NY3.46 - Final Report - Rezoning Application - 2756 Old Leslie Street

City Council Decision

City Council on February 7 and 8, 2011, adopted the following:

 

1.         City Council amend Zoning By-law No. 7625 substantially in accordance with the draft Zoning By-law Amendment included as Attachment No. 10 to the report (December 13, 2010) from the Director, Community Planning, North York District.

 

2.         City Council authorize the City Solicitor to make such stylistic and technical changes to the draft Zoning By-law Amendments as may be required.

  

3.         Before introducing the necessary Bills to City Council for enactment, City Council require the Notice of Approval Conditions to have been issued under Section 41 of the Planning Act and Section 114 of the City of Toronto Act, 2006.  The following issues will be addressed through the site plan process:

 

a.         provide a high quality design and architectural treatment with minimal or no window openings (whether spandrel, frosted glass, tinted glass, vision glass or other material opening cover) for that portion of the north facade located within 5.5 m of the boundary line;

 

b.         provide detailed design drawings of the proposed crash wall required by City Planning and CN Rail;

 

c.         an acceptable alternative to the proposed location of the above grade transformer;

 

d.         an acceptable relationship between the front door of the building and the public realm at the corner of Esther Shiner Boulevard and Old Leslie Street; and

 

e.         provision of securities for the costs associated with the relocation of the above-grade utilities and equipment at the corner of Esther Shiner Bouleveard and Old Leslie Street.

 

4.         City Council direct that the outstanding site-specific requirements of CN Rail included in Attachment No. 9 to the report (December 13, 2010) from the Director, Community Planning, North York District, be addressed.

 

5.         City Council direct the Toronto Transit Commission and Real Estate Services to report to City Council through North York Community Council on a plan for the development and/or landscaping and maintenance of the western portion of the property that will be retained by the City.

Community Council Recommendations

North York Community Council recommends that:

North York Community Council held a statutory public meeting on January 18, 2011 and notice was given in accordance with the Planning Act.  No one addressed the North York Community Council on January 18, 2011.

Summary

This application proposes an 11 storey building with 182 residential units and 264 m2 of commercial space on the eastern half of the property at 2756 Old Leslie Street.  The proposal is consistent with the objectives and policies of the Official Plan   This report reviews and recommends approval of the application to amend the Zoning By-law.
