City Council Decision

City Council on June 10, 11 and 12, 2015, adopted the following:

 

1.  City Council adopt the confidential recommendations in Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor and authorize the public release of the confidential recommendations and City Council direct that the balance of Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor remain confidential.

 

The following confidential recommendations in Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor were adopted by City Council and are now public:

 

1.  City Council authorize the City Solicitor to advise the Ontario Municipal Board that, subject to the City, the Toronto District School Board and Toronto Lands Corporation entering into an agreement of purchase and sale for the acquisition by the City of lands as set out in Executive Committee Report - Item EX6.6 (or making alternate arrangements therefor satisfactory to the City Solicitor) and subject to the resolution to the satisfaction of the Director of Community Planning, Scarborough District, of all matters related to the appeals, the City supports the settlement of the zoning by-law and draft plan of subdivision appeals for the residential subdivision and the site plan referral for the new secondary school on the basis set out below:

 

a.  the zoning by-law for the residential subdivision shall be substantially in the form attached as Appendix 1 to Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor;

 

b.  the proposed conditions of draft plan of subdivision approval for the residential subdivision shall be substantially in the form attached as Appendix 2 to Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor; and

 

c.  the conditions of site plan approval for the proposed school shall be substantially in the form attached as Appendix 3 to Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor.

 

2.   City Council authorize the City Solicitor, in consultation with the Director of Community Planning, Scarborough District, to support Council's decision to the Ontario Municipal Board, modified as necessary in the opinion of such Officials to reflect the intent of this settlement, and to finalize the elements of the settlement, including the final form of the minutes of settlement and other planning instruments. 

 

Appendices 1, 2 and 3 to Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor are now public and can be accessed under Background Information (City Council).

 

The balance of Confidential Attachment 1 to the report (June 9, 2015) from the City Solicitor remains confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice or communications that are subject to solicitor-client privilege and it pertains to litigation or potential litigation that affects the City.
