accordance with the Non-Residential Construction Price Index for Toronto from the date of execution of the Section 37 agreement to the date of payment.

 

b.         The following matters are also recommended to be secured in the Section 37 Agreements as a legal convenience to support development:

 

i.          The provision of easements in favour of the City as required for the transit reserve and the private roads at the time of Site Plan Approval;

 

ii.         Details of an arrangement among Dunshorn, Alder Place and the City regarding financing and construction of required infrastructure improvements, including sewer, water supply, storm water management, traffic and road facilities, and transit priority signalling satisfactory to the Executive Director of Technical Services and the Director, Community Planning, Etobicoke York District;

 

iii.        Arrangements to secure a 3.44 metre wide land dedication for road purposes along the east side of Shorncliffe Road from the owner of Alder Place at the time of Site Plan Approval; and

 

iv.        The Owners shall construct and maintain the developments in accordance with Tier 1 performance measures of the Toronto Green Standard, as adopted by Toronto City Council at its meeting held on October 26 and 27, 2009 through the adoption of Item PG32.3 of the Planning and Growth Committee.

 

5.         Before introducing the necessary Bills to City Council for enactment, City Council require

 

a.         the Owners of the Dunshorn property to:

 

i.          finalize the Functional Servicing Report to the satisfaction of the Executive Director of Technical Services;

 

ii.           finalize the Traffic Impact Study to the satisfaction of the Director, Transportation Services and the Director, Transportation Planning, City Planning Division; and

 

iii.          fulfill the following conditions related to the Air Quality Assessment (AQA) to the satisfaction of the Director, Community Planning, Etobicoke York District:

 

a)          the AQA prepared by Dunshorn has been completed;

 

b)          a third-party Peer Review of the AQA for the City, at Dunshorn’s expense, has been satisfactorily completed; and,

 

c)           written confirmation has been received from Dunshorn’s consulting engineer that the off-site mitigation measures recommended to support the development proposal, if any, have been completed, are operational and have been demonstrated to mitigate air quality and odour impacts to acceptable Ministry of the Environment requirements and/or other arrangements to achieve the outcome noted herein, including financial and implementation arrangements between the odour-emitting industry(s) impacting the development and Dunshorn have been made, all to the satisfaction of the Director, Community Planning, Etobicoke York District.

 

              b.       the Owners of the Alder Place property to:

 

i.          finalize the Functional Servicing Report to the satisfaction of the Executive Director of Technical Services;

 

ii.           finalize the Traffic Impact Study to the satisfaction of the Director, Transportation Services and the Director, Transportation Planning, City Planning Division; and

 

iii.        provide a Revised Pedestrian Wind Study, to the satisfaction of the Director, Community Planning, Etobicoke York District.

 

c.         Before introducing the necessary Bills to City Council for enactment, require the Owners of Dunshorn and Alder Place to enter into an agreement with each other, and register same on title of all the relevant properties, regarding negotiation and, if necessary, arbitration, of conditions relating to access to, construction, and maintenance of the Private Road, all to the satisfaction of the Director, Community Planning, Etobicoke York District, provided that, should such agreement and registration not be achieved by December 31, 2011, the Director, Community Planning, Etobicoke York District will further report to the Etobicoke York Community Council at its meeting of January 10, 2012.

 

6.         City Council authorize the Bills related to Dunshorn to proceed to City Council independently of Alder Place's Bills, if necessary.

Summary

This report reviews and makes recommendations on applications for zoning by-law amendments for two separate but abutting sites at the south-east corner of Dundas Street West and Shorncliffe Road.  (Attachment 1)  The proposals are similar and they have been processed concurrently.  Most of the issues and aspects discussed in the report apply to both. Where appropriate, separate recommendations and commentary have been provided. 

 

Due to the number of addresses involved in these applications the sites are referred in the report as follows:

 

Dunshorn Holdings Inc.:

5415, 5421-5429, 5453, 5475 and 5481 Dundas Street West and 15 and 25 Shorncliffe Road – File Nos. 10 272799 WET 05 OZ and

11 288365 WET 05 OZ (Removal of the “H” (Holding Symbol))

 

Alder Place: 5485 and 5487 Dundas Street West – File No. 11 107405 WET 05 OZ

 

These applications propose to demolish all the existing buildings on the properties at 5415, 5421-5429, 5453, 5475, 5481, 5485 and 5487 Dundas Street West and 15 and 25 Shorncliffe Road and replace them with six condominium apartment buildings containing 8 high-rise towers ranging in height from 20 to 30 storeys, a 0.4 hectare. public park and a new publicly-accessible, private road network.  The three buildings (with five towers) on the south portion of the sites would be residential only.  The three buildings fronting on Dundas Street West would have an 8 storey base section, with commercial uses on the first floor facing Dundas Street West.  The second and third floor of two of these buildings would be used for office space.  The remaining floors in these buildings would be residential.

 

The proposed development advances the Official Plan and Provincial policies of intensification in the Centres and provincial Growth Centres and Mobility Hubs.  The point tower and podium design will significantly improve the public realm and streetscape along Dundas Street West and allow the intensification to occur without undue negative impacts on the surrounding neighbourhoods.  The public park and private open space included in the project will provide benefits to both new and existing residents of the area.

 

This report reviews and recommends approval of the applications to amend the Zoning By-law.

Community Council Recommendations

Etobicoke York Community Council recommends that:

 

1.         City Council amend the former City of Etobicoke Zoning Code for the lands at 1030 and 1040 Islington Avenue substantially in accordance with the draft Zoning By-law Amendment as described in the report dated October 17, 2011 from the Director, Community Planning, Etobicoke York District.

 

2.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendment as may be required.

 

3.         Before introducing the necessary Bills to City Council for enactment, City Council require the Owner to enter into an Agreement pursuant to Section 37 of the Planning Act as follows:

              

a.         The community benefits recommended to be secured in the Section 37 Agreements are as follows:

 

i.          $100,000.00  cash contribution to the Land Acquisition Reserve Fund (XR10-12) towards the purchase of the land for the expansion of Fairfield Park, paid prior to the issuance of an above grade building permit, and indexed upwardly in accordance with the Non-Residential Construction Price Index for Toronto from the date of execution of the Section 37 Agreement to the date of payment; and

 

  ii.       $25,000.00 cash contribution towards improvements to Fairfield Park.

 

b.         The following matters are also recommended to be secured in the Section 37 Agreements as a legal convenience to support development:

 

i.          Funding from the Owner for turning lane improvements required at the eastbound approach to Norseman Street and Islington Avenue;

 

ii.         The provision of noise attenuation measures as detailed in the Environmental Noise Feasibility Study dated June 2, 2011;

 

iii.        Agreement to permanently remove the existing drive-through facilities from the building at 1048 Islington Avenue if the current use (TD Bank) is changed; and

 

iv.        The Owner shall construct and maintain the development in accordance with Tier 1 performance measures of the Toronto Green Standard, as adopted by Toronto City Council at its meeting held on October 26 and 27, 2009 through the adoption of Item PG32.3 of the Planning and Growth Committee.

 

4.         Before introducing the necessary Bills to City Council for enactment, City Council require the applicant to:

 

i.          finalize the Functional Servicing Report to the satisfaction of the Executive Director of Technical Services; and,

 

ii.          fulfill the following conditions related to the Ambient Air Quality Assessment Study (AAQAS) to the satisfaction of the Director, Community Planning, Etobicoke York District:

Summary

The zone change application proposes the construction of approximately 250 residential townhouses and a 5,250 square metres GFA industrial building at 1030 and 1040 Islington Avenue.  The application for Draft Plan of Subdivision proposes the creation of 13 blocks including a public road that will connect to Islington Avenue and Norseman Street through the lands. (Attachment 1)

 

The proposal will result in the redevelopment of a former industrial site.  Townhouses would occupy the larger, eastern section of the site which is designated Mixed Use Areas in the Official Plan.  An industrial building will be built on the west part of the site, which is designated Employment Areas in the Official Plan. (Attachment 7)  This building will buffer the residential area from the existing industrial operations to the west. 

 

This report reviews and recommends approval of the application to amend the Zoning By-law and advises that the Chief Planner may approve the Draft Plan of Subdivision.

Community Council Recommendations

Etobicoke York Community Council recommends that:

 

1.         City Council authorize the City Solicitor, together with the Chief Planner and other appropriate City staff to attend the Ontario Municipal Board hearing in support of the position outlined in the report dated October 31, 2011, from the Director, Community Planning, Etobicoke York District.

 

2.         City Council request the Ontario Municipal Board withhold its Order on the Zoning By-law Amendment appeals until the related Official Plan Amendment appeals are withdrawn or resolved.

 

3.         City Council confirm that the Zoning By-law Amendments to permit the redevelopment of the properties at 5555 Dundas Street West, 10 Shorncliffe Road, 5559 Dundas Street West and 25 Vickers Road, be in accordance with the principles set forth in the report (October 31, 2011) from the Director, Community Planning, Etobicoke York District, with the details to be to the satisfaction of the Chief Planner and City Solicitor in consultation with the Executive Director, Technical Services.

 

4.         City Council authorize the City Solicitor and any other appropriate City staff to take such actions as necessary to give effect to Parts 1 to 3 above.

Summary

These applications were made prior to January 1, 2007, with the exception of those respecting 10 Shorncliffe Road.  The City's implementing Official Plan Amendment 156 (OPA 156), which is under appeal, was enacted in July, 2011 and is subject to the changes to the Planning Act which came into effect on January 1, 2007, and the City of Toronto Act, 2006.

 

These applications are for the lands south of Dundas Street West and west of Shorncliffe Road.  More specifically, separate but interrelated applications have been submitted by Metro (formerly A&P) for 25 Vickers and 5559 Dundas Street West, and The Azuria Group (Honeydale) for the properties at 5555 Dundas Street West and 10 Shorncliffe Road.  This is a report on appeals by the owners of their applications to amend the Zoning By-law, in order to provide staff with instructions for the Ontario Municipal Board hearing on these appeals and Honeydale's appeal of OPA 156, scheduled to commence in February, 2012. 

 

Honeydale applied for Zoning By-law and Official Plan amendments to permit mixed-use development at a density of approximately 2.6 times the area of the lot with building heights ranging between 10 and 16 storeys on their property at 5555 Dundas Street West, subsequently acquiring and adding 10 Shorncliffe Road to their applications. 

 

Metro also applied for Zoning By-law and Official Plan Amendments. The Zoning by-law Amendments were to permit office development at 25 Vickers Road and mixed-use development at a density of 2.3 times the area of the lot with building heights ranging between 3 and 22 storeys for 5559 Dundas Street West.

 

The purpose of this report is to seek City Council's instruction to bring forward the position outlined in this report to the Ontario Municipal Board hearing now scheduled to commence on February 13, 2012.

 

The Ontario Municipal Board hearing will be a combined hearing.  Specifically, the hearing will include Honeydale's and Metro's appeals in connection with their site specific Official Plan and Zoning By-law Amendment applications and Honeydale's appeal of OPA 156 (adopted, by City Council July 12 and 13, 20l1).  These appeals are respecting certain of the lands within the Dundas Street West/ Highway 427 Planning Framework study which was initiated in response to the original applications.

Community Council Recommendations

Etobicoke York Community Council recommends that:

 

1.         City Council endorse the vision put forward in "The Etobicoke Centre Public Space and Streetscape Plan" (September 2011) and support, in principle, the projects and initiatives identified in this plan to incrementally improve the quality and character of public space in the Etobicoke Centre.

 

2.         City Council direct the Chief Planner and Executive Director, City Planning, along with other relevant City officials, to pursue the implementation of the incremental improvements identified in "The Etobicoke Centre Public Space and Streetscape Plan" at every opportunity, including those presented through the development approval process and the City's capital works program.  

 

3.         City Council direct that the strategies and implementation tools identified in the report (October 13, 2011) from the Director, Community Planning, Etobicoke York District, be extended to apply to the Dundas Street West corridor up to Highway 427 to achieve a consistent streetscape design with the Etobicoke City Centre area.

Summary

This report presents the conclusions and recommendations of the Etobicoke Centre Public Space and Streetscape Plan.  City Planning commissioned this study in 2011 as part of a joint Request for Proposal for the Etobicoke Centre and Scarborough Centre.  The firm of Urban Strategies was retained to undertake the Etobicoke Centre Plan.  The consultant's work program included a series of walking tours, site visits, stakeholder interviews and an open house to get feedback on draft findings.

EY11.17 - Closing the Existing Pedestrian Connection at the south limit of Windsor Road

1.         City Council close the existing pedestrian connection at the south limit of Windsor Road, and authorize and direct the Acting Director, Transportation Services, Etobicoke York District, to install a chain link fence 1.8 metres in height across the opening in the existing fence.

Summary

The existing high-rise residential condominium buildings at 320-390 Dixon Road visually appear to have frontage along the entire south limit of Windsor Road. While this property frontage is currently fenced, there is an opening in the existing 1.8m high chain link fence that allows pedestrian access from the condominium buildings to Windsor Road. Approximately 500 pedestrians use this connection every weekday between 7 a.m. and 7 p.m.

 

Windsor Road residents have asked the Ward Councillor to close this pedestrian connection due to concerns over crime and vandalism.

 

A recent title search found that a 0.305m wide strip of privately-owned land (also referred to as a “one foot reserve”), is situated immediately south of the Windsor Road right-of-way, extending across the entire width of the south limit of Windsor Road. Accordingly, the condominium buildings at 320-390 Dixon Road do not actually have frontage along the south limit of Windsor Road. None of the surrounding owners has registered title to this 0.305m reserve or a registered easement over it. Registry Office records indicate that the reserve is still owned by the same individuals who purchased it as part of a larger site in 1939, and subdivided the site in 1949.

 

Staff has been unable to find any evidence registered on title to suggest that the owners of the 0.305m reserve ever granted an easement to the adjoining properties to the south at 320-390 Dixon Road to permit vehicle or pedestrian access to Windsor Road or that the owners of the properties to the south have otherwise acquired a right to use the reserve to gain access to Windsor Road. Consequently, while this pedestrian connection has been in existence for many years, it appears that the presence of the 0.305m private reserve prohibits legal access to Windsor Road from 320-390 Dixon Road. Although the owners of the reserve do continue to have legal access to Windsor Road, it is unlikely that they will object to the closure given that they no longer own any of the lands adjoining the reserve. Accordingly, Transportation Services staff suggests closing this existing pedestrian connection to address the crime and security concerns expressed by Windsor Road residents

 

It should be noted, however, that if the owners of the 0.305m reserve do come forward and object to the closure and/or if the owners of the properties to the south produce satisfactory evidence that they have acquired a legal right to cross the reserve to access Windsor Road, then the City will either have to re-open the pedestrian connection or take formal steps to permanently close part of Windsor Road, at its south terminus, to legally prohibit access between Windsor Road and the properties to the south.

 

Transportation Services staff has no way of directly contacting the owners of the adjoining 0.305m reserve, given that these individuals acquired the property in 1939, and there have been no registered dealings with the property since registration of the 1949 plan of subdivision.

 

This matter is scheduled as a deputation item. Public notice regarding the proposal to close this pedestrian connection has been placed on the City’s website and on the existing fence at this location.

 

If City Council decides that this pedestrian connection should remain open, then Transportation Services staff recommends that the Director of Real Estate Services be requested to report back to City Council on the steps and costs to acquire the one foot reserve adjoining the south limit of Windsor Road and York Road.

Summary

In April 1972 the York Lions Club created a new band for youth called the York Lions Steel Band. The Band, made up of upwards of 30 teenagers between the ages of 12 to 19 and managed by volunteers, provides free opportunities for youth to learn musical skills and to travel.  The Band's goals are to provide members with a year-round activity which teaches responsibility, commitment and teamwork. Members are taught musical, leadership and performing skills, and also take part in educational trips and musical performances. 

 

For over ten years Mike Stacey, owner of 140 Cordella Avenue and Managing Director of the York Lions Steel Band has parked the Band's truck in his driveway.  Recently, Mr. Stacey was issued a Notice of Violation for parking this vehicle in his driveway as existing by-laws prohibit commercial vehicles from being parked on residential driveways.

 

The vehicle in question, while classified as a commercial vehicle, is used solely for charitable purposes and residents of the area surrounding 140 Cordella Avenue have stated that they have no objection to the vehicle being parked there.
