1.   Approved the application to demolish the building at 1396 Kingston Road containing two vacant residential units with the following conditions:

           

a.  that a construction fence be erected in accordance with the provisions of the Municipal Code, Chapter 363, Article III; if deemed appropriate by the Chief Building Official;

 

b.  that all debris and rubble be removed immediately after demolition;

 

c.  that sod be laid on the site and the site be maintained free of garbage and weeds, in accordance with the Municipal Code Chapter 623-5 and 629-10, paragraph B;

 

d.  that any holes on the property are backfilled with clean fill;

 

e.  that all privately and publicly owned trees, which are protected by the City of Toronto By-laws, be protected in accordance with the By-laws during the demolition process;

 

f.  that the applicant for the demolition permit construct and substantially complete the new building to be erected on the site of the property where the building is to be demolished not later than two years from the day demolition of the existing building is commenced; and

 

g.  that on failure to complete the new building within the time specified in (f) above, the City Clerk shall be entitled to enter on the collector’s roll, to be collected in like manner as municipal taxes, the sum of twenty thousand dollars ($20,000) for each dwelling unit contained in the residential property in respect of which the demolition permit is issued and that such sum shall, until payment, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued.

In accordance with Section 33 of the Planning Act and the former City of Toronto Municipal Code Ch. 363, Article II “Demolition Control”, the application for the demolition of the vacant commercial building containing two vacant residential units at 1396 Kingston Road is referred to the Scarborough Community Council to refuse or to grant the application as a building permit has not been issued for a replacement building.

Summary

This report requests that City Council deny the application for a permit to remove one (1) privately-owned, ravine-protected tree located at 3 Acland Crescent. The application indicates the reasons for removal are that the tree is in a poor location, situated too close to an existing house and walkway, and that the walkway has been lifted by expanding roots.

 

The subject tree is a white pine (Pinus strobus), measuring 62 cm in diameter. Urban Forestry does not support the removal of this tree as it is healthy and maintainable.

Summary

This report responds to a request by Scarborough Community Council, at its meeting on April 5, 2016, for a report from the Director, Transportation Services, Scarborough District on a proposal to enact an amendment to the Municipal Code that would permit the use of the "driveway apron" (the section between the curb and sidewalk) for parking purposes on Painted Post Drive in Ward 38. The Municipal Code currently prohibits the use of this area for parking purposes across the City, with the exception of one street in Ward 8 (Shoreham Drive).

 

The exemption to the Municipal Code for Shoreham Drive was enacted by City Council in April 2015.  Therefore, the full implications of this "apron parking" on Shoreham Drive are not yet known due, in part, to the relatively moderate winter the city experienced last season.  Nevertheless, based on an assessment of the potential impacts of parked vehicles on traffic operations, pedestrian activity, and winter maintenance, and the potential safety implications, staff have concerns with the proposed exemption.  The implications of this proposal and the basis of these concerns are presented in this report for information.

Background Information

On September 8th, 2016 the application for consent to sever the property at 46 Valhalla Boulevard (File B034/16SC, A192/16SC, A193/16SC and A194/16SC) was denied by the Scarborough Committee of Adjustment.  The applicant sought consent to sever the land into three lots for three new detached houses.  The original house would be demolished. The proposed Lot Division Plan was as follows: Part 1: Proposed frontage of 6.098 m whereas the minimum required lot frontage is 9 m. Part 2 Proposed frontage of 6.098 m whereas the minimum required lot frontage is 9 m. Part 3 Proposed frontage of 6.098 m whereas the minimum required lot frontage is 9 m.

 

The proposed consent is not in keeping with the characteristics of the immediate neighbourhood and does not conform to the policies in the official plan

 

As well, numerous objections have been received from the immediate neighbours and residents in the area that they do not support the severance.

This application proposes to amend the Zoning By-law by replacing existing Place of Worship zoning with appropriate new residential zoning and development standards to permit 8 single-family residential lots, each with a detached dwelling fronting on Kecala Road.  Seven of the dwellings would be of new construction while an existing heritage-listed single family dwelling on the east end of the property would be maintained.  (The existing place of worship structure on the property is proposed to be demolished.)

 

The proposal complies with the Official Plan, conforms to the Growth Plan for the Greater Golden Horseshoe and is consistent with the Provincial Policy Statement.

Community members were recently able to secure a granite bench valued at approximately $5,000, donated by Resthaven Memorial Gardens at no cost to the City, engraved to commemorate Yen Zhang - a 36 year old mother who lost her life to a drunk driver in the area ten years ago.
