This staff report concerns a matter for which the Scarborough Community Council has delegated authority from City Council to make a final decision.

 

The purpose of this report is to advise Council concerning an application by the property owner of 34 Wooster Wood for a site-specific Fence Exemption, pursuant to Section 447-2 of the Toronto Municipal Code, Chapter 447- Fences.  The property owner is seeking Council's permission for an exemption for a proposed wood fence which does not comply with maximum fence height restrictions contrary to Section 447-2 of the by-law.
         
The definition of a Fence: "A barrier, including one for noise attenuation, or any structure, that wholly or partially screens from view, encloses or divides a yard or other land, or marks or substantially marks the boundary between adjoining land, and includes any hedge or shrub that has the same effect."

Summary

The application indicates the main reasons for requesting tree removal are due to concerns over the tree's proximity to the house and the concern that the tree may fail during a wind storm and fall towards the house. Falling needles and security due to the tree blocking the view of the house are additional concerns.

Summary

This report responds to a request by Scarborough Community Council, at its meeting on April  5, 2016, for a report from the Director, Transportation Services, Scarborough District on a proposal to enact an amendment to the Municipal Code that would permit the use of the "driveway apron" (the section between the curb and sidewalk) for parking purposes on Painted Post Drive in Ward 38. The Municipal Code currently prohibits the use of this area for parking purposes across the City, with the exception of one street in Ward 8 (Shoreham Drive).

 

The exemption to the Municipal Code for Shoreham Drive was enacted by City Council in April 2015.  Therefore, the full implications of this "apron parking" on Shoreham Drive are not yet known due, in part, to the relatively moderate winter the city experienced last season.  Nevertheless, based on an assessment of the potential impacts of parked vehicles on traffic operations, pedestrian activity, and winter maintenance, and the potential safety implications, staff have concerns with the proposed exemption.  The implications of this proposal and the basis of these concerns are presented in this report for information.

Summary

This Zoning By-law amendment application is to permit a 4-storey, stacked townhouse development with commercial uses on the ground floor.  The proposal includes 104 residential units having a gross floor area of 9 233 square metres (99,383 square feet) and 776 square metres (8,353 square feet) of commercial space on the ground floor.  This application is for three properties (3310, 3312 and 3314 Kingston Road) that occupy the northeast corner of Kingston Road and Mason Road.  The current zoning for these properties does not permit residential uses.

 

This report provides preliminary information on the above-noted application and seeks Community Council's directions on further processing of the application and on the community consultation process.

 

The application should proceed through the planning review process to include a community consultation meeting for the third quarter of 2016.  Provided all required information is submitted in a timely manner and all issues raised during the review process and consultation process have been satisfactorily resolved, a final report will be prepared and a public meeting is targeted for the last quarter of 2016.
