CC31.22 - 68 Daisy Avenue - Request for Directions Regarding Ontario Municipal Board Hearing

City Council Decision

City Council on July 4, 5 and 6, 2017, adopted the following:

 

1.  City Council adopt the confidential recommendations contained in Confidential Attachment 1 to the report (June 29, 2017) from the City Solicitor.

 

2.  City Council authorize the public release of Confidential Recommendations 1 and 2 contained in Confidential Attachment 1 and Confidential Appendices 1 and 2 to the report (June 29, 2017) from the City Solicitor.

 

3.  City Council direct that the balance of Confidential Attachment 1  to the report (June 29, 2017) from the City Solicitor remain confidential at the discretion of the City Solicitor as it contains advice that is subject to solicitor-client privilege.

 

The following confidential recommendations in Confidential Attachment 1 to the report (June 29, 2017) from the City Solicitor were adopted by City Council and are now public:

 

1.  City Council authorize the City Solicitor, and other appropriate staff, to attend the Ontario Municipal Board hearing in support of the Zoning By-law Amendment application for 68 Daisy Avenue as revised and described in the report (June 29, 2017) from the City Solicitor and as set out in Confidential Appendices 1 and 2 to the report (June 29, 2017) from the City Solicitor, subject to the applicant agreeing to accept the Settlement Terms as set out in Confidential Appendix 1 to the report (June 29, 2017) from the City Solicitor, to the satisfaction of the City Solicitor and the Chief Planner and Executive Director, City Planning.

 

2.  City Council authorize the City Solicitor, in consultation with the Chief Planner and Executive Director, City Planning, to finalize the elements of the settlement, including the Zoning By-law Amendment and any other related planning instrument and including all necessary agreements as may be necessary to give effect to the settlement.

 

Confidential Appendices 1 and 2 to the report  (June 29, 2017) from the City Solicitor are now public and can be accessed under Background Information (City Council).

 

The balance of Confidential Attachment 1 to the report  (June 29, 2017) from the City Solicitor remains remain confidential in accordance with the provisions of the City of Toronto Act, 2006, as it contains advice that is subject to solicitor-client privilege.  The balance of Confidential Attachment 1 to the report  (June 29, 2017) from the City Solicitor will be made public at the discretion of the City Solicitor.
