City Council Decision

City Council on April 24, 25, 26 and 27, 2018, adopted the following:

 

1.  City Council adopt the confidential instructions to staff in Confidential Attachment 1 to the report (April 17, 2018) from the City Solicitor.

 

2.  City Council authorize the public release of the confidential instructions to staff in Confidential Attachment 1 to the report (April 17, 2018) from the City Solicitor and City Council direct that all or part of the balance of  Confidential Attachment 1 to the report (April 17, 2018) from the City Solicitor remain confidential at the discretion of the City Solicitor.

 

The confidential instructions to staff in Confidential Attachment 1 to the report (April 17, 2018) from the City Solicitor were adopted by City Council and are now public, as follows:

 

1.  City Council further authorize the City Solicitor, together with City Planning staff and any other staff or outside consultants as appropriate, to attend a Local Planning Appeal Tribunal hearing to oppose the appeal of the Zoning By-law Amendment application and the Site Plan application for 25 St. Dennis Drive, as revised February 2, 2018 and February 23, 2018, and to support the position outlined in the Request for Directions report (October 13, 2017) from the Director, Community Planning, North York District, and as set out in Confidential Attachment 1 to the report (April 17, 2018) of the City Solicitor.

 

2.  City Council authorize the City Solicitor and appropriate staff to seek revisions to the Zoning By-law Amendment with the applicant to address the issues outlined in the Confidential Attachment 1 to the report (April 17, 2018) from the City Solicitor and the Request for Directions report (October 13, 2017) to the satisfaction of the Chief Planner and Executive Director, City Planning, the General Manager, Transportation Services, and the General Manager, Parks, Forestry and Recreation, in consultation with the Chief Engineer and Executive Director, Engineering and Construction Services, at the Local Planning Appeal Tribunal mediation scheduled for May 2 and 3, 2018, and to report back to City Council on the outcome of the mediation and discussions, if necessary.

 

3.  City Council authorize the City Solicitor and appropriate staff to seek revisions to the Site Plan Application, in the event the Zoning By-law Amendment is resolved in accordance with Instruction 2 above, to the satisfaction of the Chief Planner and Executive Director, City Planning, in consultation with the General Manager, Parks, Forestry and Recreation, the Chief Engineer and Executive Director, Engineering and Construction Services and the General Manager, Transportation Services.

 

The balance of Confidential Attachment 1 to the report (April 17, 2018) from the City Solicitor remains confidential at this time in accordance with the provisions of the City of Toronto Act, 2006, as it pertains to litigation or potential litigation that affects the City or one of its agencies or corporations and contains advice or communications that are subject to solicitor-client privilege. All or part of the balance of Confidential Attachment 1 to the report (April 17, 2018) from the City Solicitor will be made public at the discretion of the City Solicitor.
