City Council Decision

City Council on May 17, 18 and 19, 2011, adopted the following:

 

1.         City Council reaffirm its support of the terms of the existing Section 37 Agreement respecting the Equinox Condominium Pedestrian Bridge Connection to Scarborough RT Station.

Community Council Recommendations

Scarborough Community Council recommends that:

 

1.         City Council reaffirm its support of the terms of the existing Section 37 Agreement respecting the Equinox Condominium Pedestrian Bridge Connection to Scarborough RT Station.

Decision Advice and Other Information

Scarborough Community Council:

 

1.         Requested the Manager, Service Planning, Toronto Transit Commission, to report back to the next meeting of the Community Council on May 25, 2011, on the timelines of the construction of the Pedestrian Bridge.

 

2.         Requested any party who considers that the Pedestrian Bridge project is being unduly delayed, to report directly to the Acting Deputy City Manager - Gary Welsh.

 

3.         Requested the Acting Deputy City Manager – Gary Welsh, that if the Pedestrian Bridge is still not built within two years from now, to report back to the Scarborough Community Council at that time.

2 - Motion to Amend Item moved by Councillor Glenn De Baeremaeker (Redundant)

That:

 

1.         City Council authorize staff to amend the Official Plan and/or Zoning By-law, as may be required, to amend the provisions contained within the Section 37 Agreement that applies to the Equinox project on Brian Harrison Way; such amendments, if approved, to require the developer to provide $850,000 towards the following improvement projects:

 

* $350,000 for the Scarborough Civic Centre Library and adjacent lands

* $100,000 for the Scarborough Animal Centre

* $100,000 for the Cliffcrest Community Centre as a one-time grant

* $100,000 for the parking lot at the Thompson Park Tennis Club

* $100,000 for the Scarborough Walk of Fame as a one-time grant

* $100,000 for the cricket pitch and other property improvements at the Centennial Community Centre.

 

2.         City Council direct City Planning staff to report on this matter and hold a public meeting at the Wednesday, June 22, 2011 meeting of Scarborough Community Council.

 

3.         City staff require the Developer to pay $850,000, Section 37 contribution before the release of a Letter of Credit, and that staff report to the budget committee to include these projects in the appropriate 2011/2012 capital budgets, with a net zero impact on the city budget. 


3 - Motion to Amend Motion moved by Councillor Chin Lee (Carried)

That Motion 1 by Councillor Ainslie be amended to provide that if any party considers the project is being unduly delayed, they report directly to the Acting Deputy City Manager - Gary Welsh.


4 - Motion to Amend Motion moved by Councillor Raymond Cho (Carried)

That Motion 1 by Councillor Ainslie be amended to provide that if this particular bridge is still not built within two years, staff be requested to report back to the Scarborough Community Council at that time.
